Hi All,

I had my interview yesterday. It went great and my IO was the nicest one I've met so far.

The questions asked were...

1. If the President can no longer serve who is next in line?
2. During the Cold war what was the main concern?
3. What is one right from the first ammendment?
4. Who is in charge of the executive branch?

And I can't remember the other two. I answered them all correctly so she stopped at 6.

Make sure that you carefully review all the your personal information that they will use for your Naturalization Certificate. They had my telephone # and my former nationality incorrect - they said I was from Ukraine - not United Kingdom. If I had missed that, she said they would have charged me $300 to reprint the certificate with the correct information.

Also, I had been sent a yellow letter asking to supply last 3 years of tax returns (which I had already sent in) but she didn't ask me for them. Instead she asked me fro proof that my husband and I had been living together since I filed for removal of conditions. Luckily before I left the house I had grabbed a few bills, letters, cards etc addressed to both of us so she was very happy with that.

The whole thing took about 20 minutes. Then she said that she didn't know when my Oath ceremony would be - I just have to wait for a letter in the mail. Hopefully it will be soon...

WHOO HOOO!!

Finally received my interview letter today 6/26/09 - scheduled for 08/11/09. Would someone please update the list for me.

I'm really pleased because I thought I was going to have to drive to Denver for the interview (3 1/2) hours from me but it is scheduled to be in the same place as I got my biometrics done which is only 1 hour away.

Time to get studying!!

I just received my biometrics notice in the mail today. It is scheduled for May 26th. Would someone please update me on the list?

I was hoping that the ones I had taken less than a year ago would still be current but I wasn't so lucky...

I just received my NOA1 today. It was dated May 4th. Please would someone add my NOA date to the list?

I agree, it is definitely a paired down version of all the other NOA's I have received. It just says that the above application has been received by our office and is in process and then says to check that they have my date of borth and address correct. Thats it?

You only have to pay taxes if you earn money in that country, so if you are living and working in the US only, then you shouldn't have to pay taxes anywhere else - as far as I know. I don't pay taxes to the UK - only in the states.

The US doesn't recognise any other citizenship and in the oath you 'give up' your citizenship to your original country, BUT if you come from a country that allows you to have dual then you can still be both. For example the UK lets you have both but Sweden does not.

There is a list somewhere that tells you the countries that allow it. Can't remember where it is though. Maybe try to google it - I'm sure there will be some info on there.

If Romania allows you to have dual citizenship then you don't need to do anything. Once you have your oath ceremony here you will be a US citizen AND a Romanian citizen - i.e. you will have dual citizenship. However, if Romania does not allow you to have both then once you have the oath ceremony here you will no longer be a Romanian citizen.

Oooooohhhh. I just checked the status of my passport and it was mailed to me yesterday.

I really want to go on vacation on Tuesday so I am praying that I receive it by Monday so I can book a last minute beach vacation......... I'm so excited!! Fingers crossed I get it by then.

Just wondering if this is wishfull thinking or not...

I applied for my passport using the normal processing service on 17th September. I keep checking the status of my passport on the usps website and it just says it is still being processed.

I really want to travel next Tuesday (20th) and according to the website it hasn't even been shipped yet. So, I am hoping that maybe they have sent my passport but they haven't updated the system yet (like what happens with the USCIS website) or is the website accurate and they really are still processing it?

So, has anyone received their passport when the website still says it is still being processed?

Oh thanks so much for the replies! I had no idea that my husband didn't have to be at the interview. I didn't do enough research!

We've definitely lived together with our kids the whole time, I just didn't know whether his time away for work would be considered not "living together". Guess I can actually send my N-400 shortly then. I've just requested our tax transcripts though, I will now have to do some research on whether I need to send those with the application or if I only need them for the interview.

I think I may have to ask a lawyer to get a definite answer -- but I thought I'd ask here first in case anyone had a similar experience.

Hubby and I have been married 7 years, will have my GC for 3 years in April 2008, so I could theoretically send my N-400 this month. However, in the last 6 months, my husband's job has been on a rotation - month on (overseas)-month off. He's obviously home with us the months that he's off, but when he's at work, he's overseas. Does this disqualify me from filing for citizenship based on the 3 year marriage since he's not around all the time?

Another thing, if I am able to file, I assume my husband has to be at the interview. I'll be taking my chances since my interview could be scheduled at a time that he's out of the country working. Would I then just have to try to reschedule it?

I'd be filing at the Denver office. Thanks for any tips!

Besides sending tax transcripts/returns and children's birth certificates (we have 2 children), how much documentation should I send for my application that's based on 3 years of marriage? I have TONS of stuff...mortgage statements, bank accounts, life insurance, health insurance, etc etc etc.

Do I mail copies of all of these in? A select few? Or should I just bring all the documentation to the interview and only mail in the tax transcripts/returns and children's birth certificates?

I requested the tax transcripts exactly 3 weeks ago (by mail), and they're not here yet! I have no idea why I didn't request them by phone, I think I was trying to avoid hold time and didn't realize the request would be automated. I went ahead and requested them by phone just in case they didn't get my mail request.

Anyway, I noticed that the M-477 specifies: tax returns, bank accounts, leases, mortgages or birth certificates of children OR IRS tax return transcripts. I do have pdf copies of our tax returns, birth certificates of our children (born 2002 and 2006), mortgage statements, etc etc. I'm just itching to send my application out. Should I wait a few more days for the transcripts? Or can I send in my form with the other documents instead (and just bring the transcripts to the interview?

Not much was required I was assuming it would be the same, but it was only a few thousand which I had in my current account, he was not interested in my spreadsheet.

By the time I cam to adjust status, my wife had left work and gone back to Uni so we were going to use co mingled assets. The Officer decided it was too much hassle and just used the data she had from when she was in work.

The Consulate are requiring proof that you have met within 2 years.

 

USCIS was a different agency/issue.

 

To file a waiver for the overstay he first needs an otherwise approvable petition.

The only thing I knew coming into this is that Annulments are difficult in PI and iffy activity in getting one or avoiding seems to be rife.

 

I was pretty certain that if it was this easy to get around then it would both be common and probably have a section in the guides.

 

I assumed that not a lot of effort was used to track him down, assuming his current location is unknown. Judging from some comments he is known to be alive. Which suggests his location is also known.

 

So no I could not see the Consulate going for it, a few seconds searching and there was link after link about the subject.

I was married several years ago, but my husband went to work abroad, and we really haven't communicated that much since then. 

I met and fell in love with an American citizen in the Philippines, and we want to get married. I know that I must get my first marriage annulled before I can marry my American boyfriend, and some of my friends are suggesting that I get an annulment based on "presumptive death" of my husband. Do you think it is a good idea to get a presumptive death annulment, and will I encounter problems at the U.S. Embassy once I marry my boyfriend and am petitioned for an immigrant visa?

A presumptive death annulment is where one spouse effectively "disappears," and the spouse left behind does not have any contact nor has any idea of the whereabouts of that missing spouse for at least 4 years. That surviving spouse must go to court and obtain an annulment based on the presumption that the missing spouse is "dead." However, the U.S. Embassy is concerned or suspicious about presumptive death annulments, because in many cases, the spouse who obtained that annulment knows very well that the "dearly departed" spouse is very much alive. Therefore, the supposed legal basis for the annulment is untrue. In such a case, the presumptive death annulment was improperly obtained, and the U.S. Embassy may not give legal recognition to that annulment for purposes of issuing a U.S. visa based on a subsequent marriage to a different spouse. 

I had one case where a Filipina was "caught" by the U.S. Embassy with a bogus presumptive death annulment. Like you, she met a U.S. citizen, whom she wanted to marry. She then went to court and obtained an annulment based on the presumptive death of her first husband, whom she had supposedly not seen in several years.

The problem was, that with a court decree declaring the husband "dead," some relatives thought that this might entitle them to some form of inheritance. Other relatives, knowing that the first husband was very much alive, filed papers in court (including a currently dated, notarized affidavit by the "deceased," and pictures of him), challenging the presumptive death annulment.

The Embassy was somehow able to obtain information and documentation that the deceased first husband was alive. (They may have obtained records from the courthouse, the relatives who challenged the annulment may have written a letter to the Embassy, along with a copy of the affidavits, or the Embassy may have contacted relatives of the "deceased" spouse). Accordingly, the Embassy would not issue the visa to that Filipina based on her marriage to her second husband, because she was still married to the first husband, as he was still alive.

Therefore, if you truly know that your current spouse is alive, you should NOT obtain an annulment based on presumptive death, as the Embassy will investigate.

Instead, if you want to terminate your marriage, you should do so based on valid, proper, legal grounds, so that you will not run into problems if your intention is to marry another spouse (for love) and obtain U.S. immigration benefits through that second marriage.
