If you intend playing the stupid card I would really pass it by a lawyer first.

K-1 Fiance(e) Visa Process & ProceduresExperimental Drug Use :(

If you Boiler had taken a couple of drags off a joint one time as a 17-year-old, would you classify yourself as a misuser or abuser of drugs?

Maybe not abuser, I guess that would depend on how many drags, but unless I had a prescription then certainly a misuser.

There is a minor problem with the drugs, I think, a potentially major one about lying about it.

I really would not keep digging that particular hole.

Personally I would have a legal consult.

They really need to ask that question in a different way...

Have you ever used drugs? =/= Are you a drug abuser? -- in my mind anyway.

I hope everything works out for you. I'm sure it will be fine.

He admitted to taking an illegal drug in his medical report but 'forgot' about it when he answered the question.

I would not even try and talk my way out of that one.

It does not matter how you are paid, cash, cheque, direct deposit, it matters what you are paid.

Pay cheques and a letter from the employers stating his income should suffice.

K-1 Fiance(e) Visa Process & ProceduresPlease tell what does this Mean

Oh and by the way, we weren't denied. We're going through Administrative Review because they want to check my background to verify that I just started a new job. So thank you guys..Like I said I would PREFER people who are from Jamaica and familiar with the Jamaican embassy. Yes I know it's the U.S. Embassy, but the way things are done varies from country to country. Look up Administrative Reviews and you'll see how some people are dealt with.

That is new.

You can have things like this Expunged from your record.
Cost time and money but is a option .

Not for Immigration purposes.

He asked a question, got an answer - maybe.

The rest seems irrelevant.

Makes me wonder however on what basis he was in the US, work visa?

If you want a definite answer then you need to ask a question that has a definitive answer.

K-1 Fiance(e) Visa Process & ProceduresReporting visa fraud
I really think he has got the message and repeating it time after time does not help the issue.

No harm in writing a letter, making a phone call, as long as there is no expectation of anything much happen.

He has obviously lost out financially and other wise, I can not imagine there are many people who have not been taken advantage of one way or another.

I feel really sorry for the guy in Florida.

If you can't be together in the States though you Could be together in Ngeria. I know you say she has a good job there and family, but we all have thse things but when it comes to love we are all giving them up, or at least putting them on hold. The main thing is being together. maybe you could marry, live in Nigeria where she could surely find plenty of work given her vocation and file for CR1 a year or two down the line? Best of luck and don't give up hope yet!

Seconded.

K-1 Fiance(e) Visa Process & ProceduresMoving Back... will somebody think about the children...

I researched something Gary said earlier and it looks like we would have another option. I believe my family could move back to Cambodia, and sometime before my stepdaughter turns 21 (she's 7) I could file for an IR-2 for her because I am a US citizen, and I married her mother before she the child turned 18. With this visa, my stepdaughter would receive a 10-yr green card upon entry to US and if she decides to stay in the US at that point, she could meet the residency requirement for naturalization after 5 years.

Seems legit...

Correct, but you need a US domicile, but that can be worked around.

To file for the child would require a US Domicile.

K-1 Fiance(e) Visa Process & ProceduresVisa denied

Hi I am engaged to a girl in Malaysia, we are getting married in May. I have been to see her twice and am going again in about a week. However she has not yet been here to the USA to meet my family. We tried to get her over for the holidays but her visa got denied. We tried to get a "tourist" visa since we are not getting married in the U.S. Should we try a "fiance" visa instead? Can we, even though we are not doing the marriage here?

any advice would be much appreciated!

-Val

Won't your family be going over for the wedding?

K-1 Fiance(e) Visa Process & ProceduresHas anyone met fiancé while they were illegally in USA?
Assuming he has illegal presence of more than 180 days after the age of 18 he will have a ban, 3 or 10 years.

However you can file a waiver for that ban - I 601 - which will allow him to enter either as a fiance or spouse.

It does not matter whether you go fiance or spouse route for the waiver, there are advantages in going the spouse route in other areas.

CDJ is by far the easiest Consulate to go through, after all this is their staple business and they are very used to dealing with this sort of situation.

Just to make sure there is nothing that can bite you, have at least a consultation with an Immigration Lawyer, can be done by phone:
