ANd to all the people that are being mean and saying that he needs to stay out, thats not what I asked, the courts already judged him. He did his time, paid for his crime. That is done and over with.  SO since you are a US CITIZEN because you commit a crime they should deport you as well? His crime makes him less of a US CItizen than you? Come on doesn't make sense.    He entered the US as a citizen.   Both parents knew he was a citizen, see above.   He presumably stated that he was a LPR when arrested, tried, sentenced, jailed etc..   He was deported as a LPR.   Neither parent saw fit to mention he was a USC. One of the friends was an exchange student and we were turned away from the Canadian border crossing because he required a visa. We drove to the ferry crossing and when they asked about citizenship the reply was "all US", same thing coming back. I shiver at the thought of what would have happened if we were caught. Perhaps not the same at the Mexican border, but definitely a different time pre Sept 11. This happened post 911.   False claim to US Citizenship is a life time ban, no waiver. US Citizenship General Discussion	Stuck with the Cover Letter	Hello! we're ready to mail the packet tomorrow but I'm stuck at a very simple thing, The cover letter. I was looking for samples here and I noticed that some people say "Enclosed please find MY...." while some others "Enclosed please find MY HUSBAND'S/WIFE'S". Who's supposed to sign the cover letter? the previous two (for K1) were signed by my husband but now that I'm the one applying for citizenship I thought I'd be the one signing? The cover letter is completely optional. It doesn't really matter who signs it or not. But if you do choose to use one, it's your citizenship application, it makes sense for you to sign it - if you want to sign it. US Citizenship General Discussion	Help! Failed To File State Tax	Hi, everyone! I just filed for N-400 (citizenship) today, but still worried about the status of my state tax. I had no way of knowing that my husband failed to file the 2010 state taxes until we got a mail from Ca. state. We filed it immediately and got a respond from them approving us for payments. Had anybody got the same problem before but still passed the citizenship? Your reply is highly appreciated. Since you have now filed and have payment arrangements you will be fine. US Citizenship General Discussion	Naturalization Interview Concern	Thanks for all the responses people. Here's an update: I talked to a lawyer and he's advised me to postpone the interview for now until he can do a little more digging on the issue. First of all he says that the officer that interviewed me for AOS may not have written anything down in the file which may not hurt my case as things stand but that in the event he wrote something down, a new officer that interviews me could want to review the AOS file if I answer yes and could even revoke my GC since his view would be that it should not have been given in the first place. That's the worst case scenario he says but even though the chance is small, the consequences are too big and the attorney says he may advise that I abandon the application to remain on the safe side (i.e. don't go to the interview). The attorney will get back to me this week with a final recommendation. Will update when I hear back. No, the worst case scenario is they initiate removal proceedings and hit you with a lifetime ban. If they do have evidence from your AOS, that is what will happen. The lawyer won't be able to help. There are very few scenarios in which one can get away with a false claim to being a USC, and yours is not one of them. Best of luck. If it was me, I would withdraw the N400 altogether. Any LPR who has a false claim of USC should forget about naturaliztion. Better to stay as a LPR than get permanently removed.	Dakine10	Male	Russia	2012-03-12 08:24:00
US Citizenship General Discussion	DUI and speeding tickets - Maryland	Probation for a year I believe, which puts me another year behind. I read a lot of questions about DUI cases on different forums and it seemed like it shouldn't cause much problem. I guess I will have to contact someone, it's unfortunate bc it will cost me few hundreds dollars. The DUI wouldn't have been an issue, but the fact that you are now on probation will be. Here's why (in summary): § Sec. 316.10 Good moral character. (c.) Proof of good moral character in certain cases (1) Effect of probation or parole. An applicant who has been on probation, parole, or suspended sentence during all or part of the statutory period is not thereby precluded from establishing good moral character, but such probation, parole, or suspended sentence may be considered by the Service in determining good moral character. An application will not be approved until after the probation, parole, or suspended sentence has been completed. So the first thing is that they cannot approve the N-400 while you are on probation. I had DUI in 2007 when I was on J-1 visa. First I got Probation before judgment, quickly changed into conviction because I had to leave the country. I got green card in 2009 and i removed the condition in 2011. Is the DUI going to affect my naturalization application at all? I also got 2 speedin tickets in last 6 months. They are paid off but one is showing up as a probation case. Is probation for speeding ticket considered a lack of good moral character? Thanks for help. Current probation combined with previous DUI conviction can be a issue. How long is your probation? But so far from what I've been reading it seems like you should be fine since its been 5 years since DUI. I don't think speeding tickets really matter ( if fine is less than $500) . But it just mine opinion and may not be right . P.S. I've seen many ppl asking similar questions but not all of them at all let us know about the outcome of the case ..( were they denied or approved) . It sure would be so helpful if they did let us know . I'm not so sure about this. US Citizenship General Discussion	When would you file??	I am able to apply for citizenship and was looking to do it mid/the end of February. We have since decided to go visit my family in Canada at the end of June which means I would have to get a passport since my Canadian is expired. Would I be better off filing in February and hoping I get my citizenship in time to get a us passport or should I just wait till we get back/ when we leave to file and renew my canadian passport? US Citizenship General Discussion	N-400 FILERS - MARCH 2012	My passport is still in my maiden name.....wondering if this will cause a problem at interview? dont worry JandC, my passport was expired and with my maiden name on it like yours, but when i was interviewed last week of monday, the interviewer never bother to ask for it, she only get my green card and my colorado ID..as long as you have the marriage contract with you..your ok, but just the same bring your old passport just in case they asked for it ( bring all the original papers you submitted when you file the citizenship just to be ready) ..good luck on your interview.. US Citizenship General Discussion	N-400 FILERS - MARCH 2012	hi eddy67, i was interviewed last Monday, and the interviewer told me she's gonna ask 10 questions, but after i answered 5 correct answer straight, she stopped and said very good and proceed to reading and writng test which i passed and right away i was told you passed and recommended for approval. You must have 5 correct answers out of 10 questions to pass. I'm happy that everyone took the interview here passed and i congratulate you all..the interviewer told me too that if you come prepared, you will pass, i am lucky too that my interviewer was so nice. I guess everyone here reviewed well Good luck on your interview and hope this help you on your question. I have not really started studying yet but I think I am confident on about 75% of the questions...... I am curious just how strict they are if you get some wrong. US Citizenship General Discussion	N-400 FILERS - MARCH 2012	Passed the interview today!!! My interview schedule was 8:45am today at Weaver Place, Centennial Colorado. We live close to downtown Denver and traffic was a little bad going to Centennial, my husband and I was there 15 minutes before my time, thank god we made it on time. At exactly 8:45, IO called my name, and we went into the room, introduced herself, and asked me to stand up and raised my right hand bla bla bla, let me to sit and right away asked the 5 questions then handed me a copy of paper and she asked me to read the question, then gave me a piece of paper, and ask me write down the answer while she's dictating it. She started to ask me the questions on the application, those no and yes answers. Then she made a mark on her paper, and congratulated me that I passed, and i am recommended for approval, and i should come back on 1:30pm for the oath taking. It only takes 15minutes for the interview and the lady IO was sooooooooooo nice. We went home and came back 30 minutes before the oath time, and a lot of people were there already when we came. At exactly, 1:30pm, all of us were asked to go in the oath taking room, 3rd floor. We were lined up, and there were 2 people collecting the green cards and one lady getting the paper and escorting us where to seat. The oath takers were on the right side and the guests were on the left side. The host let us watched a clip for about 30minutes before the ceremony began. It was touching on me specially when we take the oath and reciting the pledge, can't believe i am now a citizen of the United States, and most of all, my day with USCIS is over..hahahhahaha. Everything took almost an hour to finish and we were out there by 3pm. The host said that there were 36 nationalities in the room taking the oath. To all March filers that's still waiting for the big interview, just be calm and come prepared. As long as you review the 100 questions and disclosed everything on the application, nothing will go wrong. Good luck to all and thank you for all the well wishers, this site really help me, thanks again guys.. My 5 questions was: 1. What is one right or freedom from the First Amendment? 2. If the President can no longer serve, who becomes President? 3. There are four amendments to the Constitution about who can vote. Describe one of them 4. What do we show loyalty to when we say the Pledge of Allegiance? 5. What is the name of the Vice President of the United States now? And the reading test is about the old city, cant remember the whole question, and the writing test which the Interviewer will give you and let you write it down the answer..was New York. Weaver Place, Centennial CO? that's where i'm gonna be interviewed. US Citizenship General Discussion	N-400 FILERS - MARCH 2012	congrats MCKS....way to go March Filers, more approvals to come.. Please add one more approval to the list... My appointment was at 8:10 AM and I reached at 7:20 AM. Interview was on time and the Immigration Officer was very friendly. First i took the oath and then she asked for my Passport, GC, and State ID. Then she started reviewing the application and verified all the details on the application. In the middle of reviewing the application, she let me know that we will be going through the Civics test. Below are the questions she asked: 1)How many ammendments does the Constitution have? 2) Who makes Federal laws? 3) What is the name of Vice President of US now? 4) What is the highest court in US? 5) What group of people was taken to America as slaves? 6) Why did colonits fight the British? Then she asked me to read " Who lives in White house". Then I wrote " American Indians lived here first". She then went back to reviewing the application. She kept writing a lot of stuff on my applicaton (not sure what) and then she went through the Yes/No questions on the application. I had answered Yes to one of them "Q16 Part D" and she asked me to explain the circumstances. I explained her the situation and she cut me off and went back to asking more questions on the application. Then she stopped and said " I didnt mean to cut you off but I know that there are lot of travelers who cross the border accidently to Canada at Niagara falls. They should do something about it" That pretty much explains my situation. She laughed and I laughed as well. She then asked me why my wife didn't accompany me, to which I said that she wants more sleep since she is pregnant. So she didn't want to join so early in the morning. She congratulated me and asked our due date etc. Then she asked me to sign at the end of my application. She put the Approved stamp and went on to print additional documentation. She then congratulated me and let me know that I was being recommended for approval. She said there is usually one final review of the application but other than that I'm all set. She handed me the Oath paperwork. My Oath is scheduled for July 4th at 10 AM. Really exicted to be part of the oath ceremony which is planned at the Space Needle. US Citizenship General Discussion	N-400 FILERS - MARCH 2012	congrats DARUMA07 goodluck on the interview tomorrow MCKS and Ridion Ruchie passed her interview today! Her civics test was very easy! She only remembers the first 4 questions,,,, 1. What is the supreme law of the land? 2. What is the highest court in the US? 3. What is the capitol of our state? 4. Who has the power to veto? She had to write "Freedom of Speech" She had to read a sentence about Freedom of Speech He went over some parts of the N-400 application and told her that all the files really looked good . He then congratulated her and told her she passed her interview and civics test. He then went to get her a form called the N-652( Naturalization Interview Results) It told her she had passed the inteview and civics test and congratulated her and said your application has been recommended for approval... He said to make sure to bring her Greencard when she reports for the Oath Ceremony. She will be notified when she is scheduled for her Oath Ceremony..... No more USCIS!!!!!!!! US Citizenship General Discussion	N-400 FILERS - MARCH 2012	congrats dash-tx... thanks for the info.. Guys, sorry for the delay to post my review. Too much celebrating! I applied for US Citizenship based on 3yrs marriage. I arrived at Dallas office at 7:30am, was called in about 8:15am. Interview lasted about 20min or so. Officer wasn't very friendly at first (not even good morning) but after a few minutes she started to loosen up. Since she noticed I could speak English well, she jumped straight into the civic and writing portion of the interview. Some of the questions were: Who servers if the president is unable to serve? Explain one of the 4 amendments about voting? Why does the flag has 13 stripes? Name one right of all Americans that is on the first amendment? (can't remember the other 2) She stopped at question 6, since I got all correct. Reading question was "Which state has the most people?" Written answer: California has the most people. I joked about my bad hand writing, she smiled and said most people had it worse than mine. She then went on to look at my file. It seemed like she hasn't seem my file before (it was huge! every single piece of paper I ever sent to them) The file was divided from AOS, ROC and Citizenship. She asked me address, DOB, etc and then the YES and NO questions. Asked if I worked and showed an interest in my job, kept asking questions about it. She was curious why I had traveled outside US 7 times over the past 3 years, I explained I have to go overseas for work. She didn't ask for anything I had brought, besides GC, DL and passport. Not even my latest tax return. Didn't ask for original of anything. Then she said it all looked good and I was approved. She left to get a piece of paper and came back with a form for me to come back same day at 1pm for oath ceremony. The whole interview was in a very friendly mood and I wasn't nervous at all. She talked how behind she starts her day and I asked how many more cases she had that day, she said 13! I came back for ceremony at 1pm yesterday, and there were 70 others from 27 countries. I was expecting more from the ceremony. It seemed like they are doing so many that it's not very personal anymore, the officer was reading off a page all she had to say and was mechanical. But it was emotional to sing the national anthem knowing that I was about to become american. It lasted about 1 hour and I got my certificate. I'm finally done with USCIS! US Citizenship General Discussion	Did anyone include the Police Certificate with N-400???	Hi Guys, I have a question if did anyone included the Police Certificate with the N-400 Application? I always used to include the Police Certificates with the applications ., but forgot to do it this time..is that ok??? Besides,ive got a speeding ticket,but still didnt include the Police Certificate because i forgot. Will my speeding ticket cause the delay in processing of N-400? I was sober ,just was driving 10-19 miles over the speed limit. I appreciate your concern. Best wishes. Hi Guys, I have another question,does anyone has an idea why Denver ,Co district Office doesen't have an information on N-400 Proccessing times??. Is that a system mistake or ?...Maybe i should call 1-800 number and notify them about it so they gonna fix it? Here whats happening,,ive pasted it here. US Citizenship General Discussion	Citizenship eligiblity	We were going to be gone most of the time anyway. So we were going to get hassled as it was. Now, I just don't care. I'm pretty well pissed at the hypocrisy of the government of The United States of Mexico Jr. and have decided to just move to China. In China, I'm never questioned. I can yell at policemen and they apologize to me. In China they neveer ask me why I'm there or when I intend to leave and why I bought anything. In China, everyone is a capitalist and socialism is dead. In China I pay no taxes and can live unfettered. The guards at the community walk my dog and carry my wife's groceries. In China, everyone that works for me is genuinely happy to have a job. Other than that here are the only differences: In America you can yell at the President and Congress and tell them you wish they were dead. In China this will get you dead. In America if you yell at a judge you will go to jail. If you yell at a policeman (San Diego) you will likely get shot to death several times over. In China, you can do both, its expected. In America, the government says its a republic but is socialist. In China the government says its a republic but is socialist. Wait a minute.....
