Removing Conditions on Residency General DiscussionTravel outside US while waiting for ROC
Hi All,

My green-card expires in November, we are just putting the ROC package on the mail. What happens if I don't get any NOA or response and I travel outside the US after the 2-year GC expires? will they give me a hard time when I enter the US and they see that the green card is not "valid"? it worries me a little...

Give me any thought on this.

Thanks.

Removing Conditions on Residency General DiscussionQuestion on pictures
I was putting together my I-751 package and I had selected some pictures of us on vacation and with family members. Is is enough to color print them on sheets of paper? do they really need originals? since mine are digital they are easier to print on normal paper, just wondering if that is enough...

Removing Conditions on Residency General DiscussionChange of address not updated by USCIS?
Maybe it is a silly question but has anyone experienced that their change of address was not updated? We filed AR-11 electronically and the other form that had to be mailed in about a year ago and I just received in the old address (belongs to my brother in law) the notification for removal of conditions. Didn't they update it?? will this mean that after we send the I-751 the NOA will go again to the old address? what can I do to make them update the address, any suggestions?

Removing Conditions on Residency General DiscussionAR-11 change of adress ?

We filed the AR-11 and I-865 one year after we moved to the US. We used my husband's brother in law address for the I-130 and we were a little bit late filing the change of address. We just sent the I-751 and realized that I had not included the "old address" in Part 3 (point 9), but I never lived there... will they think it is weird if they look at the dates?

You might also investigate pursuing Direct Consular Filing - DCF - to get the new green card since you are both out of the country. Be prepared to move to the US when he gets the green card though.

From what I read it seems they got the DCF done in Paris already.
Here is a question: how do they know (USCIS) how long you are out of the country. I travel 50% of my time and everytime I enter the US they ask me how long have I been gone? First I thought that information was on the computers, but now I doubt it...
Anyway, I would still encourage them to file I-751 and see what happens.

Removing Conditions on Residency General DiscussionWalk-in biometrics without notice?
Hi All,

I was wondering what the general opinion was in this case. Here is my problem: I am leaving on Friday morning for 2 weeks on an international trip. I was hoping to get my biometrics appointment notice this week and do a walk-in... but so far we have not received it yet. I am afraid I will miss it if the note arrives while we are gone. I was thinking of going tomorrow morning (after mail man delivers) and explain my situation... What do you think? is it a good idea? We have about an hour drive, so it would not be too bad.

Thanks,

Kitten

Easy! You should get the 1 year extension within a couple weeks. After you get it make an Infopass appointment and go get a temporary I-551 atamped in your passport.
CSC is fast and you should get your biometric appointment within a month or so. Obviously you can't leave until you do biometrics. If you have plenty evidence you "should get the 10 year GC without an interview. Most peeps do so.
[/quote]

Why can't you leave until you do biometrics? shouldn't the NOA and the expired GC be enough to enter the country? We just mailed our I-751 and I am going back to Spain at the end of the month without doing biometrics. Of course my GC does not expire till November, so I should be ok if I come back before that.

Removing Conditions on Residency General DiscussionUnderstanding Removing Conditions CORRECTLY from Spain???
Hi there,

I think we need a little bit more of information to be able to help you better. Did your husband activate the actual GC, I mean did you physically receive it after POE? How long did you live in the US after that?

We also did DCF in Madrid for me two years ago and we activated the "entry visa" (which is not the actual GC) when we first entered the US. Then the actual GC was sent 3 months later to our home address here in the US. We are now removing conditions to get the 10 year one.

I do not see why it is wrong to do the removal of conditions while in Spain, maybe you spend equal time in both countries, so why would it be wrong? some people just jump and make comments without knowing the real situation, just be patient and we can all figure it out.

But I also would agree that maybe it is easier to do a second DCF in Spain and get directly the 10 year GC... no removal of conditions needed there, that saves some time. Moreover, the embassy in Madrid is pretty tolerant with paperwork and processing visas or green cards.

Hope my comments help a little, hang in there,

Kitten

I must be the biggest dunce on the planet.I was going to apply for I-751 3 weeks ago but saw that it costs a lot,so decided to wait till after I got back from a trip abroad and then file.

Then a friend tells me yesterday that I have to file 90 days before the expiry date! Now I am 2 weeks late.I filed the papers today, sent them by overnight delivery, explanation and all.

The thing is that we had planned a trip abroad for my brother's wedding and we are leaving in 4 days!I will be back in 2 weeks. My conditional GC expires 2 1/2 months from now.Is it wise to travel?or should I wait for some receipt from USCIS?Will I be asked at the port of entry to provide documentation to prove that I filed I-751?I keep reading about deportation everywhere and as the father of a 5 month old(she & my wife r citizens) ,it scares the hell out of me.

Any advise will be very valuable.

Thanks in advance

Don't worry, I did the same as you. I waited a little bit more than the 90 days (I filed exactly 2 months before expiration of the GC), and then I travel outside the country while they were processing the I-751. I got my biometrics appointment and I was not here, but it was easy to re-schedule it and get a new appointment. When I entered the US they did not question anything since the GC was still valid. I do not think you will have any problem. Just make sure somebody can check the mail for you, specially for the bio appointment, in case you need to re-schedule it.

Helen...

If you continue on like this, you will have a coronary and all your efforts will be in vain.

Please calm down. You posted in the November filers thread "Add me please. I send my package on 11/10/2009 and they received it on 11/12/2009 green card expires on 01/15/2010." (bolding added by me)

You are travelling in December 2009. Unless I am missing some unknown fact, you do not need your extension letter to travel in December.

You already went through this process to get the conditional card. You are working yourself up over something that should be a non-starter.

Enjoy your time with your family. The extension letter will come before your card expires. The 10-year will come when it comes, especially important to remember when dealing with VSC.

Good answer Chaplin! I also get upset sometimes reading so many posts of impatient people :-) I was also impatient but at least did not bother others (kept it to myself), something to consider...

According to your timeline you r marriage was January 2007. Since it appears your marriage was more than two years old when the GC was approved... GC appears to be correct... no removing conditions.

But, doesn't it start counting from the moment they submitted the I-130 petition? that was in 2008 and they had been married less than 2 years then... I agree with you that the GC was approved 2 years after marriage, but I thought the time counted from when the petition was sent...

Removing Conditions on Residency General DiscussionCan I file I-751 from another country?
QUOTE (irene5269 @ Nov 16 2009, 11:34 AM) <{POST_SNAPBACK}>
If we're able to lift the conditions BEFORE filing for the I-751, that would be ideal.

My question is, can we file an I-751 from another country? We are not here for military reasons, as I've stated, but we do have a premanant residence in America. I've not read anything that says you CAN'T do this, in fact, I haven't found any information on this situation at all. Hence my presence here.

Thanks to anyone who can help us with this!

But isn't the form I-751 the same as lifting conditions? somebody else correct me if I am wrong.

I heard from somebody else here who was filing I-751 from another country, in principle you can do it, but you have to prove residency in the US so it might be tricky if you have not been living here. Although I think in your situation and given all the facts you have enough proof to show why you have not been able to live in the US till now.

Hope someone with more knowledge can help you on this.

The attorney didn't provide a basis, but she was re-assuring and said that there was no reason to worry about deportation since we are not engaging in fraudulent behavior and that we are still married. She said our only option was to re-file and asap for a permanent (10 year) green card. She sent me the G325A form.

This shows she (the attorney) is lost and sleeping, and was not looking for your best interest. Get another one more competent!

Why didn't you file the I-751? Like Otto said, there are ways to explain to USCIS the reasons why you didn't file (don't tell me you guys "forgot")

I agree, that is not good... You guys should get a good lawyer right away and see what he can do, unless you have a believable excuse for missing the deadline, you will have to re-apply for a new GC.

Removing Conditions on Residency General DiscussionSeptember 2009 I-751 filers
Congrats to all those who already got approvals!!

An update on my bio, I must be the only one who did a late one... I had to reschedule it since I was not able to make it earlier. We went yesterday to the Denver office, it was really quick, took only 10 minutes. Now waiting time starts again...

Removing Conditions on Residency General DiscussionNew processing times - is the USCIS lying?
Hello, I am so glad to find this topic! My husband filed for removal of conditions with an I751 of 1/16/2007 and we have heard of others who filed THIS summer and already have their renewed GC (NOT at the NSC though). He is going through the ceiling with disbelief at how this could take so long.

Feel free to add him to the list as CAPG. I751 Notice Date: 1/16/2007, biometrics 2/15/2007

Here's what we have done so far. A few weeks ago we called the NSC and found that the Customer Service Reps knew less than we did, they just read from some sheet of paper exactly what we could already read on the web and on our paper form. Called again about a week later, same exact experience. This person did express surprise that the online status had passed the 1/16/07 date and we hadn't heard anything.

Then he made an InfoPass appointment, we went there last week. There were less helpful there. They did give him the stamp in his passport so he could travel but got testy when asked why it was taking so long, she had NO information as to why or what or anything.

My husband also contacted an immigration attorney he told me to wait until 30 days past the receipt date, I doubt an attorney will be able to do anything.

As for the person who said the online status is the date the apps are put on someone's desk, that is not correct according to the website: The easiest way to monitor our processing time is on our website, where we post the filing dates of cases that we are now completing. We list this information for each kind of case and for every USCIS office and service center. This lets you project how long it will be before your case is completed.

So as the Orig Poster stated, they are being less than honest.

CanadaLooking to be with my boyfriend but not ready for marriage...
I guess it comes down to whether your skills are sufficiently attractive to a US Employer to go through the time and cost in this market.

Canadahealth insurance company recommendations

It would be great if we could 'tailor' health care plans but generally the employer decides what options they will offer to their employees and usually offer 3 or so levels of coverage, each with increasing levels of benefits and premiums, with premiums also increasing depending on individual or family and the age of the employee.

Your husband should receive a notice of what packages are available about a month or so before his annual enrollment date. He is only allowed to change his plan on the enrollment date anniversary or if there is a life changing event such as marriage or birth of a child, which often provides a month or so window of opportunity to add them into the plan. It may be that his employer only offers one option and has different rates for individual or family coverage.

Health care costs are obscene in the US, mainly because they have added a middleman - the insurance company - who sits there between the patient and the doctor with their hand out, taking money from you and your employer, holding the majority of it back for themselves, then passing the rest on to the doctor. You can be sure that the sole motivation of the insurance company is their bottom line and certainly not the well-being of the patient or the doctor. It is becoming increasingly difficult for employers to find affordable options that they can support on behalf of their employees as well, so in many cases they too pass along a lot of the expense to the employee and minimize their own financial commitment. There isn't a one size fits all though, so you can have the range of absolutely horrible health care coverage to wonderful coverage with different employers and with the same insurer. It all comes down to money - who is willing to give the most of it to the Insurance companies.

It sounds like you are blaming the messenger.

Firstly the majority of Medical Costs are incurred by the Government, then large employers basically self fund with maybe insurance to cover catastrophe issues, for example say they expect their medical costs to come to $20,000,000 next year they may buy insurance in case it exceeded $25,000,000. They then but basically a claim handling service, often from an insurer.

Small group schemes and individuals are insured in the conventional sense but that is a relatively small percentage of the total spend.

In my state insurance premiums have to be approved by the State Insurance Commissioner.

There are endemic issues with the US system, there is an awful lot of waste. Certainly one of the problems is Employers being involved, it would be much more transparent if they kept out, but most of it is down to Politicians being paid to legislate a corrupt system.
