Removing Conditions on Residency General DiscussionPlease help, PR arrested for simple possession AFTER AOS, now time for ROC
There is no waiver for this in the I-751. The section labelled "criminal history" in the instructions for the I-751 tells you what specific evidencce to in relation to the crime. This will not affect your removal of conditions.

The reason you need an attorney is that while they won't deny removal of conditions because of a crime, they are allowed to initiate removal proceedings. A single possession of less than 30g is not a deportable offense so in my opinion you should be safe from removal proceedings, but that's just my opinion - which is why you need an attorney.


Also a little quirk, this single offense should not make you removable, but it would make you inadmissible. If that happens, it would mean you couldn't leave the USA safely until after you gain citizenship. Check this with the attorney too, I'm not always completely up to date on recent legal changes, but that's how it should play out.


So to summarize - consult an attorney, but don't lose too much sleep in the mean time.

The second marriage won't mess things up, but not removing the conditions on your residence will. If you can't afford an attorney, you will need to do it yourself. Follow the guide. Download the forms. Ask questions here and you will get help. Somehow you need to get this done.

You will lose your permanent resident status and be removable if you dont get it filed by the 2 year anniversary.

I saw your other post in the IR1/CR1 forum and you mentioned about starting marriage counseling. If your marriage still ends up in divorce and you still want to help her with the removal of conditions, you can include a documentation of your marriage counseling sessions as part of proof of marriage entered in good faith. Since this will show that you did try to make the marriage work but it unfortunately did not go well.

I don't know what that colored text means... can somebody please educate me on this. thank you!






The blank should contain a form of ID (e.g. Passport, Driver's License, etc.) to be presented to the Notary Public. This is to check on the identity of the person doing the oath.

An evidence we would be including is the copy of Urgent Care Clinic discharge papers which show him and me being treated for Strep Throat at the same period of time. If that's not an acceptable evidence of being together, I don't know what is. :lol: :lol: :lol:

My husband filed in April in Vermont Service Center, and like the rest of you, has not yet received his new green card. We are currently in the process of buying a house and we close next week. I suddenly started freaking out about this affecting our ability to close. Has anyone shown their foreign passport + expired green card + extension letter for something as big as this without a problem? Or does anyone have any experience/advice they can share? Thanks in advance.


We just bought a house last month and we were in a similar position because my GC was expiring this month and we haven't even applied yet for ROC at the time of closing because we were wanting to include the "house papers" as evidence. Anyway, one problem we encountered was that I don't have a Credit Score because in my 2 years here, I never wanted to get a credit card or any loan of that sorts, so I have no credit history. However, my husband and I talked to our mortgage broker and she found a way to still put me in the loan and deed of the house by putting my husband as the Primary Borrower and me as a Co-Borrower. So most of the financial requirements are based on my husband's ability to pay, Credit Score/History and others. I have to submit documents too but they are just to satisfy documentary requirements. That said, I think that the best person to consult about this is your mortgage broker or bank representative because they can actually find ways to help you. Just tell them the situation (like we did about my immigration status) and they would surely find a way to help you with the loan and closing.

We had the same situation. What we did was wait until we had access to the new house (in your case, you already do) and then do a change of address online. After which, we used the new address in everything - filling up the forms, etc. This way, all the communications and letters from USCIS will be sent to the new house. It's simpler that way.

Copy of pages of passport is not needed. But if the biographical page of the passport shows a change in her last name (if she took your surname), then you might want to include a copy of that page only and this could be considered as a minor evidence.

Just a quick question by looking at all the timelines. We are outside US now and probably our Biometrics notice is sitting in our mail box. I was not expecting to see these early appointments, specially some occurring the first week of October. My husband will be back in the US on October 4th, so he will be able to check the mail, but I am not back till the 9th. If our bio is later than this date no problem, but what happens is we miss it? has anyone had any experience rescheduling it?

We sent ours priority from Colorado and got to California in one day (even though it was during labour day weekend)! so, I would have somebody else drop it in the mail, that way it does not arrive too early.

I received today the return receipt for my I-751 that we mailed 09/02... It didn't have a signature of whoever accepted it, just a stamp that says "USCIS Received--09-8-09". Funny thing is, since it was sent certified, I was able to track it down and according to USPS website, it was received at CSC on 09/04 (so what's with their date?). I feel like you, I think just a few pieces of evidence is enough. Our package was super thin, just an envelope and we are not worried yet. Maybe that is why the VSC takes so long... wink.gif looking at 3-5 pound packages... I wouldn't want to be one of them...
