Thanks for the support Vj-Newbie. The only things i can think of that i didn't send with my original package was a cover letter, don't think i sent a copy of my hubby's DL and i only sent summaries of our bank statements, i'm guessing they want to see transactions? we don't have kids yet so no Birth Certs to send.

 

This is a copy of the cover letter which contains a list of what i'm planning on sending by the end of next week....What do you guys think?

It's a freaking RFE! we sent lots of proof, don't know what else they need, but we'll resend it and hope we get approved. I'm disappointed.


Oh nooooo, Sis J! I am so sorry to see this! Be encouraged and send what they have requested. Was it something specific they felt was lacking? What did you send before?

The two of us have similar timelines and the Ghana connection. We should swap stories sometime about this immigration journey because most of the Ghana folks I know on this board have been going through the same hoops (e.g. Interviews, RFEs, etc.). Until then, know that we all support you and your hubby!

Hey VJ-Newbie, did you receive it yet? I think CSC is getting those things out pretty quickly in most cases. Did your check clear? That will usually come first. I think if you haven't received your NOA by now, it's a little unusual.

Our package is on it's way to the sunny and warm California! :dance: We're so relieved, a heavy weight has been lifted off our shoulders!

This petition brought back many painful and sad memories, our K1 journey caused us countless tears and sleepless nights. Me and my hubby were apart for 7 never-ending months, we were completely heartbroken and lost. Thinking back, our days were extremely empty and long BUT it was all worth it! We'd do it over and over and over again! Since I officially moved to US we were never apart again, not for a day, not for a night and I NEVER want to be apart again! I NEVER want to take my husband and our marriage for granted, we worked so, so hard for what we have today! My husband is the most beautiful and important person in my life and I love him so much it hurts! :blush: :wub: (L)

hi all, we've got our packet all put together and will send it off tomorrow! here's our list of evidence, in case it's helpful. I'm not sure if it's too much or not enough. I'm hoping it's more than enough. We get very nervous about these processes, probably stems from having to go through a really tough consulate for the original K-1, and of course the fact that our life together is on the line!

I am actually speaking from experience and from so many other people.

Technically, you can leave for up to a year without asking for permission in advance, but anything six months or more is very likely to be questioned and closely examined upon return, and an officer can determine on the spot that permanent residence has been abandoned with less than a year's absence. You just have to prove that you maintained US residence for me i used my parents and family was still here. Other things might be;



1. Joint property in the US.
2. Joint bank accounts in the US with activity on them.
3. Letter from university or workplace explaining that trip abroad was of a temporary nature.
4. File taxes always always always and always always always file as resident of the US.
5. Joint credit cards from US.

Another thing to consider is when the green card holder wants to apply for US citizenship. If they want to do it as soon as possible, they cannot leave the country for six months or more at a time. An absence of six months or more resets the "clock" on the three years.


There is a lawyer on another board who occasionally comments on Abandonment issues.

One of his comments was that very few Immigration Lawyers are familiar with the intricacies. His advice was to ask if they had ever tried a case.

There is a reasonable guide issued by USCIS, from memory they also send it with your Green Card. Better to read that than the above.

I can comply with your list for the UK, except 3 which is not gone to apply anyway.

And I have not resided there for 4 years.

Assuming he has the greencard he can be able to leave any time he wants. USCIS allows you to leave but you have to enter the united states at least one day a year. There is a form you have to sign but usually they are not very strict on it. I used the same criteria to live in Kenya and only came back to the US to keep my green card active for 3years. Just check with your local USCIS office they will give you more info. But there shouldn't be a problem.

I have never been asked for information about coming back on a return ticket, I can not think why they would ask or care.

And how would the US based Airline staff know anything about re entry anyway? There only concern is that you have the correct documents to enter your destination.

the airline admitted that they made an error in letting her and the baby board the flight in sao paolo and fly to Peru. that was not the fault of the travelers.

There is no suggestion that she did not have documentation needed to enter Peru.

The Airline seems to have procedure for checking her documentation at first check in, as they did not do this they did the decent thing, good on them.

Since when airlines decide if a passenger can get into the US or not? It's supposed to be the role and responsibility of the Immigration officers.
Anyway, she's flying back to Sao Paulo today and will go to the US Consulate on Monday.


The first time I came to the US was about 20 years ago, certainly then.

I am not sure how much you have traveled but it is normal requirement to ask for such info.

If I understand the situation she is travelling with an expired Greencard and without the original extension letter or an I 551 stamp.

So to summarize, for most people, you can use either a tax return transcript OR a tax account transcript. It doesn't matter.

The tax return transcript is longer. The one I have in front of me is 5 pages, vs 1 page for the tax account transcript for the same year. Both show the same relevant information that USCIS wants to see.

If you file(d) a 1040X for a given year, you would need to send a tax account transcript. The amended information is only shown on the tax account transcript.

I ordered copies of both when I was doing my AOS. I sent only the tax account transcripts for the previous 3 years. I did this for the sole reason that it was 3 pages instead of 15.

I also think that although they both have the relevent tax information, it is much easier to find that information on the 1 page tax account transcript. As a rule, I don't like to send USCIS any information in a format that will make them more likely to screw it up. They do that well enough already.

How might this incident impact the OP's naturalization?


LPR's leaving and reentering the USA are not normally considered a new admission. However if a LPR commits a criminal offense that would make them inadmissible under the INA and then leaves the country, the next entry can be treated as a new admission, which will result in the initiation of removal proceedings.

If you are asking how this will affect his citizenship, I believe this incident delays the ability to apply for naturalization until at least 5 years after the charge was dismissed.

We were married in 12/2009 and received my GC without any problems or an interview on 4/27/2010, which means I am 2 months away from my dead line for my ROC proceedings!! I was regrettably arrested for paraphernalia and marijuana possession (less than 30 grams) AFTER applying for AOS


Also just to clarify, the crime and arrest both occurred after you filed AOS?

There is no waiver for this in the I-751. The section labelled "criminal history" in the instructions for the I-751 tells you what specific evidencce to in relation to the crime. This will not affect your removal of conditions.

The reason you need an attorney is that while they won't deny removal of conditions because of a crime, they are allowed to initiate removal proceedings. A single possession of less than 30g is not a deportable offense so in my opinion you should be safe from removal proceedings, but that's just my opinion - which is why you need an attorney.


Also a little quirk, this single offense should not make you removable, but it would make you inadmissible. If that happens, it would mean you couldn't leave the USA safely until after you gain citizenship. Check this with the attorney too, I'm not always completely up to date on recent legal changes, but that's how it should play out.


So to summarize - consult an attorney, but don't lose too much sleep in the mean time.
