You have until the validity of the medical to comply, get the visa and fly to the US otherwise if her medical expires, she will have to re-do it and resubmit all expired docs like NBI clearance.

 

Medical is valid within 6 months.

 

NBI is valid within 1 year.

 

CENOMAR is valid within 6 months.

As she is pregnant and you have yet to file then it is highly unlikely a visa would be processed in the time available.

 

But you do have time available to get your income situation resolved, current income is what will count.

PhilippinesTB Sputum culture for 2 months

Hello everyone! 

I am petitioning my mom from the Philippines, everything went smooth until she had her medical at St. Lukes Medical Center.

She did her x-ray and they found out that she has some blurred on her chest and because of that she did some further test which is the Sputum Test.

 

She went to St Lukes for 3 days to do  the sputum test and thank God the result was negative. Just when I thought that everything was ok, they told her she needs to wait for 2 more months because of the sputum culture test. They will check to see if any bacteria will grow on her saliva. 

 

So my biggest question, IS IT POSSIBLE TO HAVE A POSITIVE SPUTUM CULTURE EVEN IF ALL HER SPUTUM SMEAR WERE NEGATIVE??? 

Has anyone experienced this situation and what were the results.   Any response will gladly be appreciated! Thanks in advance.

 

 

  I'm not familiar with St. Luke's protocol, but It is possible to have a positive culture with a negative smear. The culture is much more sensitive than the smear. The data varies, but around 15-25% of people with positive cultures and clinical symptoms have negative smears. TB is also a slow growing bacteria, which is why they hold the cultures for several weeks.

I know what you mean. It seems we get reports here of many different types. One pinay is asked for one set of documents, and then something completely different from anther Pinay. It is just outrageous that the nuns can make all these different demands. Especially after a visa is approved. Where is the consistency, and why do these nuns have so much authority to make up new rules and requirements as they go along? Im stressing more over the CFO than the interview.


i think it's because there are two NGOs doing the CFO seminar - PRISM and St. Mary's. The nuns run St. Mary's (obviously) and I didn't have a hard time with their seminar. It was straight-forward and informative. I have heard of not so good things about the ones from PRISM though. Actually, it's because of the bad feedbacks on PRISM that I chose to go at St. Mary's instead.

i don't know with PRISM but St. Mary's do the one on one interview and that's where the documentary requirements vary. This is probably because the interviewees have different situations (e.g. no Visa yet or the fiance has been divorced, etc.) and so there are different papers that the interviewers want to see.

for those who have yet to undergo the CFO seminar, i suggest going to St. Mary's. As for the documents you need to bring, bring all pertinent ones specially passport, birth certificate and copies of it because they will keep the copy for their record.

We chose the K-1 route because it will let us be together quicker. And it has nothing to do with the processing time, rather it is due to my mother being in Canada. As she is in a work contract, she couldn't go home to the Philippines until early 2010. And, of course, I want my mother in my wedding.

So my then-fiance talked to my father and mother about it and we all agreed that K-1 would be easier for us. Turned out for the better because my mother's employer nominated her for LPR Status in Canada and she would have to wait the process out before she can go home. And that might take until the end of 2010.

We'll start planning on a Philippine wedding just as soon as my mother's papers in Canada are all done. star_smile.gif star_smile.gif

I don't think you need the antibodies test. I didn't bring a record of my vaccines during the medical because I can't find mine which is probably buried somewhere in our new house. Anyways, they will interview your fiancee regarding the vaccines and would rule out the ones that she would be too old to get. They were just very particular about the Varicella vaccine and if you can't show a record or a scar when you've had contracted the disease earlier, they will give it to you. That's what they did to me.

The reason they ask for the last menstruation period is to make sure that you're not pregnant because one of the vaccines they would have to administer is not good for pregnancy. They would even tell you to make sure not to get pregnant within a month after the vaccination. Also, they would have to provide a shield for you during the x-ray if you're pregnant.

If the last menstrual period has been too long before the medical examination, they would just do a pregnancy test. They would ask though when was the last sexual contact.

If her menstruation comes on the day of the medical (just like mine did), she can still go through the other steps but they would tell her to go back for the physical examination when her period is over.

But there is no DELBROS anymore because I heard that it delayed some processing in the embassy and so they just removed it fairly recently. I was lucky that during my interview, the DELBROS thing has been removed already.

i have the unfortunate experience of having my menstruation start on the day of my medical exam because i am irregular too. but they let me proceed to do the othe steps like blood tests, x-ray, vaccine screening and other stuff. the only thing they didn't make me do was the physical exam where you have to disrobe for the doctor. they told me to go back for it after my period is done. so she can go for the medical exam and she would just have to tell them at a certain step that she has her period and they would tell her where to go next and they would just put a remark on her paper that the only step she hasn't went through is the physical exam.

The National Statistic Office (NSO) issues a Certificate of No Marriage (CENOMAR) in their "tamper-proof" paper. She needs to secure this before her interview with the embassy because she needs to submit this document. Note that the embassy requires the CENOMAR to be at most 6 months old. So it is advisable that she secure a copy near her interview date. The NSO processes request for this document for at least 10 working days.

I think a lot of your problems stem from miscommunication. You both have problems expressing what you need to say in a way that the other would understand. It's not the language barrier but more of a basic difference between the male and female brains. The degree of being different varies from person to person and so some couples are able to communicate well while others are simply not on the same level. My hubby and I suggest that you could go to communications enhancement classes as a couple. Unlike in couples counseling, these classes deal more with how you talk and listen to each other instead of the private details of your specific problems. Your wife might respond to this type of approach better because she will see that you are not blaming her about your problems, rather, you are telling her that you also need to improve so you can better respond to her needs. These classes will teach you techniques on how to speak to each other so that arguments over small things will not blow out of proportion just because the one misinterprets what the other is saying. There are a lot of other benefits from these classes and so are worth a try.

Annulment is the only legal route they can take at this point. It might be a long and expensive process but definitely worth the Peace of Mind. Besides, they won't be able to get married in the Philippines without Katie's Certificate of No Marriage from the NSO and when Katie applies for that, her previous marriage is gonna come up and she won't be issued the CENOMAR.

There might be other legal options IF Katie is already a US Citizen because the Philippines would recognize divorce if one party to the marriage is a citizen of another country where divorce is legal. The following is quoted from Wikipedia:

Philippine law, in general, does not provide for divorce inside the Philippines. The only exception is with respect to Muslims, who are allowed to divorce in certain circumstances. For those not of the Muslim faith, the law only allows annulment of marriages. Article 26 of the Family Code of the Philippines does provide that

Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien spouse capacitating him or her to remarry, the Filipino spouse shall have capacity to remarry under Philippine law.[11]
This would seem to apply only if the spouse obtaining the foreign divorce is an alien.[according to whom?] However, the Supreme Court of the Philippines declared in the case of RP vs. Orbecidio

Not sure what you mean by that, my whole fam was given 10 yr tourist visas just last March 2011 when they came to attend my wedding. My mom is visiting me again in a month and probably 1-2x a year for the next 10 years with the same visa. My tourist visa which they cancelled when I got my k1 was also good for 10 years. I got that visa last 2005.


That's what the US Embassy website said and you can check on the link I gave. It might, however, be a MISINTERPRETATION on my part as to the way they stated it. It could be that All Mutiple-entry visa issued before March 31, 2004 would be invalidated and they would just have to re-apply for it and it's just the Visa with Indefinite Validity that they are no longer issuing.

That is why I gave the link so they can read further and be able to see their options. :yes: :)

The US Embassy used to issue Multiple Entry B1/B2 Visas to eligible applicants (e.g. Businessmen who travel to the US regularly, etc.) but they are not doing this anymore since March 31, 2004. This is according to the website of the US Embassy in Manila. Your wife would have to apply for a new visa (or renew her visa) everytime she needs to enter the US with you.

Well, it was a simple performance and approval process at USEM today, and by bebeko was APPROVED!! Yeah, after all these months.... So happy to have completed another step.

However... we planned for her to go there now, so that her visa will be good until early Feb, when I will arrive back in the US myself (late Jan or early Feb). But the CO told her that her visa will only be good until 14 Jan!! Why only 5 months? This is a huge problem for us, since I cannot leave here until at least 21 Jan. Any idea why this happened?



Congrats! The Visa is valid for 5 months but she is allowed to stay in the US for another 90 days after she entered. So make her enter the US, maybe in December and then she will have 90 days more to stay legally but you have to be sure to marry within that 90 days. When she enters the US, the Visa automatically expires and the Immigration Officer at the POE will stamp her passport with another "expiration" date.

Go there as early as you can. Bring your passport, a copy of the letter from the embassy, US Passport size photos and copy of your vaccination record (if available). I also brought some biscuits and bottled water with me because the whole process takes a long time but most of it is due to waiting in line.

They will give you a something to shield your tummy and protect your baby during the X-ray procedure. This is also the reason why they will ask if you're pregnant and/or have a pregnancy test before they do any medical procedure/exam or vaccination.

I agree with Messybrownhair, you need to look decent and presentable so as not to give a wrong first impression. But be sure you are comfortable with what you are wearing because sometimes the waiting takes a long time. I think jeans are ok as long as it is not the crappy ones with holes, solid colored ones like maybe white or black would be good. Although I really don't like wearing white jeans because if it rains, it gets easily soiled. Flats are ok too specially if you are not fond of wearing high heeled shoes.

When you had a church wedding in the Philippines, did you file for the necessary papers like the marriage license and marriage certificate? Because if you did, then this would be enough for you to change your name in your Passport. If you still want to do a report of marriage, this is done through the Philippine Consulates in the US depending on which area you (or you're spouse) are living. Yes, they could make the dress for you in Divisoria or Baclaran because my friend's wedding gown as well as the entourage's dresses were sewn in a shop in Divisoria. You just have to shop around and try if you can get some feedback from their previous customers so you can be assured of good quality at a good price.

That's nice but be sure that they indicate that the travel tax is already paid with the ticket in their receipt so you don't have to pay for the tax twice. Coz sometimes, some people in the airport would try to make you pay even if you've already done that. So just to be sure, ask the travel agency to specify clearly that the tax has already been paid.

If you bought your ticket in the Philippines, it is most likely that the price already includes the travel tax but you have to check your receipt. If your husband bought the ticket in the US (like my then fiance, now husband did) you would have pay the travel tax. I paid PhP1,620 but this was 2 years ago. So maybe just prepare PhP2,000 to be sure. I learned about the travel tax during my CFO seminar so I guess they are more updated on the amount.
