There is not much a single person can claim in the way of means tested benefits. Obamacare might be a new issue but she does not qualify for Medicaid yet.

 

I know of no cases where the Government has gone against an individual, there must be some, surprised they have not been mentioned.

 

I recollect one case which involved a sponsored person seeking monies from their sponsor, that was many years ago, it was tied up in Divorce so not really clear cut as to the basis, I think it was something a Lawyer threw into the pot.

 

One thing was that the person had to mitigate their loss, ie get a job. so any potential loss would be the difference between the income and the sponsored amount.

 

If it was that easy it would be a sticky in some of the sub forums.

A few years ago I did have a positive from a US test. Momentary panic before both the Doctor and myself realised it meant nothing.

So no if it happened again I would not take medication.

You are being scammed, the US Consulate would have no interest in collecting such a penalty, something the Philippines Government would levy. And the Consulate would be familiar dealing with dual citizens.

My aunt said her son is recognized as a Filipino, but in the embassy, they consider him a US citizen. They are applying for a US passport renewal. He could not file for a Philippine passport either because he is not a Filipino citizen but his birth certificate states he is an American.

US will only recognize hims as a US Citizen.

 

I do not know Philippine law but I am surprised he would not also be a Philippine Citizen.

 

His birth certificate states he was born in the US, which due to unusual US law usually means he is also a US Citizen.

 

Are they asking you for money?

Perhaps its just a naive presumption on my part.  My thinking is that while she is in the United States, she is subject to U.S Law and her two divorces and my subsequent marriage to her are valid.  However, when she goes back to the Philippines, she would no longer be subject to US Law and the US would have to recognize PI Law.  How could the U.S recognize both PI Law that she is married and a contradicitng US Law that she is divorced at the same time?  Surely one would have to take precedence. no?

 

Yes.  I am attacking it based on fraud as well.  Getting an annulment is hard enough and probably impossible after 12 years.  I need to get everything I can before I proceed with this. 

As far as the US is concerned it is pretty simple, she is married to you.

  But if and when she retruns to the Philippines, she would still be considered married to the Philippine Citizen, which makes our marriage void from the beginning, which would annul the marraige.
