Putting that to one side:

There is no cultural or religious requirement for 2 chaperones.

The standard format response quoted above does not say send us a visa disapproval and we will issue a waiver.

There is no requirement to meet in the US or PI.

Let us say you did get a waiver, how would that then look at the interview?

You don't have to be rich to get a K1.

 

I have payed

 

1,400 for my flight out there the first time.

250 for the engagement ring (bought from a pawn shop because she told me if I bought her an expensive ring she'd kill me)

315 I-129F application fee (unless it's changed or whatever)

 

To finish it I'll need

 

~ 500 for the Embassy interview/ medical exam

~ 2500 for the flight to go get her and bring her back.

 

That's just me and your mileage may vary.

You have three threads going which are all inter related. So this applies to all of them.

Assume US immigration knows everything you do not want them to know, and nothing about what you do want them to know.

There is a waiver for a non immigrant visa which is easier than an immigrant visa. My guess is that you were not refused for the criminal issue, you never got that far.

Obviously it will be easier for her to go to Australia than you to go to the US.

Waivers, well certainly have a consultation at least with an Immigration Lawyer. It can be done yourself BUT you are going to have to put a LOT of work into it.

Wow i am amazed that an embassy employee told you such stupid things ! How didn't he/she know that you have to submit initial evidence with the I129f petition ! I mean you should have read the instructions (either on I129f instruction form or VJ guides) but as an embassy employee i understand that you just decided to trust him/her. This is just unacceptable! 

I think he realises he made a mistake.

Should you apply for a visa if you do not need one?

Why would he need a visa to visit the UK? Any U.S. citizen with a valid passport can enter the UK at any time.......

Nope.

 

Lots of Americans get turned away.

 

Admittedly the UK has a reputation for being a soft touch.

 

And you can always claim asylum if things get tricky.

 

I have seen many VWP entrants to the US forget about their criminal history and then when they try and immigrate it bites them. I am sure it works the other way around as well.

He should check to see if he can enter the UK without a visa, apply for a visa otherwise.

 

She does not specify what the criminal issue is, but sounds like it is not serious, not a CIMT and therefore she should apply for ESTA. With a recent B2 waiver it might be some time before ESTA would be reinstated. All depends on the nature of the caution. 

 

I have seen a case where both parties had serious criminal issues and could not visit each other, bad enough that no other country would want them either.

I did the course in Colorado, 3 days I think but I did other categories as well as life, the exams were multiple guess.

 

Now making a good living selling insurance is another issue.

Just to say that the person at the consulate, while looking at my picture, was like "so, what is the age different between you two?" and, with a very suspicious look, she then had a look at his picture while I was answering "14 years". Right after that, she approved our visa.

 

They are jsut trying to make you feel super uncomfortable which you already are usually. Nothing to worry about if it is bona fide relationship. 

 

Presumably you are going through Paris?
