Hello fellow VJ friends!
I want to post my situation and see if I can get some helpful tips/feedback as to whether I am on the right path.
I proposed to my fiancee last september, she is a Canadian citizen an I am an american. We have our wedding planned for july 20th in canada. our plan as it stands right now is to get legally married soon on her next visit and then she leaves back to canada after a short time. we then start on the CR-1 application and process while we are both in separate countries. during the time that it is pending I would travel to canada, where we would have our religious ceremony and then come back to the USA with my wife and wait until we get our interview date. We are planning on informing the customs officials that we are in fact married but we will have 2 way tickets for her and proof of ties back to canada (i.e. bank accounts, letters from employers, home adress, etc.) to show that she is not intending on staying here permanently without proper documents. once we get approved for an interview or once the 6 month maximum visitor time expires, I would fly her back to canada for her interview/waiting period for approval.
Is this plan feasible? Is it too risky to presume that the customs officials will let my wife come to live with me in the US with intention to return to canada for her interview?

Any feedback would be greatly appreciated!

There are a number of grammatical mistakes in your post. However mathematics is my strong point, not grammar. So I will resist correcting them.

One could comment that this would be evidence of the failure of the US education system, not that the UK one is much better.

However I just do not believe that someone born and brought up in the US wrote the first one, and I have doubts about the second as it does not follow common US vernacular.

So what? that doesnt mean she wasnt born to immigrant parents and English isnt her first language. It doesnt mean she graduated high school. It simply means shes a USC and she has resided here a great portion of her life. There are plenty of areas in the US that are multi-lingual. They are heavily populated with immigrants and local shops are operated in both languages. Havent you ever been to a place like China town? Or little Italy? A immigrant fluent in the language can live in that area and never need to speak a word of English and get by just fine. The US gov offers pamphlets and phone options for both English and Spanish. Saying or implying she lives here and therefore must be educated and or fluent is judgmental and ignorant.

Portuguese parents were mentioned.

Works for the State so that suggests a High School education at least.

If you added your surmise to the situation it would become even more suspicious.

A letter to your respresentive is to briefly explain your case and engage them. Once contacted they will be able to interview your wife for more detailed information about what happened. It actually might be more helpfull if your wife was on VJ at this point because most of what needs to happen is on her now not you. There is only a small chance Lagos will allow a second interview while the petition is still there. At times I think it is part of their money making machine to get the petition back to the US to generate more money in new medicals and all. What you will hopefully get out this is a good handle on exactly they reported as their reasoning for returning the petition. That will prepare you for when you face them again.


To be fair I think with this story any Consulate would have issues. The reasons are self evident and have been commented upon.

The foreigner is coming from Germany. So, in my opinion all this discussion of relationship evidence, tax filing status is a non-issue. As long as the case is properly filed, the relationship is unlikely to be questions. It's GERMANY, not Morocco or Nigeria.

The people who have problems seem to be ones pushing the envelope.

It is very very unusual to be asked more than the very basic questions. Assuming a regular visit.

Proof of owning property, why would that help showing you have to return? I can see it could help as far as financial standing is concerned.

But the millions and millions don't have any reason to maybe overstay or not return at all. Someone who has a wife or fiance in the US has a lot more reason to not go home! No ones saying that everyone visiting the US should bring ties to their country and the amount who do visit while on a CR1 petition i would think is very very few, there's also nowhere ive been able to see online that says officially you have to carry your NOA1 or anything else tying you to your country, however if you think about it its for your gain and makes perfect sense.


The millions and millions who have overstayed, usually there is no US Spouse or Fiancée in the picture.

If there is a USC in the picture then much more likely is that they would adjust, not overstay.

I would say most people who have the opportunity do visit during the process.

The NOA 1 does not tie you to anything, nor does a lease.

What would be one's advice regarding this: my wife owns her apartment in the Republic of Georgia and does not need to work (and therefore does not). Her passport is Russian. Since there is no lease, and no letter from an employer possible, how difficult does this make establishing her case that she will return to Georgia if she were to visit here? I know any answer is speculative, but I'm wondering if anyone has had an experience with similar circumstances. So far I've just decided its not worth the risk of being turned away.

My assumption and everything I have read suggested they do not have access to any immigration proceedings at the PoE.

There are occasional odd comments to the contrary but I have never seen them backed up.

You certainly do not need a NOA.

My NOA1 is from 6/8 and no NOA2. It passed 5 month time frame already and I cant reach any USCIS rep. on the phone. I just can call the toll free number and hear some general info, there is no option for me to reach live rep. Does anybody know how to reach live rep. on the phone?





after calling the toll free number when it says to report changes press 3 i think it is just push it and it will give u to a live representitive =)

So my husband was brought over here when he was 6 by his mother..but left the united states before turning 18 1/2. has anyone had a similar case like this..how do you prove to them( them being who) uscis or interview officer? that you did leave before turning 18 1/2..can you show them a plane ticket or how does that work? thanks for your time and answers =)
