I am going to suggest you talk with an Immigration Lawyer.

You are her financial sponsor, she never needs to work if she does not want to.

You would be her sponsor until she does 40 quarters of SS contributions, becomes a US Citizen, dies or leaves the country.

First you need to read the guides.

She could obtain a job with a company who would sponsor her, assuming she is suitably qualified.

And yes, if you marry and she gets here through that route you will be her Financial Sponsor.

I am going to assume that she was told she had no chance of getting a Visitors Visa, which sounds right.

but it will be very difficulty to say that staying in Germany is a hardship. As the lawyer said, if my wife was in a third world country or somewhere that she was endangered, or homeless without a chance where she was, then the chances of getting a waiver would be greater, but coming from a European country it will probably not happen, so we are looking at a three year wait.


This suggests to me that you saw a lawyer who does not do very many waivers.

Logically that sounds like it should be right. Reality is different.

By far the easiest is Mexico, I guess a 2nd World Country. In the next category I would put Consulates such as Frankfurt.

It is an English Comprehension test, you need a document that says the right things whether they are particularly true or not. You have a choice, DIY if you are of the ilk that will do the research or if you appoint a Lawyer make sure it is one who does this for a living, not a sideline.

I have no idea what the previous poster is trying to say, ignoring it, if you can understand it, would also be my recommendation.

I missed the bit about the quoted numbers, your Lawyer will confirm the ban so there is also the Waiver. You can do all the prep work in advance so you can submit a waiver when she is refused a visa. See www.immigrate2us.net for waivers.

You might as well talk to one of the recommended Lawyers on that site.

Sounds like she was refused entry rather than deported so no need for a waiver.

The actual coding they used will tell you one way or another.

It should be a fairly straightforward IR1, usually DCF is quicker if you can show German residence. Sounds like you are now US based.

If a waiver is needed then it will add time, cost and other issues. I certainly would spend the money to at least have a one time consultation with a US lawyer.

For others GC's used to be issued with no expiry date, however as has been pointed out the clue is in the name, you have to permanently reside in the US.

Anyway the important thing is that when you left you had a valid I 94 to hand in, that you maintained legal status during your time in the US.

Otherwise you will be looking at also needing a waiver for illegal presence.

She lost it by default by being outside of the US for more than a year. It is considered "abandoned".
