She have a letter from the Father giving the OK for the child to travel without him - Hague convention etc.

I am always slightly surprised that people studying in the US have such a poor grasp of the language. There was a post yesterday from someone who wanted to invite his Parents to his Graduation and it read like it had been written by a 5 year old.

Anyway:

I do not know if she has any other issues like a ban, struck me as being possible.

Just wondering how the PoE would take somebody married to a USC with a USC child turning up on a Student Visa... Might be an interesting conversation.

Can not say I know much about baby food, but like many foods it does vary by Country. Pretty sure I have seen the same comment about not being able to get in the US what you were used to in the UK.

If the child is not thriving and the speculation is that the child would fare better in the US then time for Daddy to get on a plane pronto. Which begs the question where Daddy is in this process. He sounds absent.

I would strongly suggest Daddy gets some Legal help.

That is just part of the process, mine took 6 months at the Service Center, 11 months overall.

I guess it is quick. My visa was not expired. It will in 2013

here was an interesting comment by Laurel Scott in one of her chats that over 90% of her clients with criminal issues claimed to be innocent.

There might be a few who are genuine, but she has no way of determining which ones.

So if she does not believe them how much more likely would it be that a CO would?

Arguing that you were an innocent dupe strikes me as a waste of time. You would need to prove it. What proof do you have?

99% of what has been posted seems irrelevant.

Unless he can prove to USCIS's satisfaction that he did not engage in Marriage Fraud to obtain an Immigration Benefit then that is it.

This seems from what has been posted highly unlikely.

He was heading for jail in the US, they do prosecute such issues.

My supposition is that she will need to be the one to move in this case.

One of her cases with overstay did not even need a waiver. Look her up on facebook. Her sucess rate is incredible.


It is the length of the overstay that counts - 3 or 10 year ban.

did I say that they shouldn't be together? What I said was it is cruel to imply that she should just let her child go. I am certain that if the Brazilian healthcare system can take care of the child sufficiently to provide a feeding tube, medications and testing that they will be able to keep her alive, not optimal but doable. Having a sick child is stressful and the parents deserve to be together to support each other, neither one of them should have to suffer alone with this. I have been waiting for my visa for a long time also but i don't resent these parents for doing what ever they can to expedite there request and I don't understand why so many people here seem to think it is such a terrible thing. Arn't we supposed to support each other on this journey?


I am surprised she can not get care in Brazil. But I have never been there.

She has the CR1 process plus it sounds a waiver for illegal presence.

None of this is going to happen anytime soon, expedite or not.

The expedite seems to be based on the Father's inability to look after the child in the US due to financial constraints and nobody else being able to, plus the medial necessity of the baby being in the US.

I presume all this has been documented but I am not certain.

So given the child has an immediate medial ondition requiring a speedy return to the US, what do you suggest?

Perhaps the best bet would be for the baby to go to his parents/family whilst the immigration side of things is being sorted out.

The baby's needs sound urgent.

Because they (mom and baby) are in Brazil, so his insurance isn't relevant. If they want private insurance they'd need to buy extra there from a Brazilian company.

I will have him call. But we can foot crazy expensive bills more than we alreadyhave sounless it covers almost all we will keepon the mercy of public health.

You appreciate it would have to be expedited at every stage and you are talking about reducing the time to months rather than years.

Did you resolve whether you need to file a waiver as well?

The expedite is due to the health of the USC child not the petitioner's deployment/military status.

I think it is more financial, the child can come back anytime.
