In Canada you cannot obtain any benefits as you are not a resident of the country.  I'm sure it's the same with most countries.  It's a residency issue, not a citizenship issue.  I bet the OP actually looked into the issue in Sweden and if you delved deep enough into the UK you may find the same thing.  

UK as well you need to be a resident in the UK, Citizenship and any status you hold elsewhere are not relevant.

 

I am also going to guess that what constitutes residency in the UK is different to both Canada and Sweden.

 

And that to get the answer you would need help from Google and to speak Swedish.

I doubt that her Citizenship is in question just because she has her US GC.

 

And I am sure that many people in Sweden obtain those benefits you mention without being a Swedish citizen.

 

From a UK perspective it is certainly possible to hold a GC and obtain those benefits. No idea what the Swedish rules are.

There is no 30 day rule, you can marry in the US straight of the plane.

Domicile will only be an issue when you reach the interview stage, sometime next year.

 

Sounds like you will have moved back by then and it will not be an issue. If you do not have the income at the time you can use co sponsors, your financial situation benefits etc would not be relevant.

Go to the site I mentioned, one of the comments often made is that if you want USCIS to know something it can be very hard, if you do not then they will find it.

There is a forum here about waivers and that web site I mentioned is mainly about waivers of different types.

 

First check what you are up against.

 

The process is similar, except he would be refused a visa at the interview and given the opportunity to file a waiver, last time I saw they seem to be taking 6 months or so.

 

Assuming a waiver is needed then whilst some people do their own, it does require a lot of work.

 

On the plus side if it is a simple overstay the success rate is high.

Yes, I was not there so not sure what that was or if it was required etc. I have no knowledge of that aspect of it all. Anyone have experience with that? He doesn't even remember if they gave him a copy of that paper (I assume so but he has ADHD so this stuff is a bit troublesome for him.)

You said in your first post that he had surrendered his Green Card.

Hubby is all worried because he had a green card once and had to give it up. He is asking if it is different once you've had one. Can he still AOS right now or is there some special legal provision that would make that not possible? Anyone know about that? I have been looking on the USCIS site and they really don't cover that

Also I don't even know if we have all the documents needed to file like his birth certificate and mine etc. I could get copies made and sent to us but again, we weren't planning on filing so obviously wouldn't prepare for that. We have our passports and her citizenship card but my SSN and the birth certificates etc. are up in Canada.

It would be 2 to 3 months before he could go and get your stuff, you could go sooner.
