Your propspective Employer would apply, can apply now for 1st October start. Some educational establishments are exempted from the start date.

H is dual intent, but unless they were really desperate not sure why an Employer would fork out for a H when you have another route.

I'm an american, and if they don't want my husband... then i'll spend the rest of my life paying huge taxes in another country. Their bloody loss!!

They also just lost my tax returns. ARG!!!! So I have to send them in new. Do they do that so I'll have to use their expensive courier service.

I'm ###### off with America now and not sure it's the place for me anymore.

Have to wait a month due to my own error = the US doesn't want my husband so I won't come back!

PS: US citizens have a lifelong burden to report their worldwide income & pay taxes if owed. If you stay under the treaty income threshold, you're not using US resources anyway, so we don't miss your tax revenue.

PPS: you should be able to fax them copies of the tax transcripts.

It could take one month to receive the green card packet after you send the new Affidavit of Support

Foreign income does not qualify as affidavit of support. Your domicile will change and your job will change as you leave UK to come to US. So this basically means you need a job in US.


Foreign income can count, I used it.

But if she was talking about her job, which she quit, then that she obviously can not count something she does not or will not have.

She could count it if for example she kept her job and would continue working but in the US.

Exactly - that's why your foreign-earned income, if it will end when you return to the USA, does not count. Your affidavit of support needs to show that you can support your husband after he enters the USA as an immigrant, not that you have been able to support him up till now.

The way it read was that she was refering to something other than earnings, she has no current job.

I have seen people who have had problems in this situation with capital, but not income from the capital, assuming it is in the USC's name.

Foreign income does count.
You would need evidence, you do not mention what the income is, dividends/interest? Would they not accept the capital instead of income, I know some people have had problems in this area.

Easy to get US Dollars, any Bank will arrange a transfer to a US account, plus of course London is full of Exchange Bureaus.

But with a large sum you need to make sure you get the best rate.




Well.... my income is accepted in my tax returns... but not in the I-864. So I had to redo it leaving my income as 0, although my tax returns state that I made over 60K. It's so retarded.

It was a huge shock to have that rejected. I've done so much research on that form!!!

I've been working in the UK for over 10 years. But thank god I can claim domicile in the usa as I did live in miami the year before last keeping my drivers licence and bank accounts and stuff. If it weren't for that... I would have to move to the usa without my husband to establish domicile.

I don't know how others do it. There's not too much mention of trouble with the I-864.

K3 is the same as DCF, it requires you to travel to Australia and get married there. Best bet would be to have him visit for birth then do K1 after he returns to Australia, Start the paperwork while he is visiting filling out the G-325A, Fiance Letter of Intent, I-129F ect so that he can sign and help make sure details are correct on those forms.

Be aware that sometimes the USCIS frowns upon marriage happening on a visitor's visa.

DCF usually assumes you are living in the foreign country.

I recomend the Guides on this site, and also get a copy of "Fiance & Marriage Visas: A Couple's Guide to U.S. Immigration" by NOLO, It explains all the options.

Hmmmmmmmm very confusing post.
*K-3 nor DCF requires you to travel to Australia and get married there. One can get married anywhere.
*The K-3 interview is held in the country marriage took place, wherever that was.
*DCF in Australia does not require that the USC is a resident. It is one of the very few consulates that allow this.
*One can get married in the US on a visitors visa or VWP. Many of us have done this including myself. It is only illegal to enter the US on such with intent to immigrate.
*Not so sure on the recommendation of that guide if what you stated was included in it ;)

Sounds like you need to avoid the book.

He is not guaranteed entry on the VWP, but if he has a job etc and he evidences it then hopefully he will make it.

In a few cases people have been turned away when trying to visit their spouse during the visa application process. The probability of entry while applying for an immigration visa will help us decide K3 vs. CR-1


There are many many factors that govern the success or otherwise of an entry, my guess the biggest one is pure luck.

Having a CR1 or a K3 in process would to my mind make no difference or be so low as to be irrelevant.

If we marry now, but apply for her visa only when i get upgraded to a Citizen, would that be quicker?

It sounds like you are confusing the requirements with maintaing permanent residency and those for obtaining Citizenship.

The latter are quite specific.

Last time I looked it was about 6 years for a LPR to sponsor a Spouse, so whatever your Citizenship timeline is, it is likely to be quicker than going the LPR route.

It might be a bit quicker to go the Fiancee route once you have your Citizenship.

Did not think non University Hospitals were exempted from the H1 quota, might be wrong. But normally you would be looking at finding an Employer first to sponsor you by April for a 1st October start.

Now I am sort of assuming you have the nouse to research this yourself, but a session with an immigration lawyer does no harm.

I am from the Philippines. I migrated with my family 5 years ago to the US. Went in and out of the US to finish schooling. But had the re-entry permit so the count to 5 years of residency was not broken.

Anyway... I want to marry my gf of 7 years already, and want to know which visa is applicable for her and is the best for us. I know i am not qualified for the K1 or K3 visa since i am still an immigrant.

We are both planning to go into medical residencies in the US. So time is of importance.

Which is the fastest way for her to be able to start working here in the US as a doctor? Should i marry her now and apply for this Spousal visa or should i file for Citizenship now and wait til i can get her a K1 or K3 visa? Which way will be faster for her to be able to work here in the US?

   No, it doesn't have to be withdrawn. 

 

   If a number of years have passed, it was either abandoned, denied, or possibly withdrawn long ago. At any rate you don't need to do anything with the old I-130.

 

   You will likely find out what happened to it when you interview with USCIS.

It has been 1 year 15 days since I left him the first time...and 5 months 4 days since my last visit with him.

Like S and S....good days then the bad days. Wish I was in one of the good days right now, but I am not. For the first time ever, my husband allowed me to see the toll this is taking on him also, this past Friday....it is very hard for any man to allow you to see him in a weakened state, and anta habibi is NO different!

We talk every night without fail, and we talk on the phone about every other day. We send e-cards, actual letters in the mail, and on the weekend we have our family time together: I speak with my Moroccan family on the cam and he talks with me and the kids, and my parents if they come over.

We also like to reminisce about our times together....it helps to have those memories!

We do not give up....no matter what!

After this Tuesday's 2nd interview....one way or the other we will be together! Either he is coming here or our son and me are meeting him in Spain or London to live.

It is not natural to be away from your spouse like this! It really isn't! Wives are meant to care for their families to nurture them...how can you when the key person is missing? Men are meant to protect and provide for...how can they when there is no one to do that for??

I keep remembering that we are not given more than we can handle....and in the end we will all be stronger for it! Our marriages will be built on a strong foundation, not sand that can so easily be washed away.

If you've known each other for at least 2 years: K1 visa is safe if you have documents to prove.
You can marry her in a Church (w/o a document) :-)

BUT: if you've known each other for less than a year......a civil wedding would satisfy the consuls more------- CR1 is probably better.

Anyway: this is my 0.2 cents:

Once your sweetie passes all her exams:
Philippine Boards for Nurses,
CGFNS (required in some states for foreign nurses)
IELTS exam (spoken, written english-----essay), reading test......used to be called TOEFL/TSE
NCLEX-RN (US Licensure for nurses - RN):

Always include the proof of PASSING with your papers: Copies only.

When an Consul sees that a K1 applicant is actually very qualifed to be a green-card holder (EB3 Employment-based visa for nurses): the consult will never never doubt the relationship.

This is because she won't need you to qualify for a green-card, actually since she has passed all the exams to work in US as an RN.
If the consul sees that she's in K1 visa in spite of her qualifications......they would think that SHE'S MADLY IN LOVE WITH YOU.

EB3 takes only about 15 -24 mos.-----Immigrant visa----shortcut-----no conditions-------she'll still be single.....and free to date anyone in US........
K1 visa is 5 - 12 mos---------conditional--------and needs to marry soon

If she would be still in a K1 visa,,,,,it means....she does not want to be apart from you.
'COz...... if she was in the EB3-----of course she goes to the state where the sponsoring Hospital (for Immigrant visa) is located.........away from COLORADO:-) and finish the 1 year contract.

Salamat. She passed the Philippines Board, the tests in the US will take some time, but she's not worried about that right away. She is willing to work at any job that will hire her.
The fact that comforts me is she doesn't need me to be a successful nurse or come to the US. She has a cousin in Ireland that offered to take her in and get her a nursing JOb, a job offer in Australia, and a cousin in Texas thats a nurse that was willing to take her in. Fortunately, she is in love with me. But I am going to do everything in my power to get her on the right track to success, because I love her.

My fiancee is a nurse now, just became so. During her schooling in the past two years she's had to have medical examinations: x-rays, the whole thing, even shots! If sh has everything on record, will the US Embassy accept that? Or is it manditory to go to St Lukes when they tell you to do so? She's just worried about the x-rays because of the radiation, since she's already had them in the past couple of years.

She's had shots, too, if she can verify, will she have to get them again?

Isn't there a list of all this information for the Philippines to US visa journey, anyway? Cou someone point me in the right directions, palihog?

Also, we do plan to have a wedding ceremony in the Philippines first, but not get a marriage certificate (keeping the wedding hush hush to the officials, of coarse) But exactly what is the risk we face of them finding out and her getting black listed? Id rather do things the hard way than ruin her chances, but we would rather get her to the US on a K-1 Visa and still have the wedding in the Phi first.

It seems like the USCIS people do not know how to update the addresses or do not know how to use computers. We also changed our address at the POE and still the card was mailed to the old address, we were lucky that the old address is where my brother in law lives, otherwise I would be under the same circumstances as you.

I feel like you Alan, I am going to hide my GC somewhere. And it makes sense if the penalty for not having it with you is only 100$ compared to the 360$ for loosing it, then I choose the first option. And anyway here in the US they only seem to ask you about your driver's license... so here we go...

Good news!! I finally got my GC after 3 months!!!!!!!!!! My brother in law visited us last week and personaly brought it to me.
Well, I guess I can relax till next year, it is a 2-year card, so I still have to go thorugh one more step on the paper-work. But for now, it is celebration time!!

I hope that all the ones that have not received the GC card yet in this forum get it soon. Be patient, things move very very slow...
