I would not say it is "easy" to get a waiver in any country. Mexico had 80% of the Waiver adjudications worldwide so they have a high number of approvals and a pilot system in place to deal with the volume. They also deal with cases very different from other countries and the high approval rate has a strong correlation to the fact that many of these cases involve an EWI where the person was brought here as a child ,and very strong ties to the US that go back for years, which gives them equities that might not be seen in cases adjudicated elsewhere. Consider a clean EWI case where the person was brought here as a child, and enters the I601 process voluntarily. Its a totally different ballgame than other consulates.

London presents some other obstacles, there is no language barrier, and similar living conditions to the US. Something to consider when "having the I601 handy" in case of a waiver need at the interview.


I did see the number for Mexico, it was higher I think than 80%.

I do not know what percentage of beneficiaries EWI'd before the age of 18, but as the beneficiaries hardships are irrelevant it does not really matter.

There are more significant differences between English and American English than there is between Spanish used in the US and in Mexico. The US does not have an official language.

I 601 situations, like this one, are pretty clear. It is not a case of having it handy, a case of being prepared to submit so you do not incur further delays.

By far the easiest country to get a waiver is Mexico, not a third world country.

On the other hand some third word countries are very hard to get through.

London is generally considered not too bad a consulate to deal with.

There is plenty of information around. I would put it at A level standard. Lots of people do their own, but if you can afford it or do not feel comfortable certainly go with a lawyer who knows their waivers.

Nothing will change for the visa for your wife. Except if she is pregnant when she is scheduled to have her medical. But its nothing to worry about really.

I'm assuming the child is yours. Once he/she is born, you can file for a consular report for a birth abroad and then get a US passport for the child.

I sent ours on Oct. 28, it was received on Nov. 5. I verified the check was cashed.....once I knew it was.....i then waited 10 days. When we did not get it, I called USCIS.......the man issued a new NOA 1 to us, and gave me the receipt number over the phone. With this number, you can check the status on line. Make sure when the call to USCIS is made, you explain that you have not received the NOA1, but know the check has been cashed. When I called, the agent was very helpful. Once you get the NOA1, send a copy of it with the packet for the I-129F.

I was just curious if there was a website or something that could inform me of the process my wife will go through in her country after the case is complete at the NVC and forwarded to the US Embassy in Manila.

After 7 mo, our case has been completed with the NVC. The interview should be in August or early September and she should have a visa by October hopefully.

I checked the webpage of the US Embassy here in Spain and they do not allow DCF anymore, does this mean that we have to send the I-130 to the Nebraska office? even if the US citizen is not living there right now?

Can you clarify if your husband (USC) currently resides in the USA? You state that your "husband still has an address there" not sure if that means he is currently in the USA or if he is living with you outside of the USA. The reason for this clarification is important, since if you assign your husband the Choice of Agent with his USA address, the NVC will send the documents to that address, and if he does not currently live there it'll make this difficult for you to get a hold of those documents. If he is living abroad with you, it may just make sense for you to assign yourself as the choice of agent. If he is living in the USA, then by all means assign your husband as the choice of agent.

I am just checking all the loose ends before we filed in order to avoid any surprises at the end. I want to make sure everything is tied and cool before we start the process. So, my question is: does it matter that I (spanish citizen, now married to a USC) lived in the US for 3 years under a J-1 visitor visa? I just wanted to ask you why did you need to get a tourist visa. I thought Italy was like in Spain, they have a visa waiver program (VWP) and that allows you to visit the US for up to 90 days, I have never had any problem visiting without a visa.

I entered Chicago last November on a CR-1 visa and I went through the citizen and resident line. They look at your visa and then they tell you to go to a separated area where an officer opens the brown envelope and looks at the documents. It was really easy and fast for me, no questions were asked.

I agree, I think she will be ok. I did something similar, I came here to the US last November (through POE) and then I went back to Spain after 3 weeks to spend Christmas holidays over there. I then returned in January, they do not question anything if you leave for less than 6 months. Also, it is going to take a while for her to get her green-card, so everything should work fine. By the time she cames back her green-card will be waiting for her.

I have been reading all the messages and it seems really strange that they asked about your CV. I am as well an Analytical Chemistry Ph D, plus I did my post-doc in the US (that was before getting married and going back to Spain for 4 years) and they never asked me at the Embassy for my CV. I recall there was a question somewhere about ocupation and previous jobs... but that should not matter either. They did ask me though at the interview what my job was and but I was planning to do in the US, but they did not seem to care. I think you will be fine, good luck and keep us posted!

Hi Guys,

Just a question to see if this was "normal". I have had my green-card now for almost 2 years and I have been in and out of the US several times, no problems and it always went really fast. This time the officer at POE (in Philadelphia) took my picture and my fingerprints, after asking a few stupid questions like if I had another passport... just as if I was a visitor again. Have you been in a situation like this? I feel like complaining somewhere because I do not think that after going through the process of getting the GC we have to put up again with things like this.

We did the I-130 for the CR1 only since my husband is finishing paramedic school and we didn't want to take any chances that the K3 would come in sooner than we were ready for. The CR1 was just a better option for us. Also, he wanted to be able to work immediately when he got here.

I didn't realize it until after I got my NOA2, but the NOA2 number was the same as the NOA1 number (WAC####...etc). (I'm sure someone pointed this out somewhere, but I completely missed it!) Use that number in the NVC system to see if your case number has been assigned. It was almost two weeks before I had anything in the NVC system. Hope that helps.

It was about 3 weeks from when I got my NVC case number to when the DS3032 and AOS Bill were generated. I just kept calling on Tuesday mornings and eventually the automated system told me it had been generated. Once I knew they were generated, I sent an e-mail to NVC instead of the 3032 (I still haven't received it in the mail as of yet) and my choice of agent was accepted in 2 days. So, I'd just be patient and check the NVC system every Tuesday morning for a few weeks.
