You cannot change a visa type once you start a petition, if you have a K-1 in the works, and then decide to marry before you have it you will have to start from zero and file for the CR-1 or K-3 visa.

We decided to get married before my K-1 petition could be processed. What should I do?

If you get married, your K-1 petition will no longer be valid. Your spouse will need to file a different petition, Form I-130, with the CIS.

I am doing a K-1 through Guangzhou, Started July 31, and expect to interview this Feb or March.


We started got the reciept June 22nd then in Sept. We recieved a RFE. Sent it back Oct ...recieved on the 6th. Then Nov 29th got a denied but with an appeal so we have started the appeal process.

I wish you the best ...Looks like you were just a little ahead of us. We had hoped for a Febuary or March Interview ourselves.

I need to ask a question since i have not been able to get clear answer from USCIS. My fiancee and I have already filed for a K-1 petition. Will it jepordize our case if we get married and have to change to a k-3 visa? Will we have to reapply and start from square one? Thanks for any advice on this.

Yea, I noticed that same thing. We got our approval email on a Sunday night. Most likly is has to do with the batch theory. I am sure they are doing this so as not to overload the server and slow the system down during working hours. This is what my company does anyway.

She doesn't need an SSN or TIN as part of the initial petition. When she is in the country she can apply for an SSN a week or two after she enters the US. SSN may be needed for marriage license in some states.

Not only 'no'. but she's not even eligible for one yet. Silly rumors. :) It's confusing enough as it is!

Do be sure to look at the SSA Guide here at VJ--she will have a narrow window to get a SS# when she first gets to the US.

I don't have any great advice about who would be a great co-sponsor. I'm in a very similar situation. I graduate from college in May, and should have a job shortly after that. I'm planning on having my parents co-sponsor, but am not exactly sure how that works. But good luck with everything! I'm excited to make some East Africa connections on VJ :D

We sent our I-130 in on December 4th using priority mail to the TSC. Our check cleared our bank account on the 15th and I believe they received our petition on the 12th. However, we never received a NOA1 in the mail and still haven't to this day. We called USCIS after about three weeks of not having received the NOA1 and they informed us that the case number is stamped on the back of the cashed check. We could not read the number on the back of the check, but the immigration officer on the phone was able to look up our names and tell us the exact case number.

I guess the NOA's get lost sometimes. But give it some more time to see if your check clears. Thats the important thing.

In the form-fillable version of this form, how does one enter multiple lines for Question 18? I type in a paragraph but it's one long sentence and the majority of it is not shown and all one sees is a "+" in the bottom right hand corner. Will I have to provide an additional sheet or is there some way to fit four or five sentences in this box via some sort of carriage return? (Hitting enter doesn't work as this)

Does this include those overseas occupations that may have been greater than 5 years ago (ANYTIME) that were in any other country? Or would this only apply in the past 5 years? In other words, is there any specific timeframe for this particular question?

I've searched this forum and I was unable to find an answer to this question. How strict is the 30 day rule? I mean if the photo is 40 or 50 days old, will it really matter? How would anyone know if no dates are printed on the back? How would anyone know they were taken 2 mos ago versus 1?

On a similar side note, I've seen conflicting "official" documentation that photos up to 30 days old and photos up to 6 mos old are acceptable.

Greetings all. First post on this site I do believe and I'm glad to see this thread. I, too, like many others here am in the process of filing for a K1 visa for my beloved in the Philippines. I am at the very, very early stages as I'm just trying to figure out what needs to be filed, filled out and sent in. I work in engineering and like to think of myself as an intelligent guy, but this is not an "easy-to-follow" process! :lol:

At any rate, I'm hoping to get the paperwork out the door and in the mail sometime early September. Mahal ko (my love in her Tagalog language) is working on what she needs to get to me to send in with the I-129F. It's funny because I've been reading and doing research on the process and it seems she knows more about it than I do just by talking to one of her friends that is going through the process!

So I'm guessing this thread will be used to post any/all questions or comments about the process? If so, I have a couple questions already...

1- What is an A#?
2- In the image below, am I suppose to put my birth certificate number in the space provided just below where "Birth in the US" is checked? Or is that provided if the "Naturalization" box is checked?

If it's for a birth certificate, which number do I enter? Because I have three different numbers on my BC. A District Number, Registration Number and some numbers and letters below a bar code towards the top of my BC.

It took our petition (from the Philippines) 101 days from the NSC transferred to the CSC.

Ok folks, I need some help, please. Have received the first NOA from Nebraska Service Center; receipt dated 9/27/06. USCIS website now says petition is now in California office. Site also says that the NE Service Center is now processing I-129Fs from April 18, 2006 (but I think this date has been same for a couple of months). Anyone on this list have semi-accurate idea how long the wait (backlog) between 1st NOA and 2nd NOA really is at the NE service center these days?

K1s are no longer processed by NSC and they's why you were transfered to California. (Same for the Texas service center). USCIS also restructured their processing times to give themselves a 6 month window to complete cases. Most cases donot take this long. An average wait out of California is 70-90 days.



When you do the timeline search timelines for CSC, NSC and TSC K1 petitions to get an idea how many people are going through from here on VJ and what their time estimates are.

He knew about the ban and the need for a waiver a long time ago, I know I partook in a thread with him about it at least a month ago in connection with expediting the waiver.

So he would have gone in expecting the denial with the I 601 to file. Which presumably he did. Just part of his process.

Is there something else?

He has applied for asylum. Anybody can apply.

You can never say never about anything in immigration, but the chances of him getting asylum is close to zero.

A delaying tactic, as the process takes years.

His best bet is through marriage to a USC, even then with his priors it is going to be a very messy process.

Why would a Brazilian claim to be from a country that does not exist and to an area he has never been to?

Why file so late, especially when there is a requirement to file with one year of entry or be presumed fraudulent.

The one common factor is the desire to stay in the US by hook or by crook.
