I'm just curious, when the NOA2 for the I129F is issued, does the case status on the USCIS site reflect that the NOA2 was issued? Or do you just recieve the NOA2 in the mail??

My fiance never received the NOA1 in the mail, so he called the USCIS's 800 number (it took him awhile until being able to talk to someone sad.gif ) I think you can them call after 30 days after you sent the petition (maybe 45? unsure.gif ) Once you get in touch maybe you'll be able to find out how you are doing in the process.

Did most of you send in the letter from your bank showing deposits and balances with the Initial I-129 or will my Fiancee only need this for the Consulate? In the instructions it does not state you need banking information so I am thinking the Affadavit of Support and financial information will only be needed once the initial petition is approved. Is this correct? While on the topic of finances I am wondering how much weight it holds. I have a job of course and am certainly way above the US Poverty Line and probably even above the US Average but that is only because I live in the SF Bay Area which has some of the highest costs of living in the Nation. For this area it would probably be considered below average but certainly not poverty(approx 45K annually). The affadavit of support asks for value of property, stocks, and bonds. None of which I have. I rent like many others in this area. I also have a daughter that I support(not through the courts but just between her mother and myself). Does anyone think this will cause a problem?


It is 125% of the Poverty number, you are about twice over it for a family of 3. So no sweat.

2. This would not be the reason for a B refusal. I would guess that they considered he would not return.

Tennesse, well that looks direct against illegals. Amusingly they quote the reglations requring a SSN and then say a passport is OK without quoting where the regulations say that.

There is probably somewhere out in the boonies that knows no better and want a SSN.

But lots of people fly to the US for a wedding, no intention of staying. Some people legally here are not entitled to a SSN, and of course all the people here illegally. They all manage quite fine

1. My fiance and I both have been trying to track down solid answers on this, he even called the U.S. Embassy in London. They refused to give any straight answers, the whole sort of "Don't quote me on this" type thing.

2. They told him he is welcome to try, but that as soon as they swipe his passport, they will see he's the beneficiary of a pending I-129F and may refuse him entry even though his country part of the Visa Waiver Program [they said this even after he told them he'd be bringing proof of ties to England like a letter from employers, proof of obligations, return ticket, etc] . Apparently, on the fear that he and I will marry while he's here.

3. This is what confuses me, because as far as I can tell he'll need a social security number for us to get married anywhere, and if he doesn't have one, it's not possible ANYWAY.

4. Has anyone from the U.K. visited their fiance during the process? What happens?


1. The Embassy does not deal with Visa issues, the Consulate does, but the POE determines entry anyway so there is nothing that they could say, not their call.

2. Not so sure about them knowing at the POE, but matters not. The presumption on all visitors is to disprove that they have immigrant intent.

3. Wrong, SSN not required to get married in the US.

4. I did, they let me in, I have seen many posts from others who also did. All depends on your individual circumstances.

Just an educated guess on my part, you can apply, but I doubt it will be granted. I don't believe they will grant an employment visa to someone going through the k-1 visa process. Reason being; if (s)he is here on an employment visa and they reject the k-1 visa application for any reason, there is reason to belive (s)he will stay when the emplyment visa expires.


Employment visa's usually have dual intent.

My K1 was long winded, but drama free. I believe that is the norm. Certainly has been for everybody I have physically met, but then most do not hang around boards such as this one.

Whether you will have issues with the F1 in your circumstances is by no means certain.

I have seen plenty of posts from those with F and J issues, obviously not normally seen posted on here.

I would be entering on K1, I think, and according to the info you directed me to, the actual marriage isn't an issue (I could do that almost straight away). The AOS is what I have to wait for.
It's a toss-up, really. I mean, we are thinking of applying for K1 and doing it that way. But it seems hardly worth all the effort if I am going to legally here anyway for several years and can by-pass all those fees, flights too and fro, and time-consuming form-filling, not to mention the stress factor.
Is there something I am overlooking?

She will have a 3 or 10 year ban.

Assuming the ban is still current she will be refused at the interview and you will need to file a waiver showing extreme hardship to you.

Being refused a visa means he would have had to declare that at the PoE, and usually results in a grilling.

Dublin seem to be a harder PoE, but then not so far back if you get bounced.

I was told to write a letter to them giving them details and where we are in the process,etc. That is done and now I am just waiting for Customs to get back to me with a decision.



Huh? It's the decision of the officer at the POE . . . Can't imagine why they told you to write them a letter with details or why they said they would get back to you with a decision. It will be interesting to see if you actually get a response.

I would be really, really surprised if he were denied entry, especially with all of those things that proves his ties. I just posted a similar post because my fiance is visiting next week. We've had a visa pending for almost two months and he is visiting without a return ticket (we're going to buy it either when we know his interview date or when airfares drop, whichever happens first), a letter from an employer, and he also lives at home. (Basically he owns a vehicle, has a job, and is a fulltime student so we're hoping that helps.) It's good to be cautious, but I wouldn't worry too much. Wehave flown back and forth several time while the visa has been pending and have never had any trouble as long as we have had the return ticket. He is also from the UK so it is a similar situation. Good luck!


One of the conditions of the VWP is a return ticket.

Plus of course there is uaually very little difference in the price.

If you marry and adjust now it will be say 4 months before you can leave. If that is OK then go for it. A K is an entry visa for someone with immigrant intent, you doid not need it as you had no immigrant intent at the time.

The difference is that you're Swiss....we haven't had a whole lot of problems with the Swiss trying to pour into the U.S. - illegally or otherwise. It is different when it comes to the MENA countries as well as others like Mexico and Latin America. Due to the surge in illegal immigration from these countries it is difficult to obtain a tourist Visa to the U.S. But Europeans, at least as far as I know, are still able to qualify for tourist visas without much difficulty.

Well the original OP's question has been answered several times.

Actually it would be nearly as difficult for you to get a Visa, B2, but you have the advantage of the VWP.

When I was younger and nieve I also said I was visiting my girlfriend, if I thought about it at all I probably thought of it as a positive!

If you look at those who were turned back at the PoE then usually there is a reason, if you are just travelling on holiday a couple of times a year your chances of a problem are slim. Try and live here on the VWP and then its a different situation.

A refused B2 has no negativity for a K1, they are usually refused for lack of non immigrant intent, something you obviously have with a K.

No i haven't filed yet. Probably in a week or two depending on when i get my fiance's forms in the mail. I didn't know if the phone records were something that should be sent with my initial packet or something that i should get only if they send me an RFE requesting them. If they're not important i won't worry about them. I'm just trying to get as much evidence as i can just in case.

You can self sponsor at the Consulate for a K1. You job is irrelevant unless they are continuing to employ you. The Capital requirement is small, a few thousand.

You may need a co-sponsor when you file to adjust status, - I-864.

It's what you fill out on the plane before landing, and the USCIS stamps it before you leave Customs.

That's the customs declaration form, not the I-94. The I-94 is filled out at the POE and it's usually found in the visa. It is needed for AOS...a customs declaration form would not be.


Replace Customs with Immigration and the first post is right.

You can of course fill it in at the PoE, but you have that long flight and the films are not always that interesting.
