I'm sorry, I havent figured out how to quote yet but to rebeccajo: So I should plan for an automatic denial and going through the hole waiver process?

And to desert_fox: I've been talking to my father about being his co-sponser unless I am able to get on my feet any time soon.

K-1 Fiance(e) Visa Process & ProceduresVery Overwhelmed
Thanks to everyone for all the awesome advise and good wishes! I've been looking around for immigration attorneys in my area and was offered a consultation for $200! I'm still looking and plan on making lots of calls today. I wasn't sure if immigration lawyers did pro bono work but I'm deffinatly going to check into that. We might be able to ask a few friends for assistance. I thought I would go with the K-1 Visa because I heard it was quicker and I'd like to have family at my wedding. Honestly, I think it would be easier (and cheaper) for the government to allow him to immigrate into the US then for the government to continue to pay for supporting my children for the next 17 years lol. I would also hope that they wouldn't tear a family apart.

Ok, I'm off to call the attorneys! Thanks again everyone!

I'm just jealous that some people can afford a lawyer, and make multiple visits to their SO, on top of all the visa process fees. If I could afford a lawyer, I'd be using that money to go and see my fiancee, or saving it just incase we need it later.

Yeah I can't afford a lawyer either, I'm trying to find the money to just file the I-129F

Well, our case is different because he was in the US illegally from 2002-2007 (a fact I didn't know until much later) and we have two children. He wasn't deported out of the country but left voluntary. The judge we spoke to let him stay in the US until our daughter was born and told him that he shouldn't have any issues getting a Visa to enter the US. I'm just concerned that something might go wrong or that that might get in the way. I need him here to help rasie our children and I am so nervous that I'm going to mess something up.

With that being the case, an immigration attorney would be a good move. Research them though, make sure you get a good one.

Good Luck

I've been looking for one who might offer a free consult or something (it's been very hard to find an attorney like that lol).

1) For the most part a lawyer is a very expensive paper shuffler, many times they mess up the petition, K-1 is an easy petition to file, the guide and example forms here on VJ are Excellent. A lawyer is useful for complex cases for dealing with issues like an overstay. A lawyer will not make anything go any faster, if one tells you they can, RUN AWAY!

2) This comes much later you and your joint sponsor will provide an I-134 and supporting financial evidence for the visa interview.

3) NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

Only way to guarantee work authorization is to marry first and apply for a CR-1 Immigrant visa, this visa results in green-card upon entry, this authorizes work immediately.

Thank you so much for your help! The guides really are great, I'm so glad I found this site.

Our case is a little different and I'm trying to get a free consult with an attorney just to see whether or not we'll need help. I'm just so overwhelemd with it all!

Does everyone feel so overwhelmed by all these forms and stuff??

A few other questions:
Is it more helpful to hire a lawyer to help with this process? And what form do I fill out if I can't support my fiance but could have a relative sponcer him? And my last question, can he work once he's here on the K-1 Visa?

Is there a POE in Colorado? If this is in one of the guides and I missed it, I'm so sorry. I was just curious about it since I've seen so many questions about POEs recently.

QUOTE (andersensr68 @ Mar 30 2008, 02:56 PM) <{POST_SNAPBACK}>
We are still waiting on our NOA2 and are hopeful that will happen soon. I want to go and be with my fiancée at the interview even though I can not go in it will give her morale support to know I am close by. I am wonder how much time to they give you when they notify you of your interview. Is it days, weeks or months? It will be hard to request a vacation, apply for visa and purchase plane tickets on a moment notice. wacko.gif

Once you recieve the NOA2, it will be sent to the NVC. After processing at NVC, it will be shipped to Consulate in Guangzhou. Your SO will get a Packet 3. She must complete and return this to the Consulate. Aftter processing the Packet 3, the Consulate will send Packet 4 and a letter of invitation for the interview. The interview is generally 30 days from then. The Guangzhou Consulate generally takes 4 to 5 months from recieving paperwork to interview. So, you have a lot of time, but you do not know the interview date for sure until you get Packet 4.

My fiancee's daughter is blind from birth. In the future I will post some photos so you can see how cute she is and see me holding her innocent.gif

To me this is a non issue! But could this be a concern? Would or could the baby be denied becouse of this birth defect? I make more than enough money to cover the poverty guide lines.

Any feed back about this?

Hi All!!!

I just mailed this week the visa petition and today I joined this site. I have a few questions, I will ask each in its own thread.

Question #1
If there is a age diffrence between the me and my fiancee. Does that make any diffrence? What if the age gap is 30 years?

I would appreciate any input.
Thanks,

What most Americans think is that everyone in the world wants to come to America! This is so wrong! I think most people would prefer to stay in their home country, it is for one reason or another they are choose to relocate in USA. Your father, thinking your fiancee's only goal is to move to USA is so wrong! I bet if it was possable, your fiancee would like for you to move to her country.

The case with my Fiancee is not that she wants to become a US citizen, she just wants someone to love her!! The same with me, I want someone to love and love me. I have not found that person here at home, but I found her in the Philippines.

As far as scammers, there are many right here at home!, for money, power, status, you name it.

I don't know what to tell you about how to deal with all the negitive attitudes, other than just ignor them, they do wish good for you? don't they?

I agree, Take a Lawer to court? haha and get refund? not on this planet. If you wanted, try filing a grievence with the state bar association. It will get his attention for sure!

I suggest you let it drop. Add a mark under "learning experience" and move on. Take the high road. Going after your lawyer will only add to your anger and frustration and might create "bad karma"

K-1 Fiance(e) Visa Process & ProceduresLooking for a little advice...
QUOTE (kevin.l @ Jun 29 2009, 01:55 AM) <{POST_SNAPBACK}>
Hello all, this is my first time going through this visa process and was wondering if anyone would take the time to give me some advice. To sum most of it up; I'm young, in the US military, and currently deployed to Afghanistan. My fiance is from the Philippines, and thats currently where she is at right now. I talked to her for a little over 6 months before meeting her, and we got engaged on my first visit last February. I returned for a second visit in March, and in April I shipped out to Afghanistan.

I already filed an I-129F on her behalf with the service center in Vermont, and I received a receipt and got a case number. So our plan was that hopefully by the time my deployment is over in December, she will be close to getting her visa. For now, she is trying to get her passport there in the Philippines. She has met almost all of the requiremens but ran into a problem getting a certificate from the CFO. She had to go to a seminar and they asked what her passport was going to be intended for. She told them our story and that she is going to be getting a fiance visa. And then they started harassing her with a bunch of personal questions and demanded legal documents from me. Is all that really necessary? I have trouble believing that all that information is required just to get a passport. I told her to try again, and tell them that her passport is for tourism. To try to minimize the interrogations.

So anyways, if someone has run into a similar situation i'd appreciate any help you could offer. And if anyone else has some advice for the petition, visa, passport, immigraition processes, etc. that could help my experience go smoothly, that would be great.

Tell her to go to the Quezon City office at St. Mary Euphrasia that is were i got my cfo certificate the people there are very nice.

Thank you everyone, we have talked with a couple of them and have decided to do it our selves. Now our concern is our daughter. Should we just apply for the dual-citizenship or would it be easier to include her in the k-1? Or do we have to do both? She has been in her daddy’s care since I left Ontario in October after I gave birth. I have visited once since, and he has visited once since.

Thank you everyone. We really don't know a whole lot about the process, etc.

Yes, She is my birth daughter, no we never notified the US embassy of her birth. I have no idea if it would be too late to do so, but I am assuming it is. It has been two years as of The 20th of Sept.

I don't really see any complications with our case, neither one of us have been married, or convicted etc. I make almost 10,000.00 more a year then they request for a family of 3.

My only worry would be I do something wrong or incomplete.

Anyway, my question is should we hire a lawyer to help with the K-1? How many of you have hired lawyers? Was it worth it? Is it easier to just do it out self’s? My fiancé met a guy who said he could do it for 800 and something US$ plus the processing fees, is this a good deal, or a rip off? Thank you, everyone.
