In reference to the OP original question, (first of all congratulations :) ) I suppose you can try but I'm not sure how easy it is to get ones case expedited simply on the fact of a pregnancy. I wish you the best of luck in your case.

You probably don't need a lawyer.

Sydney will be nice to deal with. Most people on these forums will be extremely conservative with their advice, but keep in mind most of these people have fiances from non English speaking less developed countries. Most of the Visa-waiver countries are very easy to deal with, because there is very little visa fraud from them.

You ned an address, your Parents one is the obvious one.

You do not need a job, however with Vietnam you need to check on the Consulate's requirements, they may well require you to have income comensurate with the income support.

I have been fingerprinted and photographed, and frisked - one officer was even trying hard to get me to admit my accent was something else than french(!?!). They never specified how long I would be banned for. Just said I would need a visa to enter from now on.

In my experience? Yes. They'll make a few exceptions during the six months, but will deny you entry after detaining you for 2-3 hours during the six months after the first rejection.


They didnt tell me that when I got denied entry in April, but I have gotten a different answer from each person I have talked to ever since lol
Last one was "I wouldnt book tickets if I were you", from a very sympathetic customs officer we went to talk to when Matt was in town (there is a POE at the airport in Montreal, 15 minutes from my house). So I wasnt even going to try to enter for a while....

Nope does not effect your visa or student loan at all, if possible try to pay some of it off before you come to America, I know some people do not and good luck to those people, I had a little credit card bill but my kind husband paid it for me and I have no debts left in the UK. It is possible to pay your debts from the USA, they have free international money transfers at some banks, I know our bank does this. Good Luck with the process.

I've been bad and havent paid any of mine off and havent told them that I've left the country. :devil: Not really from trying to evade it but from having other more pressing things to think about. ie - getting married!!
So, nope. No body to do with immigration has any idea about it. No need to worry!!

If the only box marked is the one that states you need additional processing....
then you need to start calling the consulate everyday....and sending them an email to nivcasablanca@state.gov.

BUT...if you needed to turn in additional paperwork, get it turned in...then within 72 hours of them receiving it, do the above....call the consulate daily and email.

If you do nothing...they also will do nothing.

Your Petitioner's age, birthdate, birthplace
Is he Divorce
How many times?
Dates of his divorce
How many children he has
Where did you two meet
Exact date you meet him
Exact date he visited you in the Philippines and where both of you going in the Philippines
Are you single, never been married or separated
Do you have children, how many
What is your petitioners job, name of his company and how long he's been working in that company

After the Screening Window, you will be asked to wait again for your number to be called for American Consul Interviewer

Consul Interview
- the interview will be conducted by an American Consul. Interview questions that i encountered as follows;

You take an oath with the Consul
Exact date he propose to you, Did you say yes at once
Date you say yes to him
SAME QUESTIONS AS ABOVE
Are you working? Name of the Company your working with, address and your position
Ever been to the US? or outside Philippines?
When do you intend to join him in the States
When is your date of marriage
Will you be living alone together in the States or with his kids, if ever
What part of the state will you live as couple


After the interview with the consul, you will be asked to wait again. They will call your number again on another window, wether you pass or not. If they returned your documents, it doesnt mean that your denied, it means that you need to submit more proof. If you recieved a PINK SLIP (pink slip was used on my time, 2007 if you passed) you will be asked to pay for your passport and visa delivery. It will take just 4 days or a week to get your visa to be delivered at your home address, then off you go to the US to see your american fiance

take note, even if the filipina fiancee have presented all the documents in the screening window but if she goofed on the interview, like forgetting details about her fiance, that could mean a denial on the petition. Just be calm and review everything about both of you, because you never know what the consul may ask. Some consul ask just a few questions and some ask a lot, like the one i have (grrrrrr to him..lol)

Congrats on the new baby and welcome to VJ :) Read through the guides up above, they are very comprehensive. The K1 is usually faster than the marriage visa's. To get a good idea of the processing times, read through the timeline and procesing times above as well. It varies based on where you file and his country. For the poverty rule, you can get a co-sponsor who makes over the 125% line. Good luck

Rodolfo and I met in 2002 in the US, he was here illegally. In 2006 he got arrested for assault and that's when we all found out about his status. He went to ICE and was released on $6,000 bond. The judge recomended that he leave the US voluntary and he did last March.

So... I'm meeting with a lawyer soon to go over our K-1 Visa application and help us out. I am curious what some of you VJers might ask the lawyer if you were in my situation. I am compiling a BIG list of questions and things I want to go over with him. Any suggestions would be greatly appriciated! Thanks smile.gif.

I didn't work in 2007 (because of my daughters medical needs). I've read that the petitioner and co-sposor need to provide their W-2s and income tax information. Since I didn't work, I haven't filed taxes. My question is, does the petitioner have to provide tax info if they didn't work?

I feel bad, I talk to my fiance everyday for about 10 minutes. But we're both poor lol. He gets phone cards in Guatemala in 10,15,or 30 min increments (sp?) and he doesn't have internet access. I can talk to him for about 45 min with $5.00. Lately I've been using Phone Hog though lol.
