K-1 Fiance(e) Visa Process & ProceduresK-1 Visa Process.....Fiancee's kids that will stay in Philippines 129F question
Yes, you need to fill in the information regarding the children as you have to declare their existence during the petition. This way, they will not have problems in petitioning for the children when the time comes.

K-1 Fiance(e) Visa Process & ProceduresForeign travel right after marriage?
K-1 visa allows entry to the US once. Whether you marry or not, it is gonna expire after 90 days of entry. If you get married, she would have to apply for Adjustment of Status to have her green card. She cannot leave US until the process is done or until an Advance Parole is granted to her. AP usually processing usually takes about 1 to 2 months from application unless there is an emergency case where you can have it within a few days. I am not so sue if a job abroad is one of those cases wherein they consider approving AP within a few days. You might want to check on this because otherwise, she would need to apply for another visa to gain lawful entry again after she leaves the US without gc or AP.

K-1 Fiance(e) Visa Process & ProceduresHabilitado Needed for Cubans Travelling Back??
It is true that Cubans (with a Cuban passport) living in the United States need a special visa to visit Cuba. My wife flew to Havana on Friday and was denied entry at the airport. They wouldn't let her buy a tourist visa. They told her to get a special visa from the Cuban consulate in Washington, D.C.

They kept her and 14 other Cubans in the airport overnight, sitting on hard chairs, and wouldn't allow her to see her parents who had come to the airport to meet her, or even let her call her parents. We were all very worried about her.

K-1 Fiance(e) Visa Process & ProceduresDoes Divorce need to be final before applying? + other question

Does the divorce have to be final before you apply?

My fiancee said that if he comes to usa on tourist visa and marries me, he can stay? Is that right?

I read some depressing stuff on a petition, but it seemed to apply more to getting the spouse to usa, is this fiancee visa jsut as bad or is it pretty easy? How much money total does it cost if you do it yourself? And is it 4-6 months or so?

Yes your divorce has to be final.

Does he have a visa to visit you in the US? Sort of assuming the answer is no.

Have you met?

He will be subject to AP/AR, anybodys guess but assume a year plus.

Have a look in the MENA forum, not an easy Consulate due to fraud issues.

A B2 is the visa to visit, marry and leave again.

Getting one might be an issue.

K-1 Fiance(e) Visa Process & ProceduresPreparing Documents - Question

We had his lawyer assist with the I-129F form. He did not explain that we needed this proof prior to sending in this application. However I am aware that we'll need it come time for the interview.

We have emails, phone records, pictures, and i have flight tickets to chicago but not to kansas city where he resides.

I collected a few bits and pieces, but at the interview I showed a photo of us together and that was it.

By all means take all you have with you, but it is unlikely to be an issue.

I did not have e mail/phone records etc. I mainly phoned from work due to the time difference and it was free!

K-1 Fiance(e) Visa Process & ProceduresWhat is the best "evidence" to bring?

I was told that after filing for a visa, I was more likely than not to be refused entry as they assume immigrant intent unless you can prove otherwise. I was also told I could try if I could provide very strong evidence of ties to the UK, but that if they had any doubts, not only would they turn me back, but they would not let me call anyone or speak to anyone before being put on a plane again. I would not be able to speak to a lawyer, and more than that, even though I would be travelling with my husband, I wouldn't even be able to speak to him as they would be interviewing me on my own.

All said and done, that just scared me too much to even try....

Wow! Yeah, I don't blame you...

Does this mean I should NOT file K1 beforehand, as Boiler suggested? I still don't quite get the logic behind that (I mean, we're going to be honest with INS if they ask her status) but if waiting on the K1 for a few weeks lets us visit, then it's probably worth it. Or is INS just concerned that we're engaged, regardless of K1 app status?

Thanks again!

EDIT:

English Muffin -- very interesting. Finland is (thank God!) part of the VWP, so she won't need a visa to get on the airplane. I love your 'handle' btw!

mandp -- Eek! In a way, though, I guess that agrees with what English Muffin is saying.

I did not say that.
I travelled when my K1 was in process, many do.

> While I can't say that the country of origin matters, several people have mentioned that they were questioned whether
> they filed for a K1.

Dumb question time: I assume it's better if you DO file for a K1 before coming here, since that shows that you're trying to follow the rules? (waiting until she was here had crossed my mind, since it's easier to fill out the paperwork together, but I'll gladly pay for the FedEx if it will help)

Nope, they then know she has immigrant intent, eventually.

You gave to have a return ticket, a requirement of the VWP.

But don't they know that she has immigrant intent anyway, simply from asking her why she is visiting the US?

I travelled.

She should take evidence of her ties to Finland, Job, Property etc etc requiring her to return home if asked.

She has no right of legal representation at the POE.

K-1 Fiance(e) Visa Process & Proceduresfiancee work concern

For many Filipinos who are proud of their country and culture, it would be insulting to suggest that their women are all too eager to sell themselves to foreign men for sex or even to marry themselves to a foreign man.

I have not been to PI.

Logic would suggest that a Consulate would deal with the roughly the same number of applications for women and men.

PI does not seem to follow this pattern.

How do you explain that?

I'm assuming this didn't happen too long ago. You need to call the police for one. I'm sorry that this has happened to you. You need to contact your embassy for assistance for sure. Tell the local newspaper. This shouldn't happen to anyone. But you are better off going back to your country and working, apply for a different visa which allows you to come back legally but you are not able to stay.

The last thing you need is more problems than you already do in your hands! sad.gif rose.gif

I find it odd that no one mentioned being threatened with a gun is a felony in this country! First things first, if you were threatened with a gun you must report it to the authorites.

To be picky he said he had a gun.

And none of us were there.

Police not told I assume and also no mention of witness's.

Reading through your posts you explain why it may be difficult to get a Visitor Visa for your wife. Having said that, I would certainly try and get one.

I presume you could get a work visa in Syria quickly, that is generally not the norm. If you were a Syrian wanting to teach languages in the US, it would be difficult, certainly lengthy to get a visa.

Hmm a little condescending don't you think?

In reference to the OP original question, (first of all congratulations :) ) I suppose you can try but I'm not sure how easy it is to get ones case expedited simply on the fact of a pregnancy. I wish you the best of luck in your case.

PS I would trust the "masses on VJ" over one person.

If it is that easy, then that would be the Number 1 mention on the K process.

But it can do little harm to try.
