I feel her. When I first posted on this forum. It's not very welcoming either. I complaint it to my fiancé and then I learned from all the problems people posted judging me and saying that I will not get approved. I am siting here approved and be flying in 2 weeks. Stay strong. Keep up with this forums and learn from the bad comments. Haters are always out there to get you.

The original comment was that he he could not travel.

 

Half way through we are advised:  I work, I go to school and have a perfectly capable life, 99.99% of people would never know that I have a condition in the first place.

 

So all the comments prior to that were on the basis of a misunderstanding.

 

I am going to guess that the above statement was not included in the waiver application, but the K1 would include employment information, I think?

 

It will be interesting to see what happens. As they had already applied the whole thread is a bit pointless.

 

BTW Cancun is less than 2 hours away.

You submit the waiver with supporting medical information. I am not one to judge the extent of his inability to travel, I am sure the people reviewing the case have access to such resources.

 

Having just one B2 application declined may not be enough.

 

If successful you then have the issue with the Consulate who may have issues with the nature of your relationship.

I think it is peritoneal dialysis. Hemodialysis are done 3 times a week even when kidneys are almost non-functional. He can probably switch to hemodialysis for short period of time to visit Pakistan. if he comes to Pakistan they can get the marriage certificate and apply for Immigrant Visa directly. 

He would not need to go that far, just to somewhere where they could meet.

There are 3 aspects.

 

1. You need to show why he can not visit you, presumably reports from his medical team.

 

2. Why you can not visit him, might want to try one more time.

 

Presumably there is nowhere else you can meet? He is housebound?

 

3. Then there is the issue assuming you get past that hurdle of the interview. Could be seen that the motivation is more on moving to and working in the US.

It is a pre requisite to be able to apply for a ESTA, so if you fail that test then you should not be applying anyway.

 

The question arises is that some sources mention that if you have overstayed your VWP then you are not eligible to use the VWP again but do not go on to mention any other visas.

well my husband came to the US on a b1/b2 and was only granted 1 month...so not everyone gets 6 months

I don't think overstay on a visa affects VWP eligibility. Overstay on the VWP itself does, but not another visa I believe. Not 100% on that though.

 

I have seen long debates about it, the logic of voiding a B by overstaying but not the VWP escapes me.

 

What matters is what the Consulate thinks. And it appears that they have an issue.

OP stated that his subsequent visits on the VWP were seven years after his previous B-2 overstay, so a three year bar would have expired by then.

 

it would seem unlikely from what has been said that he ever had a ban.

 

The issue is his use of the VWP when not eligible.

B entry could be for one day but in the vast majority of cases is for 6 months.

 

VWP is 90 days or nothing.

 

No check points on the way out, only coming in.

 

Seems that they missed he had overstayed when he was let in on the VWP but of course has now come up. Just because he was not previously caught does not give him a pass.

If he's Australian, he wouldn't have needed to apply for a visa for a trip under 90 days.

 

Not all Australians are eligible to use the VWP. If that is what he did.

 

He has a prior overstay.

You said he visited subsequently, how? With such an overstay I would have though another B would have been difficult.

 

From memory when you apply for a Visa you are asked about all your prior US trips including their duration.
