I've seen posts saying that K1 Visa holders have to wait until they receive their EAD, and I've seen others that say they can work right away.

The VJ timeline says "Depending on which U.S. airport you fly into (NY JFK) some will issue a temporary 90 day work authorization if asked for. If issued, the employment authorization ends on the day the K-1 expires. You will have to file for an EAD when (or after) you file for AOS. If you do not receive your EAD before your K-1 expires you must stop working until it is received."

Is there someone who can link a definitive answer on this? I want to know if my fiance can apply for a job when he moves here right away, if he can start once we get married, or if he has to wait until after we are married and he receives his EAD.

We email constantly while we are at work, chat via gmail, send texts, and then when we get home we are on the web cam or playing EverQuest 2 (which is like WoW). We involve each other in all of our day-to-day stuff, so even though we are apart we feel very close.

Sure, a class syllabus is good. Perhaps he has some rental lease, a mortgage, utitility or bank statements, appointment cards for a Dr. or Dentist appointment...gosh there are other things other than an employer letter. Most people I would suggest though do tell their employer, so it's easy enough to just ask for a letter when crossing the border.

I know there have been occassions where Canadians are asked for additional information when crossing the border, but really. This is not rocket science. There is no added responsiblity for anyone on a K-1 or K-3 or whatever to have additional paperwork. At ANY time when a Canadian crosses the border they can be asked for information to prove that there is no immigration intent.

Relax, answer all questions honestly, and you'll be fine.

Can someone please explain to me how this is a problem? I flew to Canada just last month. He has flown to see me 5 other times. All that happens at the airport is they check your passport. Is there some database that they scan your passport against that notifies them of our I-129f? I just received my NOA1 last Friday, and he is coming in less than two weeks for Spring break.

I don't see why he should bring any extra papers or request a letter from him employer. As far as I know our file is sitting in Vermont for the next 130 days or whatever until they approve it and send it on.

He is taking classes in college that aren't over yet, so that's a reason to return. He also works as an accountant and Canadian taxes are due by the end of April so he has a lot of work to return to. I don't want him to have to request a letter from his employer, because then they will know that we are engaged and then they might surmise that he is leaving. He is close to getting a raise and he doesn't want to lose it because who knows how much longer he will be in Canada until this is all approved?

We have almost the same timeline and we live in the same places lol! I live in Florida and he lives in Ontario!
My fiance is coming to visit me in two weeks, but he is flying so I think a return ticket should be sufficient evidence of his intent to go home!

Did any of you include pictures that didn't have the time and date imprinted on the picture?
Unfourtantly I am don't know much about camera's, matter of fact I only bought this camera for the purpose of taking pictures with her and I when I was there.
On the bottom of the RFE it says include "film dated photographs of you and your fiance when last you met"

The problem is the camera setting was defaulted to not include the time and date and I didn't realize this until now and it won't allow me to add the date and time now after the fact to reprint and send the pictures. I read the manual and it sounds like date and time is engraved into the image at the time of taking the picture. However on the digital screen it shows the correct date when the picture was taken ... anyone know how I can get this date to show up when the picture is printed??? I am a little worried now .. I would hope they wouldn't deny us because the pictures are not time dated ... I mean I have the passport with the exit/entry stamps from March and April of this year when I was with her. I also included bank statements showing atm with drawls and also the credit card statement showing the payment to the hotel. Maybe I am just a little over paranoid now because of this whole RFE thing ..

But on the bottom of the page it in bold it says :

Provide film dated photographs ..... which we don't have because the camera won't imprint when I print them out now ..
and
Sign the enclosed Form G-325A forms.


I'd like to know the answer to this one too. Mine didn't have dates made by the camera . . . just hand written dates on the back by me.

I know the waiting is really hard. I really really know. I just got my NOA2 last week, and people whose NOA1 date that were 15 days ahead of me were given their NOA2's back at the beginning of June. That's almost 2 months for 15 days between us. The waiting is killer. Just hang in there and know that your time will come, and it will likely come very very very soon.

Any who. . . hopefully there won't be an issue or a delay due to the divorce papers. . .

So I just have to cross my fingers and hope that I don't have a picky adjudicator, and stay with my plan to give my fiance the original for the interview stage.

The IO even went to get a second opinion about one of them because it was an extract from the Divorce Records by the registrar which is all they had from that far back.

I am not aware of USCIS changing their requirements for the I-129f but will check into it. It may be a case of an overzealous caseworker, though.

Hello....I posted this in spanish and now in english so here goes....My boyfriend and I are filing for the k1 visa....he is 21 and I am 35.....he is Dominican and I am American born to Dominican parents....I am a bit worried and concerned that we may get denied the visa because of the age difference which can trigger thoughts of a fake relationship (fraud).....to my surprise this relationship is realer than real and I think that if we have all of our documents in order and answer all questions truthfully and correct that age difference is not a valid reason to deny a visa....Please give me your totally honest opinion...i appreciate it....thanks....


I'll let you know if it's a problem for us! I am 9 years older than my sweetie. He's Canadian so I am thinking that his embassy won't care. I don't look much older than him so I think that when they see us together/see pictures of us, they'll agree that we make a good match!

Yay for marrying a younger man! I never thought I would have anything in common with a 21 year old either, but we are better suited for each other than I have been with guys my own age!

30 is not that old for having a baby. My mom had me at 35 and my little sister at 36. My co-worker had two children in her late 30s.

I want another baby, I'm 30, but I am going to wait about 3 years until he moves here, settles in, has a job, etc.

To me this sounds crazy and it's awfully hard for my fiancee and I to afford those fees all at once delaying the process even longer. We make good money to live off of, but not so much to drop that much extra money all at once, so we are quite stressed out by this whole process.

Why did the fees go up so much from what they were and has there been any benefit to this?

Not to defend fee increases (something I never do) but the AOS fee now includes the I-765 and I-131 if filed at the same time. So if you file for all three there really is no fee increase. Also, I have it on very good authority we can expect fees to increase again, 30-50% across the board within 12 months


Hopefully it won't be in the early half of the next year. Also I have saved up in the last 3 months the AOS 1010$ fee sitting in my bank account when for us to file when we do finally get done with the process of getting her here from Poland. You do have a point with the I-765 and I-131 forms. Also love is forever and it's only paper that the money is printed on, with the dollar dropping so quick it's actually becoming cheaper if you think of it in the world term if that makes any sence. If your other has some saved up money overseas most likely she will be able to buy more USD at todays rate then 2 years ago.


I hope it's not before April. My fiance doesn't want to get married until the end of April.

If you do a K1 Visa you might not be getting married by the summer. We started ours in March, and we are having our interview next week. So this process took us 8 Months. Just be prepared that it could be at least that long and possibly longer. We didn't have any RFEs, we were not stuck in AP at NVC. Some people had circumstances that made the process longer than anticipated.

I just looked at the VJ example, and the box for "intend" "do not intend" doesn't look like it's checked at all? That's a good point though, to check the box even if you are saying "N/A ( K1 visa process for permanent residence )."

You don't need bank statements if you are not using cash in the bank/assets to meet the income requirement. If her employment meets the requirement that is sufficent.

I also included W2s and tax transcripts in addition to the letter from my employer and the paystubs.

I put "N/A Visa process for permanent residence" just like on the example form found here on VJ.

Anyways, as far as the visa criteria goes, you have quite a few options.
K-1 - This is a fiance visa. In order to be eligible for this visa, you guys need to be engaged and must have met in the last 2 years (which you have). Also, you guys should be free to marry. It will take about 6-8 months for the entire process to be done with. I would recommend you read through the K-1 guides on here. You will have to submit a form, I-129F to the USCIS and then wait for it to be approved (along with the proof of having met in the last 2 years). Once the case is approved by the USCIS, it is forwarded to the NVC and eventually to the consulate listed in your form. Then you have to attend your interview and once you are approved, you have to enter US within 6 months and once you enter the US, you have to get married in 90 days.

CR-1/I-1 - This visa category is for the applicants who are already married. I am sure some of the CR-1/I-1 applicants will help you with this.

K-3 - Another visa category for the applicants who are already married.
I would recommend you to go via the K-1 route but thats just me. Feel free to direct any other questions to me, if you have any!

Canadians don't have "visitor visas" you are allowed to visit on your passport for up to 6 months, return to Canada, and then come back.

Try googling "work Visas." We looked into that at first, but if I recall correctly, an employer has to say that they could not find a US applicant for the job, and so only you can fill the job.

You could try for a student Visa, but you'd have to be accepted into the University and then apply for the Visa (I assume).

Oh, and for Canada, right now Visas are NOT 6-8 months. They are 8 months or longer, as long as your case goes without any delays or RFEs.

I am pretty sure I need proof that I have a job to go to, but I thought that there is a way I would be able to move down and look for employment when I arrived?

My boyfriend and I have also talked about the Fiance visa.. and, if the work visa doesn't fall through we are both fully prepared to apply for the Fiance visa in order for me to move down there.

Bottom line, I'm lost, I'm confused.. this is a first for me and when I stumbled across this site I felt relieved. I am sure there are some of you out there who have gone through or are going through a similar situation. Any information that any of you would like to share would be great, and also any advice about the visas and steps I need to take in order for me to get down to the United States would be greatly appreciated as well.

Wow your story sounds a lot like ours! My mom said to me, "I don't cae how much you think you are in love with him, you must break up with him- he is not God's choice for you." This was because his myspace said he is "agnostic" and because he is 9 years younger than me.

Fast forward 2 years later. My parents ADORE Sean and can not wait for us to be married!

It will work out once your family sees how happy he makes you and vise versa.

Sean's mom was against him moving here to the US. When I was in Canada last weekend, she finally said she "has made her peace" with him moving because she sees how happy I make him!

Your family just wants you to be happy.

So take your time, visit frequently, and only tell them the good stuff (sometimes we tend to complain about our men and that's all they remember . . .).

My ex-husband's parents met when they were 14 and 15 and got married at 20 and 21. They've been married almost 40 years now.

My sister-in-law got married when she was 17 (with parental permission) and she has been married for almost 15 years and is very happy.

I met my ex at 16, married him at 18, and the only reason we divorced was because he couldn't keep it in his pants. Oh, and dispite getting married at age 18 I still managed to get a master's degree by age 24, and became a mom at 24.

I'm now getting married to a 21 year old, who would have been 12 when I was 21!

Let's not forget people used to die in their 30s and 40s and marry by age 15. I think the Virgin Mary was 15 when she had Jesus. Just sayin'.

My interview took 8 months from the date of filing and we had no issues, no RFEs.

Also, are you sure your religious wedding will not be offical? If you are married before your fiance Visa is used, then you will have to ditch the fiance Visa and file all over again for a spousal Visa.
