so our case was transferred to CSC! so that's nice. and today, at the last possible second, we got notification that g was approved for his EAD (finally) but of course it could take up to another month to GET said card. *insert sad trombone noise here*

If you look at my timeline you'll see that the EAD card didn't take as long as the 30 days.

Another thing to note is when it came (on 8.02.10) it said employment was authorized from the date of my notice (7.22.10). So in theory he could have started working then.

Sean actually has a job that he wasn't being paid for, and now that he has his card, he is getting paid for it. :) He works for my dad at a non-profit charitable organization so he was "volunteering" up until we got the card. :)

yeah I think you should be fine with just that. I'd have to try to track down my packet..*I'm sure I made copies..LOL*...to see what I sent in.

I went ahead and completed the supplement. I made a cover letter explaining the supplement, and then made a new mailing envelope with a label indicating that the supplement is inside and is to go with the AOS packet.

I hope I am good now!

No I did not. Part 4 had a box labled "Information About Your Proposed Travel" so I put in there that he wanted to visit his family in Canada and that we wanted to go on a cruise to the Bahamas. It said "if you need more room, continue on a separate sheet of paper" but I didn't need more room.

Isn't that the same thing?

I see the form now, I-131 supplement, part 7. No, I didn't even notice that. It basically says that I am filing the I-131 with the I-485, and that Sean hasn't overstayed past the 180 days. Well, both of those facts are obvious from my packet, so hopefully this won't mess up my application.

Bah. I should probably send the form in now. It's too bad I didn't notice it before.

hey Arabella,

Did you include that extra page with the I-131 saying why Sean might need to travel outside of the USA before he gets his GC? There's a template somewhere in the guides.

If you didn't, I don't think it will be a big deal.

I just sealed up my AOS packet and will mail it after work today. Before I sealed it, I took a picture so that I could share it. I ended up doing a lot of color labeling to help organize the documents. I also took the liberty of making a mailing label with our picture on it, and also inserting a picture on my cover letter. I figured they get 100s of these and I wanted mine to stand out.

The bank letter was my mistake, I mixed that up with the visa interview. The letter from the employer was specifically requested. I too have an employment contract that basically gives the same information, but they still wanted the letter from my employer and not a copy of the contract. It was explained to me that contracts can be terminated and for all they knew, this contract could have been terminated months ago. A current letter from your employers HR department shows that you are still currently employed which is more what they are looking for.

That's true enough. I will just ask HR for a letter before the interview, and bring it with me. They'll want a current date anyway.

Who knows, maybe I'll be one of the lucky ones who doesn't have to have an interview?

LoL, It's your choice, i'm just telling you, I was asked for it, especially the letter from my employer.

If you were asked for it at the interview stage, I can just bring that with me. I have my accordion folder from my interview in Montreal, and all of that stuff is in there.

Two things that I don't see in your list there is a letter from your employer and a letter from the bank. Our interview officer specifically asked for both.

The I-864 does not ask for either of these documents. It only asks for the W2s and tax transcripts.

I did include the letter from my employer, pay stubs, W2s, and tax statements in my I-134 for the fiance Visa. I can include the letter from my employer (it is back from October when I sent it in for packet 3), and my teacher contract that states my salary and employment status. I also have pay stubs.

I quailfy based on my income, not on assets, so I have never provided a letter from my bank for anything. All that my bank would show is money comes in, and goes out, and that there's not much left over!

I included 6 photos.

Does this cover everything?
ArabellaFemaleCanada2010-05-19 09:04:00
CanadaAOS'rs...

The guide is regarding the I-485 package alone, so it says to only include the two photos.

The instructions for both the I-765 and the I-131 specific that you must include two photos per. That isn't to say that there haven't been those approved with only two (don't know), but the instructions on each form state to include them, which does make sense, as those two packages will be separated from the I-485 petition once USCIS receives it.

Hmm, well it is a good thing I haven't mailed it off yet. I didn't read the instructions for those forms. I just filled them out and used the guide to assemble the package. It looks like I need to make extra copies of some other things for those forms as well (extra copy of passport bio page, copy of I-797, copy of Visa in passport).

So, since these are really 3 separate applications, did you guys put them all together, or separate each application with it's own supporting documents?

CanadaAOS'rs...

Congrats on the approval Supreme! And I hope you hear some good news soon jessie- glad it was a good experience :)

Arabella, if you want to do some more reading on the I-693 the AOS forum is flooded with threads about it. A lot of people receive RFE's for not sending it, and a lot of people don't have an issue- it's pretty much a shot in the dark. There has been a theory floating around that apparently USCIS has hired a bunch of temps to open and look over AOS packages to ensure all the information is included. Often these temps aren't completely aware of what is required, especially from someone adjusting from a K-1, so there is an RFE sent for a form or medical that isn't really needed. Also, on occasion they "misplace" the medical, in which case you either need to have a new medical, or have the I-693 which shows you've had a medical within the last year and have all the required vaccinations. This really isn't something you can control at all.

Personally I didn't send it and It wasn't a problem. I never wrote a special letter or mentioned anything about it in the packet either. I had an interview and it was on the list of required documents and I didn't even need it then. So basically it's up to you. If you don't have a problem with getting an RFE for it, then go ahead and send the packet without it. I figured that if they accepted it without the form I could save myself some money and a really big hassle!

I was actually saying to Sean that perhaps the reason people get RFE's is because they have new people or temps looking at the folders and they just go off a checklist. That's why I highlighted the instructions, and printed out an explanation with a summary. I'm sending it off today, so I'll cross my fingers that it gets approved!

Also about the passport photos, the guides here on VJ say to send in 2 passport photos, not 6. I couldn't convince Sean that we needed 6 over the 2 that the guides state we need. So he just got the 2. Anyone else just send it 2 passport photos with AOS??

They find their ways out of it, if they choose. It's been lost, misfiled, not completed... whatever. In my case, my vaccination record actually wasn't complete - Dr. Seiden missed the fact that I didn't have my second full MMR set.

Either way, hope it works for you.

Well I have a copy of the shots from Dr. Seidon in case they "lost" the originals. Although I only see one date for MMR. Should there be 2 dates for MMR?
ArabellaFemaleCanada2010-05-18 13:56:00
CanadaAOS'rs...

Arabella - I just included a letter with my vaccination worksheet - I think a well written letter helps a lot to avoid the RFE. I'd take your chances and if you get RFE'd then look into getting it transcribed. It's worth a shot.

I just wrote the letter. I highlighted and attached the instruction page, and then highlighted and attached the vaccination documentation that has Dr. Seidon's signature, date of medical, our case number, Sean's name, etc. right on it.

I hope they take this. If not, they need to change their requirements/instructions!

CanadaAOS'rs...

I just called a local doctor and they told me they have to do the entire medical or they won't transcribe the shots. How lame!

I don't really want to chase around these doctors and end up paying for a service that isn't even necessary. The I-693 instructions say that as long as we submitted a DS 3025 with the overseas medical, that we don't need to have a civil surgeon transcribe the shot records. It says only to do that if the DS 3025 was not properly completed with the overseas medical. So I am going to take my chances and submit just the copy of his immunization records, along with a photocopy of the I-693 instructions, and a letter explaining that we have the medical completed overseas. If they RFE me, then I will worry about it.

A civil surgeon has to do it. I saw one in Longwood, though I'm sure there should be plenty closer to you guys. Mine charged me $55 (apparently before the new year it was only $25, oi). I also had to get an additional shot, which was another charge entirely.

I sent it all in with the I-485 petition.

The USCIS website has a list for civil surgeons... It'll likely take some time to call through and find someone who knows what they're talking about. I called five or so, only one knew that I didn't have to have an entire medical done.

Sent in two photos for each app. While they also take new photos at the biometrics, for my AP, they used the original photo. Also included a copy of my passport bio page, visa, marriage certificate and I-94 for each app.

I will say that I was quite happy that I sent in the transcribed vaccinations, as the IO actually went through my petition (seemingly for the first time) to look for it and ensure that it was there.

They cashed mine within ten days of having sent it in.

Sam where did you go to have the vacc records transcribed? Can I ask my regular doctor to do that, or do we need to pay a civil surgeon? Is there a link for civil surgeons in Florida/Orlando area. How much did they charge you?

Did you send it in with the initial application, or did you send it in later?
ArabellaFemaleCanada2010-05-18 11:27:00
CanadaAOS'rs...

I sent mine with just the sheet they gave me extra from the medical in TO. I wasn't missing any vaccines so I just took the chance, was approved without it. They didn't even ask for it at the interview (though I got one done shortly before the interview just incase as some people had been asked for it).

I didn't send any proof, took that to my interview. I sent 2 passport photos per app (6 total), and 1 copy of each of the supporting for all 3 apps.

Did everyone else send in 6 passport photos? The guides say to attach the 2 passport photos to the G325-a only.

Thanks for the info about the medical and shot record stuff.

Hey Guys,

I am mailing in the AOS packet this week. The only thing that is holding me up is the I-693 Medical Examination of Aliens Seeking Adjustment of Status. I don't see this on ya'll timelines. Did you not send it in? The guides say we have to send in the vaccination portion only? I don't mind transcribing his shot records, but do I have to hire a civil surgeon to do this AGAIN? We already did it for his K-1 Visa at the doctor in Toronto.

Also, does this list look complete? Did you guys mail in proof of your wedding (pictures), or is that just for the interview?

• Payment in the amount of $1010 USD
• G-1145, E-Notification of Application/Petition Acceptance
• G-325a, Biographical Information
• I-131, Application for Travel Document
• I-485, Application to Register Permanent Residence or Adjust Status
• I-693, Medical Examination of Aliens Seeking Adjustment of Status (vaccination portion)
• I-765, Application for Employment Authorization
• I-864, Affidavit of Support

Supporting Documents:
• Copy of Birth Certificate
• Copy of Passport with K-1 VISA
• 2 Passport photos
• Copy of 1-94, Arrival/Departure Document
• Original Certified Marriage Certificate

I actually have strong feelings on this but I won't get into them just because I've always lived here and by that I know my viewpoint is very biased smile.gif I'll just say that I feel if you immigrate to this country on a spousal visa you should apply for citizenship, good luck to all who struggle with the decision!!

Why? Don't you think it's enough that we pay thousands of dollars just to immigrate, live and work? What's the difference between becoming a citizen or just being a PR for the rest of your life? In the American Government's eyes, they are still making the same amount off you regardless. laughing.gif It's very expensive to become a citizen and I'm not even sure if I'd have the money at the time.

The difference between being a PR and a citizen? Your right to vote.

I dated a guy who was a PR, lived in the US since he was 5. He can't vote. The rest of his family are now citizens. When he renewed his PR card I suggested he go ahead and apply for citizenship but he didn't want to give up his ties to Spain. Now that I know more about immigration, I might have suggested that he should see if he can have dual citizenship.

Not sure if anyone has already said this (I didn't read all the replies), but the first anniversary is "paper." You could do anything from buying tickets, to making a craft on paper, to using a receipt and then surprising him with the gift (hey it's paper).

Guess what he did for a living in Canada? Yup, file taxes!!!!

So I am filing married but filing separatley. He can worry about his own taxes. He has a 2 year degree in accounting and I am sure he can figure it out. :P

Well yesterday was an emotionally charged day for everyone! I just wanted to update that Sean is going to the November 20th interview and then packing his bags to move down for Christmas. I told him if January 1 is too soon to get married he needs to pick another day before the 90 days runs out.

I don't know if I will be able to go to the interview with him- so I might need someone with a November 20th date to keep an eye on him for me lol!

That is AWESOME!!!!! That is truly great news, Arabella!!! Congrats! I hope you can make it to interview with him. I was there with my fiance' (at the time) and I totally embarrassed him by kissing him as soon as she said he was approved! I told him about your job positing for Montreal Consulate Officers and we both lol'd.

I could use some more kittens. Varba please if you would . . .

Also, Varba I feel left out of all of the WoW references and wish some of you people played EQ2 (EQ2 > WoW IMHO).

Seriously though, he was going to "move in" with me at Christmas time while we waited for an interview date. So now it is wait until February to be together or get married in 2 months! He says he doesn't want to feel "rushed" and he doesn't want to go without seeing me. I have 2 kids so me going to Canada means either flying 3 people there or finding a 24 hour babysitter for a few days . . . Not likely.

/crying, could use some kittens or geek speak . . .

I went from being super happy to super sad in a few seconds time. This whole process just fvcks with your mind. Just last night we were talking about how hard the long distance is and how we can't wait to see eachother (he is coming on Thursday).

I am sitting here at work crying and I can't stop. I don't know what to do. I called my mom and she says she'll do anything to help us plan a wedding in a fast time. My dad's a minister ffs and could marry us in my friggin backyard on a 2 second notice.
