What he can do is e-mail them asking them about a time estimation for receiving packet 3. That's what I did and they kept it in their records (at least, this is how the embassy in Greece works).

 

BUT also when my American fiance called NVC to ask for our new case number, the employee there asked for my contact details and so he gave them my e-mail. You could do that. Otherwise, he will receive everything by post to the address you have given to USCIS when you first filed for the K1.

The alien fiance should wait until they receive Packet 3, which practically is instructions on how the procedure goes on (papers they have to collect, like birth cerificate, divorce decree, photos etc.), as also the link to form D-160, which has to be filled in online by the alien fiance. After they get all that ready, they will notify the embassy and they will let you know when they are ready for you to call them and set an interview date.
I received everything in my e-mail, as we have given it to the embassy. Otherwise it will come through post.

It is nice that things are moving along so fast, but the timing is kind of bittersweet. She has a plane ticket to come visit from November 2nd until late January. Her trip will almost certainly be cut short, we had planned to spend Christmas and new year's eve together.

I called NVC yesterday at 6pm eastern time, and after waiting 45 minutes my call was finally answered. The lady was very nice, she gave me our case number, and she also gave me two other numbers she said we will need, the Customer ID# and Invoice ID#. I was not aware of these numbers so i'm glad she saved me from having to call again. She also advised me that our case was shipped to Athens on the 18th.

I haven't been able to figure out how they process the applications because the ones directly before and after mine were approved much earlier than I was. Keeping my fingers crossed that yours is coming very soon!

 

I wish I knew their process. Mine and two before mine are not approved yet. One directly after mine was approved Monday. There is also a mixture of approvals, not yet approved, and RFE's a few numbers after mine. All activity was from this week, so maybe it's coming soon!

Hello everyone. Just got some updates for my case. as I am a july filer, I decided to post my updates to see if anybody from july f got the same message. So the message is "we transferred your I129F, PETITION FOR FIANCE(E), to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed." I am not sure exactly what does that mean bad or good, but at list I see that something is moving on with it smile.png))

 

I got this same notice August 6. I received the hard copy in the mail today. We were transferred to the Texas Service Center.

Starting the week of July 29, 2013, USCIS began redirecting all newly filed Forms I-129F from the VSC to the TSC. The receipt notice will bear a TSC receipt number beginning with ?SRC?. The case will be processed by the TSC. The CSC will continue receiving Forms I-129F.


USCIS will post additional Web updates to inform customers of any future workload realignments

I checked the USCIS website today and got the following message

I'm not sure exactly what this means, but I assume it means our case is not sitting around in a file box???

Alot of us here are patiently waiting to receive the long awaited NOA2, and there is an unpleasant feeling knowing the members of this forum are stating they received theirs within 2 weeks, or in some other short term period within 2 months.  From what I heard, some people are just feeding their ego and lying about their NOA 2 date.  So I ask that if you're gonna write about receiving your NOA2 earlier than most members of this forum, to prove it by simply uploading a copy of your acceptance certificate (white out your important info).  This way, we can separate the egoists from the legitimate approvals.  Thank you :)

I'm sorry you had to go through this.

 

I didn't know you had such a close relative in the US. If I knew, I would have warned you. They asked me if I had any relatives in the country, too, but I only have 2 second cousins in California, 3000 miles away from where I am.

 

I'm sure you feel disappointed and having been wronged, but, on the other hand, the consular officers have to do their job. No matter we like it or not, we are the ones that have to prove that "we are not an elephant"!

 

Did you send them the information they asked for? I think they were just looking to see your reactions. The fact that they kept your passport is very important. Send them the info they need and be patient. They'll update the CEAC status to AP, but this is normal. Then it will go to READY and then AP again, before they let you know that they need you to pick up your passport/visa and envelope.

 

As other members have already told you, once you get your visa in hand, all these will be forgotten. Immigrating (for whatever reason) is a hard process from many different aspects. You HAVE to be strong, if you want this to work out with your man...

You will get your SSN before you get married and after the happy event and when your EAD/AP arrives, you'll go back to the SS office and change your name! You just have to wait for 14 days after your entry in the US, for their secure database to be updated with your data. Then, you can go ahead and apply for an SSN.

 

I'm sorry to read that people had trouble entering at Atlanta POE. I came in through that port and it went very smooth. I had no problems at all.

So, you got it!!! Congratulations!!!

 

Don't worry about the NOA2. My NOA2 expired on January 31st and I entered the country on February, the 20th....no problems there! 

Your visa will have an expiration date, which will be 6 months after the date of your medical examination. Make sure that you enter the country before that date and you'll be fine. Then you have to get married within 90 days after the date of entry and file for AoS.

I guess you mean his A#. In the past I would have said to put 'Unknown' for the answer. However, the new form does not allow for entering anything other than number characters there and the new form instructions state if something is not applicable or none, then leave it blank. Since you do not know the A#, Then leave that question blank. If you want to explain that you do not know your ex-husband's A# on the cover letter or an attachment sheet, then you can do that too.

 

That's a good idea. The old form can still be used, It's valid until  September 16, 2013

Does not necessarily need to be English. All documents for the I-129F package must be translated. Documents for the interview at the embassy can be English or the language of the country where the interview is.

So you are not out of status and a legal permanent resident? So you can get an ID or drivers license, work, go to school, travel outside the US and be able to re-enter. If you ever want to file for naturalization, the sooner you become an LPR, the sooner your 3 year clock starts for being eligible to do that as well. You are essentially home-bound and dependent upon the USC spouse for everything and have to worry about traveling near the borders and hitting CBP checkpoints or the searches they do on buses looking for illegals they sometimes conduct, if you were to try and get around that way. I personally would not want to live like that. It is always best to file as soon as possible.

USCIS is giving conflicting information. In this section 23.2 General Adjustment of Status Issues, under a section concerning advance parole, clearly states there is a 90 day time frame.

 

USCIS notes that applicants for adjustment of status who entered as a K-1 or K-2 nonimmigrant, and who later filed to adjust status, will continue to be required to obtain advance parole to avoid abandonment of their adjustment application upon departure, as provided in 8 CFR 245.2(a)(4). This is the case because K-1 and K-2 aliens have only a 90-day period of admission prior to being required to marry the citizen petitioner and file for an adjustment application.

Wrong on both counts.

 

A K-1 usually has validity of six months from the date of the medical, not the date of issuance.

 

And even if the K-1 does not marry within 90 days of PoE, if they go on to marry their original petitioner than they can submit an I-130 and an I-485 and adjust status that way.

 

So the department of state website is wrong? And how am I wrong about having to leave the country if you don't file AOS within the 90 days?

It can happen, especially since they debit your account electronically and destroy the actual check. I once mixed up two checks and my power bill check was sent to, and cashed by my auto loan bank! It was the power company who caught the mistake and called me.
