I know that I have EVERYTHING that they have asked for, every form, every piece of supporting document. All boxes filed out. I've even added additional things that may not be needed, but might be asked for. Everything is signed. I have attached Letter providing information to explain things that need to be explained. This is one complete well organised package.

I've quadruple checked EVERTHING! Unless they want some additional information that is not listed as a requirement, I think we're good to go with the applications.

My medical appointment is tomorrow and Wed I can pick up the results and will be mailing in the package.

I'm confused at to what actually will happen to my applications. My husband and I are filing a concurrent I-130 and I-485 tomorrow. We'll send it to the address in Chicago.

What happens after that?

Our local district office is Boston. I'm getting confused as to where my applications will go from Chicago and where I should be checking to see processing times.

No, they do not need to pay an extra $1000.00. There is an I-485 supplement that people need to file (fee is $1000.00) if they have overstayed, but spouses of USC's are exempt from that.

She said she got an EMAIL from USCIS yesterday. It doesn't sound like she actually recieved the denial letter yet. She also said that her husband forgot to send in the G-325 and sent it in late: ATTEN: USCIS and the address. Sounds like they may not have gotten that document until after the RFE timeframe, but either way, you will need to wait and see what your denial letter says.

Maybe you can book an inforpass and go down to the USCIS office and talk to someone, but it's probably better to wait until you recieve the denial letter. It probably should come to you in the mail soon.

Town Hall is usually good, also Fed Ex usually has a notary. I took my tax return and id right to the IRS Tax help center and they just verified the documents there.

I believe they only need the page with the phono/info on it. At least that is what the IRS clerk took a copy of from mine.

I'm sure he can bring a copy and the original and that would be fine.

No, it is not fraud to enter the US with an intent to get married, it is fraud if you enter the US with an intent to get married and not go back home. Therein lies the difference.

One thing to consider, if the person inspecting you on entry, knows that you plan to get married, they won't admit you into the US, because they figure there is a good chance you may not leave.

Anyway, that's my take on it.

I've crossed the US multiple times with my current husband and each time we were travelling as a couple (expect once on a day trip to michigan), I was quizzed and quizzed on what my plans were, when i was going home, where i lived, was i planning on working in the US..etc..etc,...even had all tampon box opened up and searched. Anyway, that's another story.

Benjlenbar, not to be nosy, but what is your current annual income? Even though you might have had a low income in the past, your current income may be enough to sponsor her, especially if it is a full time, non contract job. Anyone can act as a co-sponsor, so if you need one, it doesn't have to be a family member.

You'll probably have a hard time getting a K-1 visa without having actually met your future wife in person, so I guess that is out.

Yes he can. I applied for a TIN last year and used my passport (in maiden name) for identification. We just attached the W-7 (and supporting documents) to the the tax return and it was fine.

Canadians who entered the US as a tourist (with no visa) and who wer not given an I-94 (or a definate departure date) are not subject to any bars based on an overstay, but I believe that his working illegally could lead to a possible bar if he left and tried to reenter.

Canadians won't need a passport to reenter Canada (although chances are they will have one seeing as they now need one to get in the US). But it's not a Canadian rule, it's an American rule - Americans will require a passport to reenter the US.

I find their story much more believable than someone who comes in pretending to know nothing about the immigration process and talks of intent and "spontaneous marriage"...etc ... etc.....

Anyone who enters the US legally can file to AOS, weather they get an interview and approval for that AOS is another thing.

She was given a tourist visa and allowed to enter the US. My take on it - at that point a decision had been made that there was NO intent to immigrate, otherwise she would have been denied entry. That seems pretty logical.

There are people in here saying things like "you and your wife will have to prove that there was no intent to immigrate".

I've seen plenty of people post stories about their adjustment from a tourist visa and only ONCE have I seen anyone say that they were questioned in ANYWAY about their intent on entry.

People MAY (not will) have to prove that they did not intend to immigrate when they entered the US on a tourist visa and then adjusted status from within the US based on their marriage.

If you ask the wrong question, you'll get the wrong answer.

It's not a question about the validity of the first or second marriage to the current wife. It's about the attempt to have two marriages to two wives at the same time.

A polygamous marriage is, by definition, invalid (at least in the U.S.) The point is, it's also illegal, and cannot be brushed off with a friendly explanation (whatever that might be.)

Fact is, the man tried to have 2 marriages simultaneously, so the real question is: is he eligible given a polygamist past?



That is not polygamy. Go look up a detailed definition. You need to PRACTICE polygamy (be involved with 2 or more wives at the same time in a relationship). He would be considered a bigamist.

Cessna, go to http://www.uscis.gov...00045f3d6a1RCRD and look up the information regarding fee waivers. You probably will fall into one (or more) of the categories that they feel may qualify you for a fee waiver, but it is up to USCIS to determine if they are going to waive your fees and their are no guarentees.

I was grilled for quite sometime at this backwater POE in Nowhere Maine/Quebec. This was years before I even married my husband, but I think because I was in his car with him, they were suspicious. I've never experienced that before or since. We even entered the US several times together, when he was living in Canada (Michigan/Ontario border) and it was all a breeze. I think a lot of it depends on how busy a POE is and who you get to inspect you.

I read one article about a spouse to be being denied entry at the POE. the girl was about 21 and the husband to be was in his 70's. The POE officer decided he didn't believe that the relationship was valid. I'm sure this is not something that happens a lot.
