You are calling this a wedding.  You cannot get married and have him leave and come back for the "real wedding" on a K-1.


 

Quit calling it a "wedding party". Never use the term wedding, if it is not a wedding.  Why not wait till he gets here on the K-1?


 

She's a bride to be she can call it a wedding if she wants to. People get married legally all the time and then have the party and they call the party their wedding. So why can't she do the same?

I actually think it's a great idea and even if he doesn't get his visa before October and has to go back home you know it won't be long before he comes back :)  Smart thinking neaivj. It sucks not being able to plan a proper wedding so why not take control one way or another. Let me know how it turns out as I too will probably push back my interview to make things work with when we plan to get married.

sorry i didn't make it clear, its just celebration wedding, no legal document invloved, of course we will do the legal marriage document after we have the finance visa

 

so by law, we are still not married but we are having the wedding party before

We are about to submit our K-1 Visa, still waiting on a few things to settle before we send everything. My fiancé currently lives in Ohio, which if we file now would assign us to CSC, but he will most probably be moving to Florida in the next few weeks so that would send us to TSC. My question is at what point in the process do they assign the service center? And what happens if during the process there is a change of address?

I am in this boat too. I planned for an ~ 5 month wait for NOA2 and got it in a month... I contacted the consulate once I had packet three and they said they it was OK if my interview was after the date of validity and that they would extend it. They told me that they generally do this automatically, but advised that I contact them around that date again to tell them to extend the date and that I was still actively pursuing the visa. This is what happened for me in Canada, but sounds like it's similar in UK.

 

Remember that you have six months to use the visa once you have it, so there is some buffer time if things move faster than you expected.

Once you file the I-129F it could take days or months.

Once you have NOA2 they expect you to be booking an interview within that 4 month period

Once you have the visa, you have 6 months to use it 

 

You never know how fast or slow things will move... In the end it could change at any time... but you could stretch out the packet 3, medical, interview and moving to take 8-10 months even if you got you NOA2 in a month or two.

 

 

 

Was this the consulate in Vancouver or Montreal? Just curious because we are kind of in the same situation... I live in Montreal.

I just want to make sure something like this wouldn't result in some kind of fraud. 

 

Me and my fiance decided we need to have a wedding in both countries so neither of our families feel left out. I was planning on visiting him this December anyway, and was wondering if it would be legal to have a FAKE ceremony? like with no papers signed, just the act of a wedding for his family? 

 

This might be a stupid question, but i'm just being cautious. 

 

I'm not quite sure what to tell you... Another VJ member suggested something similar, which I thought was a good idea for her situation but totally got shut down by someone else (can't remember who exactly) saying I was totally wrong, stupid,  and giving bad advice that would jeopardize the OP's future. :o  Which obviously I had no intention to do.. I'm a nice girl and was just sympathizing with another future bride in the midst of her crisis!!

 

Therefore I have no actual advice to give you but in my opinion I do honestly believe the US government is smart enough to understand the difference between a LEGAL wedding and a FAKE one. There is no reason for someone to POE on a K-1 when they are actually already legally married... that is nonsense!

 

I love all the suggestions, but we must consider that this couple actually are worlds apart... They probably want to see each other in December because it will be half way (or something like that) through until they get approved and can POE. Weddings are expensive and so is travelling. Why not kill 2 birds with one stone: Visit the fiance and celebrate their union with the Australian  family!

 

All I know is people often deny or judge others plans or questions with no actual proof. I feel like a lot of VJers make things worst then they actually are. It's a crazy and scary process but in all reality there are just about a million ways to get through this process.

Don't think about tomorrow, plan for your future.  My only other advise will be, stay busy, distract yourselves as best as you can and talk each and every day. Right now you get to plan your perfect future and that's something to be excited for.

Hey guys--

 

I just left the Post Office with empty hands - I just mailed our I-129F packet vis USPS Express Mail to the Lewisville address.  It will be delivered on Monday September 8th by 3:00pm.

 

I'm not sure if I'm the only one who as ever felt this way, but letting go of something I spent months working so hard on, has left me so emotional.  (I made two copies of everything one for me to keep and one to send my fiancé -- no worries there folks!)

 

It's just that while I am excited to have completed this very first step, I feel empty now and a little sad.  

 

Has this ever happened to anyone?  It's a hard feeling to explain - I am over the moon that we are one (tiny) step closer to being together.  But I think the idea of the many unknowns - RFE's or long waits for NOAs and case numbers or the petition in transit from one place to the next - that is making me terrified and sad. 

 

I'm gonna give my fiancé a call this evening, I think talking to him will make it better, as it always does.

Your post made me both smile and worry about my own reaction when we send out our packet lol. I?ve also been working hard on our application to make sure everything is in order and that we have everything we need. I am visiting my fiancé in 2 weeks and we will finalize everything, and double (triple) (quadruple) check that we are all set to go.

 

I completely understand your feelings! Although feeling very excited that the journey will begin, it will no longer be in our (my) control. That for sure will make me feel uneasy and emotional. It?s good that your fiancé makes you feel better? Same with us, although I?ll be emotional and stressed he will be calm and help me chill out. One of the many reasons I am so in love with him and know we complete each other!

 

Remember to celebrate every step, as it is a step closer to being with him and your wedding day! I will try to remind myself as well lol!

What do you mean you arrived in US without a visa because your a Canadian citizen? You still need a visa if you have been living in the US. If you are here visiting for less than 30 days then say you arrived as a visitor.
The I-94 shows how and when you entered the U.S. it's all digital now but you can request a paper document for immigration purposes.
A travel document allows non-US citizens to travel abroad. I would guess that you do not have a travel document though so you can't fill this section in.
P.S. It sounds like you came into the country legally so defo do not put without inspection. That means you crossed the border illegally. If you came by plane then you most definitely were inspected at the airport.


 

Canadians do not need a visa to visit and we can stay up to 6 months, many stay even longer without issues.

 

On I-129 question 15, it asks "If your fiancee is currently in the United States, complete the following:"

 

 

15 a: He or She last arrived as a: (visitor, student, exchange alien, crewman, stowaway, temporary worker, without inspection, etc"

 

Now, I arrived without a visa because I'm a Canadian citizen. Do I just write without inspection? Or does that imply that I had a visa but was never inspected?

 

15 d: Date authorized stay expired or will expire as shown on I-94 or I-95:

 

What do I write in this? I was never given one? 

 

15 f: Travel Document Number:

 

What is a travel document number?

 

I'm also curious to know the answer to this question and if going the k-1 route while you are visiting and staying there could cause a problem.

What enables you to be able to do that?

 

We share a pretty big border and many people go back and forth daily. We even have a program called nexus that allows Canadians and Americans that travel frequently to go through quickly  and avoid waiting at the border or customs.  http://en.wikipedia.org/wiki/NEXUS_(frequent_traveler_program)

Yay to a fellow Montrealer, or ex-Montreal I should say. 

 

No matter how often you see each other, being apart is hard because your spouse is not in your regular day to day life like normal couples. We've been dating for over a year and got engaged in July we see each other every 2-3 months usually for a week to 10 days at a time. Coming back home is always difficult and it just no longer feels like home... but it wont be like that forever.

 

I guess like everyone said keeping busy with work and friends helps. I also plan for our 'unplanned wedding' gathering ideas and searching for venues that can be booked last minute. I've been wanting to start a scrapbook for just about 10 months now lol i'm a procrastinator I suppose. Every time we do something together my fiance gives me our tickets or our hotel room key and says ''Here for the scrapbook'' I actually think he's expecting me to do one  :oops: I should get started!

You seem really fixated on this Carribean thing... why is it so important to you to be married THERE? There are beaches and resorts aplenty in the US - you could be married in Florida or Hawaii... it just seems to me that since you are already legally present in the United States with your fiance, you have something that most of the people on this board have fought hard for, so why jeopardise it? It's August - if you married him in front of a JP next week and applied for AOS/AP right away, you should have the permission you need to leave the country safely by January. Then you could have your big 'destination' wedding and all the hoopla you wanted without risking a ban or eviction from the US.
