No using household members with an I-134 for a K-1. There is no combining of incomes with the I-134. That is only for an I-864. You need a co-sponsor that meets the requirement on their own for their household size plus the foreign fiance(e).

 

So you're saying that if my friend who wants to help gets a job, she'll have to make enough to be above the 125% poverty line for her family of three, and for my fiance. So how much money (a year) would that be exactly?

I'm guessing she will file for taxes based on what she earned last year. Also have you heard anything about the fiance needing to live with the co-sponsor? Someone I know who has helped people with other immigration issues mentioned that, but I don't know if she just heard wrong. Any idea?

Hey- I've been asking around about how much I need to make to be approved to sponsor my fiance before he applies for a job. All the answers I get are to study instructions and to look at a poverty chart thing which really only confuses me more.

 

Some informtion about me:

- I am the only one who works in my household. My grandfather has investments (he won't be a co-sponsor), but would those factor into my household income?

- I make almost 9 dollars an hour at my work, and I work anywhere from 14 hours a week to 35.

- There are 4 people total in my household

- I haven't worked a full calander year yet, so I don't have a good idea of yearly income.

 

 Please don't post the whole poverty line chart unless you can explain it to me please. I'm really wanting to figure out if I can actually sponsor mu fiance by myself. I am not having success finding a sponsor at the moment, so I'd love some clearer answers.I'm looking to file the paperwork in January. Thanks!

Hi everyone! I haven't found too much on this topic here on Visa Journey, but was wondering if anyone has ever seen while tracking their paperwork from the NVC to the Embassy that the package was refused by the recipient (meaning the Embassy)?

 

Is this something that I should be concerned about or just give it a few days and see what happens? I'd just hate for my paperwork to end up in the hands of somebody it doesn't belong to or have to resubmit everything all over again.

 

Any advice, suggestions, etc... would greatly be appreciated.

I put mine in a plastic bag stapled to a sheet of paper that was labeled "Photos". Also, don't forget to label the back of each picture with names, dates and locations. I just received my NOA2 smooth sailing with no RFE's, so it worked for me!! :)

Hello to All VJer's!

 

I had something very strange occur here pertaining to an RFE. Hopefully someone out there can explain, since no one at USCIS could explain it. (I'm sure this comes a shock to you allrofl.gif )

 

On April 22, I checked my case status on the USCIS website, finally after 7 months and 2 days they looked at my application. Much to my surprise, they stated an RFE would be coming my way(Never thought I would be so happy to get an RFE). Now,  I patiently waited for almost two weeks, checking my mailbox every day and guess what? No letter has appeared in my mailbox. So tonight, I checked the website and wouldn't you know it, the website states that on May 1, an RFE was mailed to me. #######?

 

What happened to the the RFE that was supposedly sent April 22? Something else that got me attention was I have yet to receive any text or e-mail notifications of the RFE's. I know its working because I got text and e-mail notification for my NOA1

 

Now here is the question, did they send me 2 RFE's? One on April 22 and one on May 1 or was the first notification a mistake? I talked to Tier 2 rep and all they could do was say that an RFE was sent May 1.  

 

Any input from you all would be greatly appreciated.

Hello Everyone!

 

I have a few questions regarding filling out the I-134. Question 11 regarding " I intend or do not intend"

 

I checked the sample form I-134 on VJ and it has for K-1 purposes fill in the following:  N/A (K-1 Visa Process to Permanent Residence). Can someone tell me if this statement is still valid when submitting I-134 at Embassy Manila interview? Or do I have to check intend and make specific statements as to amounts and duration? 

 

Also, because my fiancee will be submitting K-2 visa documents, would I put on the (K-2) I-134, N/A (K-2 Visa Process to Permanent Residence) for Question 11?

 

Lastly, is it recommended that I fill in net worth numbers, savings accounts, stocks, bond info even if I already meet income guidelines without that information or will putting that information on the form just "muddy the waters" with Embassy Manila?

I wonder if someone can please give me some hope.
In 2004 I was diagnosed with Depression and spent 3 months in hospital and in 2010 I was struck down again by my ex partner leaving me for someone ele.
I was also diagnosed with Borderline Personality Disorder and depression. I made some bad choices and in May and July 2010 I took an overdose and was in hospital overnight.
I have remained on anti depressants ever since but I'm glad to say that I have been well for 3 years now.
I am extremely worried that I will not pass the medical examination due to my history.
My Doctor has said she will write a letter saying that I am not a threat to myself or anyone else.
To summarise, I am "the best" I have ever been and I think testament to that is that fact that my mother passed away on Christmas Eve last year and I have dealt with that in a productive way with no signs of my past issues reoccurring
The thought of waiting 5 months for processing and then possible denial is difficult to come to terms with.
If anyone has any experience of a similar situation I would appreciate you sharing your story.

Did you send in the Decree Absolute or the conditional order?
The decree absolute is the paper that is stamped by the judge to say that you are now divorced and that you are legally able to enter into another marriage.

I am Canadian and my boyfriend is American, we are trying to figure out what we want to do in order to be together, we do not want to rush things as it pertains to our relationship but find long distance difficult. My question is, if we apply for a K1 visa, how long after I move to the US can I apply for my green card? And what is the timeline for that usually.

Oops I had forgotten about the fee for AOS. Just getting the process started... so much to think about! But your timeline just made me super hopeful. You see and hear so many complaints about the long wait, but your waiting time was pretty good. I heard Montreal was slow for interviews but it doesn't seem so bad, hopefully they keep the same pace for another few months lol!  I'm excited can't wait.

I don't know if I'm blind or dumb, but I am looking for information regarding the fees associated with my k1 visa. I have seen the first fee that must be sent with the I-129F petition, but I haven't been able to find the other fees. I'm not sure if this is relevant but I live in Montreal.

Im curious...I sent boarding passes & passport stamps for me. Some photos, screenshots from checkins on Facebook, an engagement ring receipt with his card on my visit (I stayed at his flat in England) 3 photos, a photo of me wearing the engagement ring & a letter from his roommate stating I was there. We didn't go anywhere because money is tight & everything was paid in cash. Do you think I'll get an rfe? I just visited him again & I have more boarding passes & stamps & more photos of us this time (including ones with his family) in case I do get an rfe...

 

From what I understand I believe you have enough. As stated earlier in this thread, they are only looking for proof that you have met in the last 2 years. Proof of bona fide relationship is for the interview... So I do not think you have too much to worry about.

Just so everyone is clear, you do not need proof of a relationship at I129(f) time.  You do however need that at interview time.

 

All you need at I129(f) time is proof that you met once in the last 2 years.

 

OH yeah that's true. 

 

Anyways I just looked into a few things and in the last year we have over 726 hours talking on skype! I don't think proving we have an ongoing relationship will be an issue lol. And we have plenty of pictures and boarding passes to prove we have seen each other recently. Everything is looking good!

We are about to start our I-129F package. We met online, and have been officially dating since August 2013. I was wondering if screenshots of facebook posts can be submitted for proof of relationship? I have my plane tickets, he will checking for his. We also have some pictures of both of us with his family, as well as booking confirmation for a cruise during Christmas time. Just wondering how much they actually need since we have seen each other many times in the last year.

You got it wrong. You are supposed to have the exact day in August. They will be suspicious if you do not even know the day you guys met.

 

I never said i didn't know the date we met... I have a plane ticket for it. I doubt they will have anything to be suspicious about.

So forgive me if this is a super silly question (or if there are a lot of threads about it), but I want to hear some stories!

 

My fiancé and I are in the throes of wedding planning, but the idea that we could pick a date that is before his approval or too late AFTER the approval is terrifying!

 So what did y'all do?

 

We were thinking, ideally, we'd apply in August 2014 and be able to get married (or "married," as in venues, flowers, cake but maybe not legally, lawfully, sign the certificate yet if the visa isn't ready yet) in June 2015. We are looking at a venue when he visits this weekend. Is it possible to have a "ceremony" and reception of sorts, and then get "married" after? Or vice versa? Should we just wait until the petition is approved?

 

As if wedding planning weren't already insane enough...

 

Trust me by no means is that a silly question. It is probably one of the biggest struggles that come with the K-1 Visa, in my opinion anyway  :wacko:

 

As mentioned it all depends what is important to you. I reluctantly suggested we go that route courthouse and later on the actual wedding to try and make things easier, but as my very smart fiancé put it... If we do that we will probably never actually go through with the wedding reception, and to us it is important to celebrate the same day we say our vows and legally become Mr & Mrs. Therefore we are most probably planning a simple but elegant beach wedding in Florida. It would be ideal to get married during the off season, and for Florida this means before December and after April. I'm hoping our timing works out for me to move in February so we can have the wedding in April.

 

As far as planning goes I guess I already started planning for my planning. Some things can be done beforehand such as dress and shoe shopping, and choosing colors, flowers, wedding favors, etc. I guess one of the benefits of not being allowed to work when I move is that I will be able to dedicate my time to plan our big day.

With all due respect: YOU ARE WRONG.You cannot call it a wedding.  You cannot get married while processing a K-1 visa.  You cannot even infer that there is any kind of a ceremony that looks like a wedding.  People have gotten tripped up just having an engagement party and showing pics to the CO.  CO's tend to believe that photos taken at what looks like a wedding, a bride wearing a wedding gown, a groom in a tux, bridesmaids, groomsmen, setting, reception, etc appear to be photos of a wedding.  You know the old saying, if it smells like a wedding, quacks like a wedding and looks like a wedding, it probably is a wedding.  Therefore the word wedding should never be used.  An engagement party might be okay but I would not even show the CO photos of that.  They might request evidence to prove that they were not married.  I am just trying to help the poster.  You are giving poor advice that could very likely get the OP in trouble.

 

With all due respect YOU ARE WRONG.  A couple in the process of a K-1 should never hold any event called a WEDDING or any event that looks like, smells like, or sounds like a wedding.  They should simply postpone the "wedding" and wait until the spouse is here in the US.  But that's just me talking.

 

Oh and by the way.  I am not suggesting that I am perfect.  I made the mistake of booking our airplane tickets from my wife's home country to the USA 10 business days after we attended the interview.  Well, I failed to follow what all the fine people here on VJ said and that was, "Never book plane reservations until you have the visa in hand."  Well, as it turned out 99% of the VJ'ers were correct.  I ended up having to change our airline reservations at a considerable cost because it took 11 business days for the visa to arrive at our 2GO delivery location.  So the moral of the story is: Patience...and never book anything until the visa is in hand.  Oh, and don't get married while processing a K-1 visa.

If you read what I said I did not give her advice. I understand the situation she is in and if that is what would make her happy then I think she should go ahead with her plans. Obviously if this goes against a 'rule' or requirement she should not do it. I am not an idiot.

Where can we find this information you have stated? My thought process is a wedding is a tradition and means nothing if there is no legal marriage. Just as having an engagement ring is a tradition so it is not a requirement to apply for a k-1. I'm not saying you are wrong or trying to offend you in anyway but a lot of people say a lot of things and I think it's important to get information from proper resources.

sorry i didn't make it clear, its just celebration wedding, no legal document invloved, of course we will do the legal marriage document after we have the finance visa

 

so by law, we are still not married but we are having the wedding party before
