Hey Bajan,

I have a few things for you. The first is that once you can find a co-sponsor they need to fill out i-864a. That was the same problem one person had at the embassy. The co-sponsor filled out the wrong form. The i-864a is used in conjunction with the i-864 so that you meet income requirements. The other option is seeing if your assets can be converted into money times five the difference of your income for 2009 and poverty level or see if you could borrow the difference and put it in the bank. The last option is and I know you don't want it to come down to this but to wait until you file your 2010 tax return.


They request the I 864 she is married her maiden name is on everything and her married name is on the passport. Should I have her put her maiden name on the I864 or the married name?

First - dont email the embassy 4 times asking such question. No co-sponsor is needed id you met the income requirement.

You petitioned for your husband and you're now petitioning for a child. You will be required to have the income of $22,887.00 to support you all (3).. for any additional person you are responsible for add $4,675 and you need to earn least that amount. if you have sponsored ANY immigrant who is not a citizen or worked 40-credits then you count them in as your household.. if you only sponsored your husband then ignore it.

Ok here we go again well last year I filed for my husband and due to the fact that I was unemployed for part of 2009 my yearly income tax was low for 2009 and not enough for the income guideline even though I was making enough in 2010 so I had to get Co Sponsor because in JA they only look at the tax papers so now I'm filing for my step daughter and I just filed my 2010 and it is more than enough do u think that I will need a co sponsor again? Congrats! Sounds like bad news for us, we had to wait a while to schedule our interview for various reasons, only sent packet 3 back yesterday, so looks like we'll be scheduled for April too sad.gif

Well, as far as what you do now, make sure you have your police report, medical and forms complete, organize your packet, get your affidavit of support and supporting documentation together, practice for your interview, and sit and wait. whistling.gif Also make sure you know your paperwork backwards and forwards. A lot of shuffling and searching doesn't look good.

Hey guys, boy you Dubs are popping up a lot lately:D I'll just address you all generally and say the Dublin embassy is VERY understanding so I wouldn't worry so much about your income. As long as you have plenty of proof of a job that pays enough it doesn't matter if you've actually MADE enough yet or not. My fiance took in a signed letter on letterhead from my boss, and a copy of my job offer, along with my tax returns for 2006, 2007, and 2008 (none of which showed I had made enough money!) and they said oh yea, that's not problem at all. Also, they didn't even look at the rest of our packet, the only thing they looked at was my financial support, and they took that and kept it.

Also just FYI, Dublin sent him the financial affadavit from 2007 that requires a notary, but there's a new one that doesn't. I actually sent him back BOTH, with just the one from 2007 notarized. I think I wrote all this in the embassy review...

Check the poverty guide lines site that No Where Man gave you, then you will know for sure. You financial for the embassy is based on the last year filed for taxes, plus any other assets "if have" Best to file the 2008 ASAP, I would say.


I sure hope they take into consideration CURRENT income because if they only use 2008 I am totally SCREWED. But I got a great job in December.


They did for us, I only just got my job at the beginning of August so my tax return showed below poverty level because technically I had only earned 5 months income for 2008, BUT I had a letter from my boss and my job offer with the full year's income listed, and they took it no problem. Also FYI, it helps to be SUPER organized. They really really like it and know you're serious. We put all our stuff in a 3 ring binder with tabbed dividers.

my fiance went to the local Superintendant (Kerry) and got it without the packet 3, but he did take his full application with him, including a copy of our NOA2. It took about 3 weeks to arrive. He says they didn't ask to see any of his paperwork at all, even though he had it with him. It wouldn't hurt to try! He also says make sure you ask for a "police certificate for visa or immigration purposes".

That is really encouraging, thank you. At first glance, the K1 didn't seem like the way to go — and I'm still not sure about him having to wait to work. I assume if he left his current company, however, he could look for jobs during that three months, just not begin work.

That the '90 days a year' on the VWP/tourist visa isn't hard-and-fast is good to know. I had read he would be barred from coming here at all in the interim and I still may consider trying to go over there for a time. Being able to work would be an issue for me, however — I wouldn't want to go stir crazy!


Regarding looking for work, from experience, it's hard to look for work during that 3 month period because you don't have a set start date, and most jobs open fast and fill fast, unfortunately.

Regarding my hubby's 89 day visit, keep in mind he did NOT tell the CO that he was in the middle of a K-1 application. He most assuredly would have gotten turned away. However, that being said, we decided to risk not saying anything because we weren't getting married during that time and didn't feel that we would be doing anything illegal by him visiting.

Regarding working in Ireland, they are just as strict as the US for working. However, if you're married you can work straight away, it's much faster over there. I know a couple that got married, and she went over there and got residency VERY quickly and started working. If you really don't want to be separated maybe you should get married there, put in your CR-1 application, and be an Irish resident in the meantime.

hxxr, how long before filing for the K1 did you get engaged? Did you get married in the U.S.? How was he able to come for 89 days if 90 is the cap? I want to understand what the process would be like for us on the K1. My boyfriend has actually not proposed yet!


We were engaged about 4 months before we filed. We got married in the US in a civil ceremony in June 2009. (See timeline). He came for 89 days in one visit. 90 days is the cap per visit, not per year. See above post by Wyld Blu for the process details, we were exactly the same.

Regarding working, we were fortunate enough that I could support us both while he wasn't working, albeit barely. In fact, even though he's been here for 8 months he only just starts his new job this Tuesday.

If earning money is a major concern for you, some folks get married in Ireland and file the CR-1 then return to their home countries until the CR-1 comes through. Your hubby would stay there and work while you stayed in the US and worked but you'd be married. It takes around 6 months, maybe less. Then as soon as he comes over he'd be eligible to work.

PM me if you have detailed questions, I've helped a few Irish folk through the K-1 via VJ, I'm happy to answer questions. I'm not too knowledgeable about the CR-1 though.

Just do the K-1. Being apart is hard, but if you really are in love and have a solid relationship a K-1 from Ireland is easy-peasy. Ours took 6-7 months but he's here for good and we didn't break the law. It could have been faster but he took his sweet time getting his paperwork together. He also visited me for 89 days on a VWP after we filed for K-1 but just said he was on holiday visiting a friend and showed LOTS of good evidence that he'd be returning home, including a letter from his boss. So we really spent half of the K-1 wait here, and just a couple of weeks after he got back to Ireland from his visit he got his interview papers.

Just remember it might be a hard year for you, but you have the rest of your lives to be together.

Good morning VJ amigos! I have a couple of questions.

My Lawyer recommends I get a Bank Letter from the institution whom I bank with. Is this really necessary?
I've been gathering all other required documents and information, but I thought I didn't need a bank letter unless I was near the poverty line.
Can I submit my pay stubs instead? The reason I ask is because my bank tells me it will take approximately 2 weeks for the bank letter to be delivered. I don't want to wait that long.

Previous years tax information. I've also been told to get a tax transcript for 2009, 2008, and 2007. Problem is I didn't file taxes in 2007 because I didn't work (in college was student), and I only made about $10,000 working part-time in 2008. I work a full time job since May 2009. Lawyer believes I may have to get a co-sponser. Why do I have to have 3 years of income history to show I'm capable of supporting my wife and she is not going to be a burden to the government welfare system? My monthly paystubs shows I make over 400% above the poverty threshold!

I understand my lawyer is erring on the side of safety, but I don't want to delay this any longer than it needs be.

Can someone offer me some advice?


I submitted a letter from my local bank branch stating the current average balance in my accounts, a letter from my employer, 6 months of pay stubs, and my W-2s with my tax transcripts for 3 years (we filed right after I filed my taxes so I had 1 year of taxes above poverty level). I had only held my job for 6 months and before that I was a student as well, making below poverty level. Mine went through fine, no RFE. The co-sponsor is not necessary, but the other items all are. As someone said above, more is always better than less, but you should be fine.

Is there anyway you can just get it updated? My hubby has to update the address and add me as spouse. He took an appointment and they said he will get his passport back in 15 days (and that is with the verification for new address etc) if you are just adding hubby to the passport it should be faster and easier!

 

Otherwise, I agree that just state the truth, you haven't had time or whatever reason to add your hubby to the passport!

I think it depends, in Mumbai the USC is not even allowed in so there really is not point for me to be in the country except for moral support. In Delhi the USC can enter with their spouse for the interview so then it might be worth it.

if your marriage certificate is like ours you should be fine. Ours has out passport photos on the MC along with our full names, DOB and signatures i would guess that if yours is like that too then at the infopass appt it should be verified that its not a problem at all!

That's great!!!! I will let the husband know about this so, we can start working on fixing this problem. Do you think I should wait to file after we get the marriage certificate fixed? I really wanted to get the ball rolling on the petition since I know its going to take some time.

I don't know how much of a problem it will create if you send the packet with 1 marriage certificate (that is spelled wrong) and then update the packet later once its fixed? Or do you send the packet without the marriage certificate knowing that you will send it as soon as you get it corrected? Maybe call and speak to tier 2 and see what they recommend?

 

also see how long it will take to get the marriage certificate fixed, if its less than a month i would wait and send everything together and correctly the first time, since sending incorrect MC or not sending the MC at all might delay processing by more than a month anyways so it would have been worth it to wait for the corrected MC and send it all together!

Yes, both my husband and I are surprised that we did not catch this. I am thinking of sending both the registered marriage and the Hindu marriage also which has my picture on it to prove its me till I can afford to return to India to fix.

You shouldn't have to go to india to get this fixed. we used an agent from Your Man in India and he fixed hubby's birth certificate (which had a completely wrong name) it costs a little more (around $100) but they did all the legwork at the municipal office and got us 4 certified corrected copies to submit. oh and it was done relatively quickly (under a month)

Hello all. My friend applied for cr1 for his wife at the mumbai, india consulate, but she was refused. They said the marriage looked fraudulent because they didn't have a "proper" marriage. The refusal letter asked for more pictures. They sent those in and now have to wait 2 weeks for a reply. 

 

Please help. If anyone else has had this experience, please let me know how you remedied this situation. What happens if they don't accept your pics the second time around?

what do they mean by "proper marriage" as in registered court marriage or registered temple marriage or??

 

I would say that having the marriage registered in India is one of the most important things so prove marriage, then you can get affidavits as someone has already suggested.

 

Also, if they are married its not too difficult to add spouse in India to the bank accounts, you have to show original marriage certificate and address proof so if that can be done then that also will be a good proof for the marriage as well.

 

I agree though, that just pictures is not the way to show a proper marriage, need some secondary proof as well.

Hi! I am the USC and I was able to add my hubby (Indian citizen) as the beneficiary of my US life insurance policy. Your husband can do the same, it was very easy.

 

Is there any way that if you are calling with cash card but hubby's phone should have records of the call in US maybe you can get that and have the proof from that as well?

Well we live at my Parents house so obviously we don't have any rental proof or legal documents of living together. I came back from Australia on 1st feb and so did she from US. Since then we been living at my parents and got married n such...I only have one account in HDFC bank and will put her name on it too when she returns back next month.

yup everything was approved and visa issued june 18th! Hubby comes to the US on the 28th so 17 more days of waiting!!!

Well my wife is absolutely worth all the pain in the world anyway, :joy: Living in india is not the hard part in our life, cause of the love we get from my family but living on my own in Australia is what I do miss. Anyways, any suggestions on what documents I should be prepared with in advance??? I already got the Australian Police Clearance Certificate.

 

what can I provide as proof of relationship cause we never really email each other, we did talk on facebook and Skype a lot, so giving them messages probably not good idea as they are private conversations anyway. And for all the time we spend together, there wont be anything else then our photographs and documents that show that she is in India.

 

we were living in india and got joint bank accounts (one at IDBI and one at Citibank) that was a really good proof of our bonafide marriage. Also hubby added me to his LIC policy as beneficiary and I added him as beneficiary to my New York Life policy. Also we showed 4 years of joint rental agreement since we were living together in India all that time.

 

we did not submit any calls/emails/chats at all as proof and we had no issues.

 

honestly the bank accounts were the easiest thing to add a spouse, just had to fill a form give a copy of our marriage certificate and my passport. 1 week later it was a joint account.

my hubby is from bhopal and we had to go to the municipal and have a new birth cert issued. had to pay some bribe but it was done in a week. showed his school marksheets and his mum had to go to the hospital where he was born for some record but once these things were submitted they issued him a new birth cert in hindi and english with his name and his parents names.

We also got a checklist yesterday on the DS-260 saying they were waiting for a response to a checklist sent for the I-864 - that was sent weeks ago. Tuesday, I had gotten confirmation that they received the checklist response. So weird. We called NVC and got a not so nice person today who couldn't tell us anything.
