K-1 Fiance(e) Visa Process & ProceduresRead this before you talk to a Lawyer
All -

I know when I started this process and I wanted to hire a lawyer and if you google immigration law then you can find thousands of lawyers or services that will help you compile your packet for $$$$. I just wanted to talk with a lawyer and paid $100 for a consultation. I had no time limit and was able to ask all the questions I wanted to, I never felt rushed. We talked about what would be best for me and my fiancee and at the end of the converstation she said go head and apply for a K-1 Visa and you dont need a lawyer to do that. If you run into problems schedule another consultation because even if you come back here 5 times it will still be cheaper than hiring a lawyer.

So my advice to everyone is if you are seeking legal advice find a lawyer close to you who will do consultations.

This is the one I used and she has offices in many different cities and I HIGHLY recommend talking to her if you have any questions.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa Activation
Hey Guys -

My fiance and I were wondering when the K-1 Visa actually activates (when does the 90 day clock start running)? Is it when she gets the VISA from the consulate or is it when she enters a POE in the US??

I notice that the Germans format their addresses a little differently than we do. So the question is do I put her address as the Germans write it (blahblahblahstr. 9) or do I "Americanize" it (9 blahblahblahstr.) Any advice would be helpful!!

Definately USPS. It's fast, relatively cheap and quite reliable. You can track your mail online too.

Its not a problem because of the PO Box?

K-1 Fiance(e) Visa Process & ProceduresBest way to send the form?
All -

What is the best way to send the form? I have seen some say by certified mail, can certified mail go to a PO Box? Because the address I have for the CSC is a PO Box and I know Fed Ex will not ship there. Any advice and or tips would be helpful as I am sending the forms tommorow.

K-1 Fiance(e) Visa Process & ProceduresI sent the forms but....
All -

I sent in the forms on saturday and I have just read a post that says to use fasteners or paper clips to put the forms together. I just put everything in an envelope (following the Visa Journey guide) and sent them off.

Also, we glued the all our pictures to pieces of paper and wrote a story next to the picture about dates, places, people etc. I know it says to write on the back of the pictures.

Has anyone had experience with this? Will this cause an RFE or a delay in processing times?

Thanks for any advice....

Good luck to all...Its not fun to sit on coals

K-1 Fiance(e) Visa Process & ProceduresIs it normal to be touched quite a few times?

Our case was filed on 1/4. We received the NOA1 on 1/12. Then we also had two "touches" on 1/11 and 1/14. Is it normal to be touched so many times??? Could this be that they are working quicker now?

I filed one day after you and have a similar pattern of touches after receiving the NOA1. I pray that they are moving faster but more than likely they are just moving our files from one pile to another

Hi all -

New to VJ and to this whole process. My fiance is British, but is currently living in Germany. Should he plan on going to the Embassy in London or in Frankfurt?

Thanks for your help!

He should use the embassy in his country of legal residence. If that is Germany than you use the one in Frankfurt

K-1 Fiance(e) Visa Process & ProceduresA newbie just beginning
All -

I am so happy that their is an online community of people who are going through the same process I will be starting in a few short weeks. I just have a couple of newbie questions. I have noticed A LOT of acronyms. Is there a list or a post that I can find somewhere in the forum just to educate my self?

Also, my girl lives in Germany but has to come over here several during the next year for work. Is this going to affect anything in the K-1 filing process? Our employer takes care of her as we work for a major international company but I just wanted to know if anyone had any experience with a fiancee coming to the US during the process?

Thanks again and its nice to meet all of you....

K-1 Fiance(e) Visa Process & ProceduresWhy do the process times at CSC keep going up?
Anyone have any ideas as to why the processing times keep going up? When I started my timeline the date was June 29th 2008 and now its all the way up to July 9th. I just wondered if anyone had any ideas as to this drastic change in dates.

Good luck to all, I wish patience was a virtue that I possessed

K-1 Fiance(e) Visa Process & ProceduresSenators listen to registered voters
To All:

I know that I just joined this website and started the K-1 process a few weeks ago while many of you have been dealing with this process for years but as an online community we can make a change. What I propose is we pick a day and we all call our respective congress people and senators and tell them, as registered voters, we are very concerned about the state of the USCIS’ processing times. I do not claim to be a political organizer or any sort of leader but just a guy who wants to be with the woman he loves. A very wise person just recently told me that “change usually happens from the ground up”. We as an online community have the ability to create a foundation for change. I have been doing research and there are numerous organizations out there that have the same goal as all of us, and I think a massive influx of telephone calls, emails and letters would really get the governments attention. These people are elected by us for us. Let’s tell them how we feel.

I just wanted to throw this idea out there; if I get enough positive responses from people then I will try to formulate a plan to get this message to all interested parties and then move forward. All input and ideas are welcome. Please feel free to PM with any questions or comments.

Respectfully,

Eric

Just for reference here is a letter from numerous groups who are just as concerned as we are about the processing times as the USCIS.

Hi all!

I am preparing to send back packet 3 and Í´m soooo confused now:

The checklist says you need to bring one photo to the interview. Don´t send.
The photo requirement page says you need only one photo and you have to stick it on the DS-156 form which you have to send back.
What to do now????

Many thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresHave you used a Lawyer/Law firm and if so who?
I went and talked to a lawyer before we started the process and I thought she was great. She said our case was pretty simple, neither had been married, no Children involved and she had already been approved for a B-1 Visa a year earlier. I apprecaited the honesty and the fact she said it would be a waste of money to hire a lawyer and I should just do it my self.

It seems like the only reason to hire a lawyer is if the case is tricky. If anyone wants this lawyers name they can PM me.

K-1 Fiance(e) Visa Process & ProceduresPacket 3 Checklist
1. I am 30 years old and have lived at number of different places at different cities with a stay of more then 8 months. I had been at my current residence for a year now(Will that address be sufficient for the police clearance). Or do I still need to collect police clearance certificate from all these different places , which I think will take more then two months. And if yes do I have to go to all these places myself to collect these or the police stations would just send it themselves.
2. My fiance just needs to send me 1040 and W2 for the year 2004 as affidavit of support with other documents as per embassy checklist. Is that okay. Please refer to the checklist text given below.
3. I have filled the Form DS-230 Part 1 in adobe acrobat. Can I just send the print out of this form with my signatures.

The following text is from the checklist in Packet 3 that I received from US Consulate, New Delhi. INDIA
Police Report:"Each applicant aged 16 years and older must submit a police cerificate that includes information regarding the applicant including all arrests, the reason for the arrest(s) and the disposition of such cases. (A) Indian citizens residing in India for six months or more since turning 16 years of age must present Indian police clearance certificates from both their district police station and the local area passport office. Applicants whose passports were issued within six months of the visa interview may present just the passport office certificate. These certificates are valid for one year from the date of issuance."

Affidavit of Support:"Affidavit of Support (I-34), job and bank letter, 1040 and W2 for the year 2004 from the petitioner."

K-1 Fiance(e) Visa Process & Proceduresanyone ever get RFE'd because of a "scan" instead of a "photocopy"

I know it sounds like a silly distinction but I'm wondering if anyone has every got RFE'd for anything because they scanned and printed, for example their passport, vs doing an actual photocopy. I realize they are totally the same, but a photocopy is much sharper usually but in black and while, while my printer and scanner, are good, but medium quality, but in color which makes the passport stamps stand out more. A couple forum searches here seem to indicate it inst a huge problem but they were older posts, so was wondering if this has been a issue with USCIS viewing them any differently lately.

Thoughts? Thanks in advance.

I am yet to hear of an RFE due to a scanned copy. Believe me that is the least of uscis' problems, they look out for more important stuff

K-1 Fiance(e) Visa Process & ProceduresMedical Problems

If you say too much you can buy trouble for yourself... as I found out, being compulsively honest. My medical exam turned into an hour of cross-questioning and then I had to get a letter from my psychiatrist to pass the medical... and then when I was doing my AOS I got a letter from USCIS saying I was required to have a followup medical exam in the US before they'd adjust me!
But in the end it all worked out. I got the visa, came to the US, and got my greencard... I could have saved myself a lot of hassle and worry if I'd brought a statement from my head-shrinker to the initial medical but it never occurred to me that I'd need it.
I don't know if it applies to you, but an accidental overdose does NOT COUNT. I didn't have to tell them in the first place...

If your depression issues have been successfully resolved that's all you need to tell them, but you need a letter from your doctor to back yourself up.

Thank you all again so much , and you would think that if depression was a issue I wouldn't be able to handle this daunting Visa Process. I think that is the test of all of our mental sanity. Life throws us curves and sometime you go with them and sometimes you are strong enough to fight them. I've decided I'm a better person and I will fight them All THE WAY !!!!!!!!!

K-1 Fiance(e) Visa Process & ProceduresMedical Problems

I had issues with self-harm due to situational depression which ultimately ended up with me in the hospital having OD'd. Since that time I have been medication-free and have not self-harmed again. Because of that, I did not mention it on my immigration paperwork and I was approved fine.

Congrats on getting over it :)

Thanks everyone for the info , just want things to go smoothly. It was a long time ago and would just like to put it in the past.
