Just thought I'd share the news to everyone that I found out my fiance is pregnant!!! :dance: . We did try to be careful because I wanted us to enjoy our time just together for the first 2 years before any additions, but hey - i'm still really happy. I also didn't want any complications in the process, specially with her family. Anyway, i've spoken to her family and everyone's okay with the situation and is willing to wait for the K-1 process. Still, I wish I could be with my love and our miracle. :(

Now I know this doesn't grant me any special case to expedite my petition so let's get off that subject. I do have questions though:
- Should I inform CSC of this situation? Should I write a notice/amendment to my petition and mail it? I just want to be sure just in case she has the baby before NOA2 or the interview that they're aware there's 2 people involved now in the petition.
- Should I just wait until she gets her medical exam and they find out she's pregnant? Or send the notification of her pregnancy with her packet 3 documents to Embassy in Manila?
- Is it true they will grant our baby a visa right away when my fiance gets hers? (read it somewhere here) or do I have to apply for that separately?

Thanks for any help and advice.

I went back and forth for months after the intial filing always honest and had the papers at hand to show them I was doing it the right way. Never stopped for more than a couple mins. Just make sure you bring ties back to Canada Rent Lease, bills, work letter stating when you will return and so forth.

I think that, as someone mentioned above, and as it says in the FAQ with the former USCIS worker, some workers will open a box and pull the difficult files and blaze through the rest, then go back to the difficult ones, or work a little here on a hard one, and take a break and do an easy one. My fiance is Irish and ours was only 96 days. We got ours during that big week before Christmas.

You need to right click (ctrl+click on Macs) on the file itself and go to Get Info, not within Adobe. Try checking permissions in the Get Info window, it's near the bottom.

Secondarily, I actually had the problem that nothing would save in preview, so I had to do the whole file over again in Acrobat, which worked/saved fine.

Also you mentioned "converting" the file to Adobe. You shouldn't need to do this, just open your .pdf in Acrobat directly. If you did any sort of converting just try opening the straight-up PDF.

Otherwise, taking into consideration my own experiences with preview, you'll just have to do the file over again in Acrobat. Good luck smile.gif

Re: the doctor - it doesn't matter when it happens. The packet 3 is the official notice to go get it but you don't have to take anything with you or anything like that. So she can go any time. It's ok if she wants to put it off a while since you haven't even sent your petition but I'd suggest as soon as you get your NOA2 she make plans to go. My fiance went today in Cork. Basically you have to go one day to get your blood test and xray, then go back after a few days to get your blood results and whatever shots you need. And don't worry if she doesn't have her shot records, mine doesn't (lost in a fire or something) and the doc is totally cool with working it out from the scars on his arm.

And it's definitely not done at/near the embassy and DEFINITELY NOT right before the interview. I mean there are 2 docs in Dublin, yes, but you NEED to go plenty of time before your interview in case there's a delay with getting your results. I think the best plan is to go ASAP after you get your NOA2.

Also FYI you should start working on your financial affidavit as soon as your send in your petition cause it can take a while, especially if you're going to get a co-sponsor. You'll need your past 2 or 3 tax returns, past pay stubs, a letter from your bank, and in packet 3 they send the 2007 version of the I-134, not the 2010 version. The difference is major, 2007 requires a notary, 2010 doesn't. I filled them both out and had the 2007 version notarized, just to be safe.

The above person is correct, it's no biggie for the I-129F. The ongoing relationship is asking whether you're still dating since you sent in your petition. For your reference, (remember my fiance is Irish too) we sent in 3 photos, plane ticket confirmations, and scans of our passports (I think this is the most important as it's definite proof) and it was approved with no RFEs in 96 days.

For our embassy packet that I sent though, since he visited me while our I-129F was being processed we additionally included his new boarding passes as well, and he sent me a mushy letter specifically for the purpose of this proof, and of course he'll have his passport with him as proof too. Your fiancee should take a complete copy of your I-129F, (we used duplicates of the photos, I wouldn't do photocopies) plus your financial support packet, and more ongoing proof. She'll have to have her medical results and police report at that point too. The police report took about 4 weeks for us so she should go ask for that ASAP. Also the guards sent my fiance on a wild goose chase to get his report so she should expect a lot of blank looks before she finds the person she needs to talk to. She can also go ahead and get her medical at one of the 3 doctors listed, there's no need to wait. One of the embassy reviews has them listed, they're still correct. Tell her to go ahead and get 3 official copies of her long form birth cert. too.

Edit: Forgot to say, we also included a typed/hand signed and dated letter from each of us stating how we met, and another stating our intent to marry. One each from each of us, so four total.

From experience, always use exactly what's written on your birth cert, NOT your passport. My assumption would be your second name is considered your middle name, and if you have 4 names you'd put names 3 and 4 as your last name. Also if you go by something different make sure you put it in the box for other names you might be known by.

Also just because your passport doesn't have your middle name doesn't mean you don't have one. Your given birth cert name is always the one to use.

There's not really much you should do but wait and see unfortunately. If they didn't notice and you notify them it could be a red flag. Better to just wait and see. If it gets approved by the Service Center that's all you need, no one else in the process would look or care. Anyway RFE's usually only take a couple of weeks to resolve and once you send in what they ask for you know it's only a matter of time.

First, the Irish embassy was probably the easiest place I've heard about for interviews. As long as you've actually met and he can show copies of your passport photos to prove you've been to Ireland or he's been to the US you'll be fine. They didn't even glance at our evidence when my fiance went, all they cared about was if I (I'm the USC) made enough money. They asked him a few easy questions about America and how we met and that was it. And as far as your K-1 petition on the US side, as someone else above said, as long as you have sufficient evidence it doesn't matter how long (or not) you've known each other within reason, as long as you've met in the past 2 years.

About your passport photos, the best thing to do is have him go somewhere to get them done. It sounds like you're trying to do them yourselves, which isn't always the best idea. Mine had his done and it was only like 8eu. But anyway our photos showed the tops of our shoulders, yes. There should be a measurement guide in the passport guide that gives a basic outline of a body in a box with a whole bunch of measurements on it, try using that.

The website says these conditions make the 2 year rule applicable:

* The EV's participation in an exchange program was funded by the United States Government, EV's own government, or an international organization.
* The education, training, or skill the EV is pursuing in an exchange program appears on the Exchange Visitor Skills List (1997 Amendment) for EV's country.
* The EV acquired J-1 status on or after January 10, 1977, for the purpose of receiving graduate medical education or training.

If they weren't here under any of those conditions the 2 year rule doesn't apply. If they were, it does. Ask for a waiver, probably not that difficult for Ireland or UK.

I didn't actually answer your question about evidence so here you go -

If you do go the K-1 route, you need several photos of you together, preferably in places recognizable as the US or Ireland so it's obvious you were actually where you said you were and lends more credit to your evidence. Also it really helps to send color copies of your passports, showing you've both made trips to the other country (or his, if only he visited). And I'm not sure if a copy is ok but why take chances, but I sent in an actual birth cert for myself, got it from the health department where I was born. It could also help to include bank or credit card statements of his with purchases in the US highlighted. You can use black marker to block out the important numbers.

Also one more bit of advice, the more organized you can make your application, the better. Use tabbed dividers, punch holes in the top, everything you can think of. This isn't quite as important for the US side, but once it get to the embassy in Dublin I firmly believe it makes a huge difference.

We sent in our application in early Sept. of last year, and even with hiccups he had his visa in hand by the first week of April. That's 8 months. He could have had it by the end of Feb. but he took his time on getting some paperwork together. If you send in your K-1 now you should be fine for May. But as someone else said, you can never be sure until visa is in hand.

Alrighty, We just finished the K-1 process (he's on the flight over as we speak!) and he's Irish, so here's the specific answers for Irish K-1.

1. In America, $455 for petition, plus $1010 for AOS. In Ireland, €317 for medical, €107 (or 105, can't remember) for Visa, €5 in postage, €15 give or take for passport photos, €50 train to Dublin, I can't remember if he paid for his police report, but I think he just took a stamped envelope, no charge. The Irish part is really pretty cheap compared to the American costs.

2. In Dublin, Yes.

3. It would definitely be better, but I think you'd have more of a problem from the USCIS than the Dublin Embassy. You should definitely try to get some. Maybe not quite so much of an issue if you can include color copies of your passports showing one of you has been to the other's country. If neither of you has been to the other (or a mutual country where you met face to face) you can't get a K-1.

4. Roughly 5 or 6.

5. As long as you make $18k+ they could have divorced you as a child and no one would care. If you make less than that you'll need a cosponsor, but even then you could get someone else, a friend or someone else close to you.

As someone else said, if you do enough reading around VJ and the embassy website you'll find all this stuff. It can be confusing, just read as much as possible.

As far as I know (we just went through the medical process... again) you're right, it's just communicable diseases, I don't think they even test for other things, so the leukemia might not even show up for them. In any case, even if it did it's probably fine. They're more worried about what you can bring in to give to other people than an isolated condition.

However, medical insurance is another thing altogether. If he has to have a medical before his insurance and he's denied coverage you would have some massive medical bills ahead for you. Just something to think about.

I'm not sure if this will work in Vegas but when we got married we took in the signed paperwork ourselves right after the wedding, watched the woman enter our info, and then asked for 5 certified copies right then and there. The place you get married at might not be ok with that, so make sure you ask. The court may not take kindly to that either, since they have to process so many. But it's definitely a possibility. I would just make a few phone calls to the appropriate personnel.

The reason you need certified copies is for your AOS from K-1 to permanent resident, amongst other things... so whatever you do don't leave Vegas without those cert. copies IN HAND!

Between NOA2 and your interview you (or your fiance...)will receive a letter with a checklist you have to send back. They won't schedule your interview until they've received it. So the time between can really be as long as you like, within reason. You could go ahead and get your medical and police report to shorten things a bit. The shortest you would have to wait between NOA2 and your interview is about a month. Ours was about 6 weeks, but that was mostly due to a delay on my husband's part.

Regarding an RFE, it's probably a little bit too soon to worry that you're getting one. The RFE and NOA2 basically arrive at the same time, theoretically. Even if you do get an RFE it should only delay you a few weeks.

Remember you're spending a few months apart now but you have the rest of your lives together. Try not to get impatient ;)

We went through the Dublin consulate this time last year. Have a look at my timeline for details. I will note that husband didn't send off packet 3 for a while after he received it, and there was a delay after the interview that normally wouldn't happen because his last name on his birth cert didn't match his passport, so bear that in mind. After my husband sent in his notice they did call within two or three weeks, and the interview was about a week after the phone call. It's possible they're backed up, but it would be with other things, not K-1's. Lottery winners are being processed right now too, and there's always other types of visas and people who don't use VJ. In any case, if they're moving at the same pace as last year you should hear from them any day now, and a late April flight should be fine but cutting it close. That being said, you never know.

Also my husband somehow had a phone number that he called and spoke to a human, but it might have been a direct line after his interview because he had to clear up an issue with his passport.

I'm glad this was asked. My county marriage license application only asks 'Are you a resident of the county?' for purposes of determining if there will be a 3-day waiting period unless a class is taken first.

I was thinking yes because she will be living there at the time but she can't very well be a resident of the county if she's not a resident of the U.S. This should exempt us from the wait. Not that 3-days is a lot, but hey...


I *think* this means do you physically live in the county at the time, different from being a federally classed resident. After all, you don't exactly have to register when you move into a county. We had to answer the same question but it was a single question for both of us, rather than asking once for each of us, so it was easier to answer :P
