IR-1 / CR-1 Spouse Visa Process & ProceduresWill the upcoming holidays slow the NVC process down
It will slightly slow things down as the embassy effectively shuts down for half of December, shouldn't be too bad though. Hopefully you'll get an interview date before then!

Officially the instructions say that if you file in the wrong place it will be rejected. However, I have no actual experience from this so I don't know.

According to the visa journey timeline I-130's are being processed from the end of April so you should probably be getting yours approved son.

IR-1 / CR-1 Spouse Visa Process & ProceduresPrior year Tax Returns
Just print whatever comes up. You effectively signed online when you did then so that should be enough. I would recommend that you get your tax transcripts instead so you know that everything is taken care of. They are free to request from the IRS and provide the official record of your filed taxes.

Print out the directions of the I-864 and show then that it says you need a letter from your employer.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to find a good lawyer?
I did my paperwork myself. There are definitely alot of good resources just on Visa Journey if you look around. Vanessa has a very good thread which although it is for the K-1 AOS it talks about filling out the I-864.
Here

Basically what you might need is:
-Tax returns with W2's and 1099's (or recommended are tax transcripts which are free from the IRS) for this year for both you and your father.
-Returns for the past two years are also optional to send. (If you did not file taxes you will need a letter stating why you didn't, such as you didn't make enough income, etc.)
-Paystubs for the past 6 months for both of you.
-Letters of employment for both of you stating your job and salary and how long you have been working there.
-Proof of citizenship for your father (probably a copy of the passport bio page)
-Bank statements if you are going to be adding your bank accounts into the total.

You can do some more research on Visa Journey and you'll probably find a ton of threads on this topic. Also make sure to read the instructions carefully for the I-864.

Good luck! Posted Image

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to find a good lawyer?

Oh okay! Well he is at the same residence as me.
Will him being a household member and still fill out the I-864A still help my case?

Yep. As a household member you will add him to your Part 5 question 21 of the I-864 as a household member under the option G. Then in 24 B you will put his name and current income. So in 24 C it gets added to your income (if you have anything) and that total is what they look at to see if you meet the poverty guidelines or not.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to find a good lawyer?

I-864, submitted to NVC.

One of my main problems is I was out of work from May 2008-May 2010
Because of this, I am also submitting the I-864A (contract between household member and sponsor) So my father can be a Co-Sponsor.

The I-864A is not for a co-sponsor it is for a household member. If you go this route and are living in the same residence as your father than he will simply be listed under your household and fill out the I-864A. If he is not at your residence then he can be a co-sponsor and fill out a separate I-864 as an additional sponsor.

IR-1 / CR-1 Spouse Visa Process & Procedures2nd RFE.....Are you kidding me????

Just when you think you've heard it all....

My case had been reviewed and I got a RFE because I forgot to send a copy of my husband's passport...According to NVC that was the ONLY thing that was wrong. So, I sent it and they put it on the bottom of the pile of cases to review so at 7 weeks they send me another RFE!!!! This time, it is because of the new ruling requiring a new police record if the previous record was dated prior to June 14th. YES, I was aware we were gonna need to get a new record and provide it at the interview but didn't realize that we would need to have it prior to getting an interview. REALLY????

I don't think that is fair. They already told me the file was good with the one exception....I think they should have advised me that at the interview I will be required to have a new police record but not hold up the process of getting an interview.

My question is....what keeps this from happening again....how many RFE's can one person get??? Is there an expedite I can request due to the length of time and the unfairness of the situation??? Anyone with this or a similar situation??? Multiple RFE's???

HELP!!!

I don't see how it is unfair though. You forgot the copy of your husband's passport, not them......

I do agree it is silly that they didn't bother to do it all at once, it would save everyone time.

If income is sufficient then you don't need to include assets. They are optional.

If you have certain reasons for an expedite than you would qualify but just generally you are not past the processing time and they will most likely just tell you to continue to wait.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is BLANKET WAIVER?
They say blanket waiver because there are shots he does not need. All of the vaccinations listed are required for immigration. However because of his age, the season, etc. the requirement has been waived as it is not medically necessary.

IR-1 / CR-1 Spouse Visa Process & Procedureshaving my teenage children write sworn statements?
I agree with Loto that because they are minors you might not rely totally on their sworn statements as they can't be held legally accountable for them, however it might be nice for you to include something short from them talking about their relationship with their step father. Just don't count on this as one of your main proofs but as an optional addition to your application.

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion !!!!!!!

Come on guys, lighten up! She said that he's been coming a lot; and while some of you are still snickering, I'm sure that she means that he has been visiting her a lot. This I can relate to. I had to account for all of the times that I have visited my fiancee and discovered that in the last 3 years, I have visited her 13 times. If you ask her, she will tell you that I don't come enough. Stop snickering.

Well she originally said:

we married in November 7th las year and have been apart since then :( as most of you :(.

Which to me is the exact opposite of seeing each other.

Loto is correct, however, I am of the belief that more is better to cover your butt. So if you can get it then get it. Your HR department probably has to do a similar kind of letter all the time. You could even do a brief outline for them and just have them sign it if you like.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarriage License AND certificate?
Your marriage cannot be verified until it is sent back to the government office of your jurisdiction. Otherwise there will be no record of it. Therefore you will have to wait until they process your signed copy and then you can get a certified marriage record which is what immigration is looking for.

IR-1 / CR-1 Spouse Visa Process & Procedureswho does it?
You are not allowed to use the VWP to immigrate (such as in your situation, if you were still in the US that would be a different matter), if you answer any question saying that you do not plan on immigrating when questioned by immigration or on any pre flight application and then you do you will be committing visa fraud.

Your bank should do it or you can find a notary to do it. The person who writes the document must be there in person to sign it in front of the notary, that is the whole point of having it notarized. IR-1 / CR-1 Spouse Visa Process & ProceduresSecond Interview at London Embassy

In wellington boots case, his medical reports from Knightsbridge had not arrived at all. Id say all they had to go on, were the civil documents etc, the CO would only have had any previous immigration history info, and the current situation minus the medical results. Its not my place to discuss other members personal circumstances but Id imagine if any medical issue has arisen in the past, regardless of how big or small then it may well need to be discussed with the individual whilst under oath.

But the medical info had been received by the time of interview?

No, Knightsbridge will not send the medical until they have everything they need to make their recommendation. The embassy did not have his medical.
amykathleen2005FemaleEngland2010-11-28 12:15:00
IR-1 / CR-1 Spouse Visa Process & ProceduresSecond Interview at London Embassy

I was told at the medical in Knightbridge - and also on the Embassy line, that medicals are becoming compulsory now prior to the interview. How set in stone this has become I am not sure.
However, wellingtonboot had his medical on the same day as me, virtually at the same time, and this was a matter of days before his initial interview at the embassy.
I was also told at the medical that they can take 4 or 5 days for the results to arrive at the Embassy. His results had not arrived with the CO upon him attending the interview.

*I was also sent my interview appointment letter and it informed me that I would have needed to complete my medical prior to the interview at the Consulate.

I can be corrected, but I believe at the Immigrant Visa interview, you have to sign form(s) in front of the CO, Swear an Oath upon approval (or even denial, not sure), obviously you cant do this in front of a CO if you are sending documents via courier.

My husband had his medical completed but needed additional information from his GP about his medical in order to be approved. His GP sent the info to Knightsbridge who sent it on to the embassy. All my husband had to do was send his passport down, he didn't have to come again.

IR-1 / CR-1 Spouse Visa Process & ProceduresSecond Interview at London Embassy

Ive got a hunch that - as they couldnt give a definite approval because wellingtonboots medical report / results - whatever the correct terms are , hadnt arrived, this will be I THINK - kind of a whole new interview - but more catching up with the medical reports, if that makes sense. I would say with the reports that the embassy will get - he SHOULD be given an approval.

Yes, taking the passport down is standard for ID to get in, BUT I really dont think they would get him to go down AGAIN, just for a denial. They will be aware of his immigration history - so if for any reason he was inadmissable - I would say they'd have denied him on the spot. As they were just waiting for medical reports to come back - once they show clear - i think he will get the all clear and the CR1

A) these are just my thoughts.
B)I HOPE IM RIGHT

But lots of people don't have their medical things all done by the time of the interview, they aren't asked to come down again, the just send their passport down later and it is sent back with the visa via courier, no need for a new interview.
