You cannot go the K3 route, it is obsolete. You can apply for the visa wherever in the world you are legally living. Just put down whatever consulate you want your interview to be at. I don't know if Canada does DCF, but she would have to prove residency in Canada for a certain period prior to you filing to qualify if DCF was available.

Surely you can figure out how to prevent this issue. The US does not expedite for bad planning in this case.

In order to do DCF you need to live in the country for 6 months or more. So you can't just send it to a different place. You'll have to send it to the US.

Wow you really scared me with this information! I really hope we have better luck then the ones you know who had these issues because at this point we have no choice but to fly Iberia airlines and through Madrid. These were the only options left for us.

I totally agree Iberia Airlines is the armpit of the airline industry and believe me I will NEVER deal with them again after this trip is over. We will be praying that Allah will bless us and protect us on this trip because Iberia is telling us that they will refund the money for our tickets that we booked the flight they cancelled on us BUT they plan on keeping 500.00 DH for EACH ticket!!!! We cant continue our journey with that much missing from our funds so we are being forced basically at gunpoint by Iberia to use their airline!!! NEVER have I ever been treated this badly by ANY company but you live and you learn which I definately have!

So we have no choice you see. We will have to take our chances.

Not true, in the state I live in no insurance company can deny insurance for pre-existing conditions. I know this to be fact because I have 2 auto immune diseases, diagnosed 5 years ago, I just had to buy an individual plan for myself about a 7 months ago. I shopped around, and each company I spoke to said that I cannot be denied coverage under any circumstances for something pre-existing. The plan I got was through Anthem Blue Cross, the rate is very reasonable, low co-payments and low deductible I haven't been denied any treatment whatsoever, and I need chemotherapy infusions that cost over 10k for each infusion, I need 2 of them once ever 6 months(40k+ a year). Not to mention my monthly visits to my Rheumatologist once a month and physical therapy twice a week, blood work monthly, countless xrays. bone scans, CT scans, you name it. You are lucky to live in such a state. However, the link you have is referring to the Health Care reform act which will not be in place for all states for preexisting conditions until 2014.

That statement is completely un-true, Blue Cross and Blue Shield have many policies that have no-pre-existing clauses. The policy can be underwritten without a pre-existing clause. Some states doesn't even allow Insurance companies to write policies with a pre-existing clause.


Most people on this board makes statemets based on the states that they live in, there are 52 states many terrioties that have different states laws regarding how a Insurance policy can be admistered.


Again, all I can find is that it will cover a preexisting condition only after a waiting period of one year. That isn't coverage to me. What states are you referring to. Please send a link.

There are many policies that covers pre-existing conditions. You can elect to have a basic policy that covers medical conditions, with a 5,000 per deductible per family. It does not have to be the top of the line policy. You are confusing your responsiblities as co-sponsor, yes the government can sue you after the fact, but the government is asking for this as a pre-condition to allowing your husband to enter the country.


If you have diabetes it is almost impossible to get individual insurance, if he can get it will exclude the preexisting condition and be very expensive. Remember, the immigrant will not have previous US coverage and therefore everything is a preexisting condition. It isn't as though he is just switching from one policy to another while in the US already.

Once again, VWP countries typically have no issues visiting.
My husband has visited me several times.

I would argue that the poverty guidelines have already been published federally. USCIS does not make up these guidelines they simply use them, and just have not yet posted the new ones on their site. The new 2013 numbers are applicable as soon as they are determined and published by the federal register.

Now if your income is not sufficient, then you can use assets:

The waiver is for someone who has accumulated unlawful presence in the US. Previously this person would have had to go to their home country for the interview. They would be denied and have to file a waiver while waiting in their home country for it to be approved. This new policy allows the immigrant to apply for the waiver before they are denied. Meaning once they go to the interview they will be approved and not have to spend any more time out of the country.

Not filing married would be considered tax fraud and could come with a prison sentence. Also how are you going to use taxes from a year you are married to show that you can be a sponsor and have it say single when the whole point of the interview is to show you have a genuine marriage? It seems counterintuitive and screams fraud.

You have been told where the guides are, what is in them and how to use them. The instructions are printed very clearly with the accompanying forms. Take your time. Actually look at them. Just like the ACT, you can't just read just the first and last sentence of the passage and then hope to answer the questions correctly. I have always said that the process is easy enough to do yourself if you are literate. If not you may want to fix that problem before tackling immigration head on. It won't go well.



However, bottom line. You are not 18, you cannot sign a legal contract with the US government. You will need to wait.

I have an upcoming interview (hasn't been scheduled yet) and I'm very worried I will be put in administrative processing due to a previous overstay (which was not entirely my fault) yet they will not see it that way.

I overstayed a few years ago when I was 20 due to being married to a US citizen who kept promising to file my AOS but never did. I had no option but to leave after he told me ICE were looking for me (I'm not sure if this is true or not). After I left the US I was barred for 3 years. If you are an abused spouse of a citizen you are supposed to be exempt from the bar but although he did mistreat me (which I can't prove) he was not physically abusive.

While I was barred (but before I knew I was barred) I applied for a visitors visa which was denied and they told me at the interview I was barred temporarily due to unlawful presence.

Some time after that I annulled the marriage based on his poor moral character and lies/fraud. A couple of years later I met my current husband and he has filed for my CR1 visa but I'm so worried about getting the 221 (g) slip due to the overstay and visa denial. I am going to be honest with them about everything at the interview but I still don't know whats going to happen and I'm extremely worried about not being believed. I know if you've ever had a visa denial they think you are just trying to get an immigrant visa to get to the US and not because you are in love.

Please help!


A visitor visa denial in itself is not a problem. If the ban is over there shouldn't be a problem them as long as there was no misrepresentation on your part.

And finally, I'm frustrated with USCIS because there is absolutely no guidance on what DOES qualify for expedition, or how to assemble a compelling case for it, unless you're a service member. "Extreme emergent or humanitarian situation" has no qualifiers or examples, or guidelines on what to do when applying. I didn't think I qualified for expedition in the first case, which is why I went to my Senator's office, because I assumed the case worker there could speak with someone at USCIS for roughly 5 minutes and get a straight answer.

That's the end of the rant. I guess now I ask for advice? I'm going to call my Senator's office on Monday and express my extreme dissatisfaction with them, and then I want to call USCIS and find out exactly what happened to my wife's case. Do any of you have any better ideas? All I wanted to do was sit down with a case worker and see what they thought. I figured, since they do this sort of thing so often, they might have a good idea of what I should do. I now have 2 denied requests for expedition on my wife's case. I can't help but think someone in USCIS is going to look at my case and think I'm some kind of maniac.

This is terrible that the USCIS process is so unaccountable that people can feel that they may jeopardize their case by asking necessary questions.

Our case was put on quickly but as of now it says we are still waiting for approval although we got our NOA2 in September. So the site certainly is not a real indication of anything.
