In my case when I adjusted my status from a K1 Visa (I know this is different to your CR1/IR1 Visa) but I had my wife fill out a I-864 and my co-sponsors (her parents) filled out a I-864A. I think that you would need the I-864A for your co-sponsors also, but I am not 100% sure. Sorry if I have added to your confusion.


You cannot file an I864A unless you live in the same house.

No matter what your wife is still your sponsor. She fills out the I-864 putting in her info. Your sister in law then files another I-864 as joint sponsor. She will need letter of employment, tax transcripts, and pay stubs.

No I think that the CR1 is more likely to be denied. But only by a smidgen. Either should work out fine for you if you have a genuine relationship.

Oh ok. That makes total sense. I thought the paperwork was different. So I'm thinking if it takes the year to obtain the visa like I've read on the forum that we'll apply for it a year after marriage. It seems like it would be harder for them to deny a CR-1/IR-1 rather than a K-1, seeing that we would actually be married. Or would that be an incorrect observation? Thanks a lot. You've helped a ton.


Personally I think they are about the same. However, I think some may argue the spousal is more critical because you are getting a greencard out of it right away so there is not the level of safeguard for frausters as the K1 has with AOS.

Not absolutely positive so hopefully someone will correct me if I am wrong. But I am pretty sure that the day you are issued the visa. Meaning after the interview and you are totally approved .That is when they determine if you have been married two years or not to give you a 2 year or a 10 year. CR1 and IR1 are the same paperwork, it is just the length you have been married. They will determine which category you fit into when they give the visa.

Well I believe it is from the date you get the visa. So if yours takes awhile you might end up with a 10 year card depending on how long you've been married now.

See can visit during processing, but she must answer honestly to the immigration officers regarding everything, especially that she is going to visit her husband, if asked. They may not allow her to enter, but they also let many people enter to visit, so it is up to you to prove she is not planning on immigrating until she has the CR1

For a marriage visa joint accounts, trips to see each other, any types of beneficiary of one another would help. For the K-1 pictures, trips together, letters to each other, phone records would be appropriate.

For AOS and ROC you would need joint accounts, joint bills, birth certificates of children, joint taxes, trips together, pictures together, beneficiaries on life insurance or retirement, joint credit cards, leases/deeds and affidavits.

Wow, that's comforting. So basically the only way to avoid all of the additional rounds of paperwork is to be married for two years and one day, and then apply for the green card? If that's the case, then it seems to me that there really is no difference in the amount of paper work when comparing the K-1 to the CR-1, given the need to adjust status with the former and remove conditions with the latter. So frustrating. Thank you very much.


Well with a K-1 you need to do it twice though. You get the visa, marry, file AOS, wait 2 years and file ROC. For CR1 you get the greencard and visa together, wait two years and file for ROC. And yes, as you said if you are married for longer then two years they would put you as an IR1 which means you get the visa and 10 year green card and not have to file anything unless you want citizenship(which can be added as another step to the other processes as well).

Removal of conditions is essentially another AOS two years later. Same questions, same evidence (although they expect more after two years of being together).

So the least amount of money spent would be to get married now so you can file IR1 in two years or more after marriage. She enters with a a 10 year greencard and she's done. No more adjustments or removals of conditions.

Even though I haven't gotten my NOA2 yet, I'm trying to be proactive with these AOS papers so that when USCIS does approve my husband's paperwork, we'll be ready. Here's the thing:

I'm 21 years old. I've been with my husband for 4.5 years, married for 1.5. We met when I was an exchange student in high school, and as soon as I graduated from high school, I moved to Ecuador to go to school and be with him. I've never had an official job, so I've never filed taxes. My mom is going to be my joint sponsor, and I thought I understood the process, until browsing around the forums and reading others' experiences and getting waaaay confused.
I, as the petitioner, have to file an i-864 (correct?). How should I do it? Just go through and put zero income, etc etc? And should my Mom (who lives stateside) file an i-864, too, or an i-864a? Also, I read somewhere that I have to write a letter explaining why I have zero income, no tax receipts, etc - what should that letter look like (length, format, etc)?
Oh, and - do I have to provide some sort of proof that my Mom is related to me (my birth certificate or something), or does that not matter?

I'm really nervous that I'm going to do something wrong, or omit some sort of important part, and get another RFE ): thanks for any info you can give me!


You both do I-864, (you cannot do I-864a because you are not in the same househoold). She needs proof of citizenship, tax transcripts, employee letters and paystubs. You just write $0 on yours and a brief letter stating you were a student with no income.

Well I'm finally posting in this group. For those that don't know my story after finishing a 200 day journey of K-1 visa, it was sent back to the NVC (only to expire and be lost forever) for "lack of bona fide evidence..IN other words Bull====!!!!. Anyway we regrouped quickly, got married in Nov.. Hurray us!! , because we didn't want our plans to be totally ruined,our orginal Wedding date was set for Dec. in the USA. So now I am finishing our new file and I have some questions... It asks two questions. Has your relative ever been under any immigration proceedings? (Would that incude his K -1 interview? and if soo what is my answer because the choices are Removal, deportation/excusion,recission, and judicial proceedings) then it asks have I ever filed a petion for this relative before, I checked yes because of the K-1 visa, that is correct right???
Finally, unlike the k-1 visa it doesn't have a space for "tell us how you meet". Many have told me to write a cover letter introducing my husband and I,and give a time line of our relationship. I have ask some should I include the K-1 process,if so how much detail, if not what do I say exactly??? Thanks for the help, and good to be back. :wacko:

You cannot go the K3 route, it is obsolete. You can apply for the visa wherever in the world you are legally living. Just put down whatever consulate you want your interview to be at. I don't know if Canada does DCF, but she would have to prove residency in Canada for a certain period prior to you filing to qualify if DCF was available.
