I'm so thankful that my Sam speaks English very fluently. Occasionally he'll slip on the grammar but I correct him instantly. He also corrects my spelling mistakes so we're a good team. wink.gif We have gotten into arguments in the past where I said something and he interpreted it the wrong way or he said something and I interpreted it the wrong way but we always worked it out. I can't wait to learn Hindi when he comes here. Then we can shout romantic expressions across the apt and the neighbors will have no clue what we are saying. wink.gif

Get a white piece of paper and stable a baggie to that page, on the front of the baggie, put a caption like "Picture of so and so" and seal it. Put the passport photo behind the 4 pages for each person and have tabs on the bottom, that's what I did.

It seems rather redundant to include a marriage certificate when the divorce papers from the previous marriage are being submitted as well. The divorce papers proves there was a marriage hence prompting the name change. Is the marriage certificate really needed?

If the previous marriage of the US Citizen and/or foreign fiance(e) ended due to the death of their spouse then include a Copy of Death Certificate(s) documenting that fact.
13. Proof of Legal Name Change if either the US Citizen and/or foreign fiance(e) is using a name other than that shown on the relevant documents. You must give USCIS copies of the legal documents that made the change, such as a marriage certificate, adoption decree or court order.

Hi guys!

This past weekend I went to Staples to buy some supplies for assembling my case file! I can't believe we are finally at this point. This is what I'm doing let me know what you think.

Case file folder with two dividers - 6 sections with metal thingies on top with two hole punch.

1st section - paper clip check to top, cover letter, I129F - Appl, I129F question 18A explanation
2nd section - G-325A - me, passport photo me (stapled baggie to white sheet of paper, labeled baggie, can open the baggie if they so desire to remove the photo) G-325A-Fiance, passport photo Fiance
3rd section - certified copy of my birth certificate, former marriage certicate certified copy showing my name change, former marriage divorce decree and separation agreement - It's only 10 pages so I'm gonna include it all just in case)
4th section - Letter of intent to marry - me, letter of intent to marry - Fiance
5th section - Primary evidence - itinerary trip 1, itinerary trip 2, passport stamps, boarding passes,baggage claim, receipts from purchases there (I do not have hotel bills or bank statements as I only used cash)
6th section - Secondary evidence - about 10 photos - maybe in a ziplog back or a clear plastic sheet?, e-mails (not sure how many to include yet), letters from fiance - maybe one or two, phone logs (not sure how many to include yet)

Will put sticky tabs on the bottom of the docs for easy reference. I hope it's ok to put them on the certified copies and won't harm them?

whew! Am I missing anything? Anways, our goal is to send this off by Sept 15th, wish us luck! whistling.gif

Only the USC birth certificate is required (yours). Your fiancee will take her birth certificate (not copy) to the interveiw.

Interestingly, my attorney asked me to include my fiancee's birth certificate with my I129f. When I questioned her and asked why and who and how it needed to be translated it resulted in her saying "We generally include it to precent a RFE". When I pushed further saying that it is not even required at this point in the process I was told "We have filed hundreds of these, it's best if you include it".

Well, I didnt provide it. And, as of yet, I haven't been RFE'd. Then again, I dont have my NOA2 yet either, so the jury is still out.

Well, I got rid of her today. It turned into a big argument and I proved her wrong on every point so it was kind of fun actually...

NOW, Im nervous about everything that we need to do before the interview, but Im sure with the help from VJ we'll be ok.

(Silly lady was telling me I still have many months to wait because they are only processing applictions from Jan 13th. When I said, thats funny because I was notified this morning of my approval. There was dead silence on the phone until she found something else to complain about!)

Uggg, then I am not sure, since she is the one that seems to be the primary contact and even has your initial receipt. Did you already pay set fees in advance or is she charging you each step of the way? You may have to contact her and get her in person to talk about your dissatisfaction, but tossing her out may be more trouble than it is worth.

If you run into a problem like a RFE, which is what hiring an attorney is supposed to minimize you have a good reason to dump her, but if the NOA2 clears and you're SO can just go get the Visa, then may as well not rock the boat.

It's one reason I read this site and others and decided to do it on my own. I didn't believe paying someone else money would ensure a competent lawyer and even if I got a good one I know their own interest in my case wouldn't be higher than my own interest, so I just did it on my own. If I run into big problems or feel I am being messed with for no good reason I may consider an attorney, but so far it has been easy with resources such as this site.


I felt fully confident in doing everything ourselves, but my girl insisted on a lawyer. With all the knowledge on this site, you really don't need one. But having that extra set of eyes could be a time (life) saver. I did get the attorney to split the cost 50% at start and 50% after the visa is issued and Im really not worried about the money part, it's just the whole lack of communication thing. I understand that a K1 fee isnt like a 'normal' case for a lawyer but she should still have time for me or at least say "You are going beyond the normal scope of what I charge, here is what we can do....".

Sounds like a bad deal. No ramifications really. Just call her up and tell her she is fired and you will be finding a competent attorney or handle the rest of the process yourself.

You may want to hold off and check if the attorney was the one to fill out and sign the I129F as the preparer. In that case I'm not sure if it matters, but you would need to check that out first.

Ok, I've searched and read but haven't found what I'm looking for. Maybe I did but I am too blurry eyed to see it....

We received our NOA2. Is it possible to go ahead and prepare all of the Packet 3 paperwork and once the Counsel in Brasil receives the I-129f package, have my fiancee go to the counsel and drop off the already completed Packet 3 without waiting for them to send it out? This seems that it would cut out about a month of waiting time...

My attorney wanted $1500 for start to finish (stopping at the K1 visa issue). I only did it for the comfort knowing that someone more experienced was handling my case. BIG mistake!

Do it yourself. LIVE on VJ for a week or so and read everything you can, read the guides, and ask questions and you'll be fine. :)

Ugh.

My (former) attorney submitted our I-129f (which has been approved 8/10/07)) with incorrect contact information for my fiancee (street address is an old address and telephone number is also out of date) and my address and phone number is also out of date. She basically put old information in and not the current information. :(

Since the paperwork is probably still have NVC, I'm not sure what to do...

Try and fix it there or ride it out until it gets to Brasil? If so, how would I go about fixing it???

This attorney has screwed up so many things, I'm amazed we got approved at all!

(On a funny side note, I'm divorced, on her cover letter she listed the contents of the packet and listed "1 - Divorce Degree". Ummm I have a degree in Computer Science, not divorces....)

Last year I moved to Brazil to spend time with my fiancee before we starting the K1 process. While that was a good "meet within 2 years" bullet point, I shot myself in the foot because I am now $1000 shy of the min poverty guideline for last year sad.gif (Normally I make approx 50k a year)

Anyway... I have the last 5 years of Tax returns and W2s. Hopefully, they will let that $1000 slide. My father (retired) agreed to cosponsor as a "Plan B" if they want to be picky about the $1000. What will I need from him? I-134 and supporting docs or are there any special cosponsor forums he needs to do? I searched but really didn't fine a "what is needed for cosponsor thread"...

I just happened to see a post about Tax Transcripts. I had never heard of this and I started to freak out!

My fiancee is coming from Rio de Janeiro. Looking at the RJ Site http://www.embaixada...amp;itemmenu=58 and reading the Application instructions, they state;

You may present your own means of support or the petitioner may fill out an Affidavit of Support, form I-134. The sponsor must attach proof of his/her income such as: copy of last U.S. Federal Income Tax (form 1040), proof of current employment, job offer, pay-slip, etc.

Nothing is mentioned about transcripts...

Do I still need to obtain one (or more) transcripts???
