Its an option. You just would have to file it and then she would go home and you would wait the 6 months or so to process it before she can come back and you can get married.

I certainly would have him visit on a tourist visa to make sure he is comfortable moving to America as well as give you the chance to get to know him better. As you said, if you are not comfortable getting married in the 90 days then that visa is not the one for you. The visa is only for this who already to get married and is not really supposed to be for a "getting to know you" kind of thing.

I don't know really where you would be able to have a student visa come into play unless he was already planning on being a student this year. It seems to be a little late to apply for university now as it is already the end of August and school is starting and it takes time to get that kind of visa.

He has saved 3000 American dollars and I have saved 11000 Canadian dollars and plan to live in a small studio ($400-$700). Maybe he can get affordable housing off campus to where he is accepted? We both met in person and the magic started from there. We see each other occasionally, but since he is transferring...we would be further apart. We waited to long to ...wait again, so now seems like a perfect chance to progress in our life. I will wait this year out and continue to work until we can come up with a solid plan. He is a good man and we both want things to work out smoothly. Is it possibly to do this under 1 year? If we cannot get married, can I work in the US full time and/or go to school particularly community college.

This process seems overwhelming and we just want to be happy.
Can you please help? How shall we approach this?

Ok first of all the financial aid will only be affected if it is need based. If they are academic scholarships, there is no difference. But getting married changes your status, either from dependent to independent or just adding another person. So if he is a dependent of his parents that would force him to become an independent filer. I would check with the financial aid department of the school. They might even be able to give you a quote as to how the aid might change and what they would offer.

You can work legally in the US but it would have to be under some type of visa. So either in as a temporary worker or as a K-1 or K-3. But all of those processes take time, lots of time. By the time you could work under a visa where you are getting married I would guess it would be around a year from the time you start the process.

So you could go to a college in Canada and then study abroad for a year at a school near to him, but that seems like it might be drastic if you have not already started the degree.

Just from the way I see it, I would wait until he has graduated with his Bachelor's degree. Then getting married will not effect financial aid and you have time to figure out your plans.

Well it is registered when it arrives, but it is only really looked at around 90 days after it arrives. I don't know how they would treat that situation.....

You're right. I apologize. I do genuinely appreciate the help from all of you. I'm just very confused & frustrated by the mixed answers. Not even the USCIS reps could give a straight answer. sad.gif I plan to call again tomorrow & hopefully get someone who can help this time. If I send in the parental consent with the petition and it is denied, I'm scared of having to start the whole process over. You both have to include a letter stating that you are able to marry and intend to marry. If, when you send in the petition, you are not able to marry (meaning legally of age in your state) then that is against the requirements and your petition will be denied. You need to wait until you are of legal age to marry in your state to mail in your petition. Then you wait the normal process and the beneficiary can come over. Sri, but regs are the regs. Take the time to build your relationship.



It is legal to get married in Wisconsin under the age of 18 with parental consent. If I send the parental consent (which I COULD easily get if needed) along with the petition, then it should be legal, shouldn't it?

Ok guys, here is my update and I wanted your opinion and advice! My D will be final next week (around June 20th ish) I am toying with the idea of having Sam come here for a visit in August from India. He has never been here before and I think it would be a good introduction to the U.S. before he comes here permantely after everything is approved via K-1. It will also establish more evidence for our relationship for the K-1.

Here's my dilema, my new place is under construction and it won't be ready till late July ish. When should I start filing for the K-1 Visa? I already have my new address but haven't moved in yet obviously but want to make sure I get my mail hehe. Is it ok to apply for a K-1 visa at the same time of a B-2 visa? I know for the B-2 visa I have to fill out an I-134. A few of you mentioned tax returns for support but my tax returns were filed jointly with my ex. Is that going to be a problem? Does Sam need to get shots for a B-2 visa? What should Sam put down for his reason of visit? Visiting, friend, girlfriend, fiancee?

Please help, I'm a little ball of stress right now lol - all I want is to see my man. :unsure:

You'll need evidence of the divorce with the I-129F submittal. Photos are good, but largely irrelevant. And sorry, but I'm not clear why exactly you "... have to file the I-129F within the next two weeks." You can file the I-129F at any time. Right?

Ok guys,

I have a question. :unsure: First of all, Part one is official, the dissolution of marriage in the state of Ohio was approved on June 20th! :dance: I got 4 certified copies that day (just in case lol) and to my horror and shock I was confused.

The first two pages consist of the decree of dissolution of marriage. On the second page is where the judge would sign (in this case it's a stamp for them) and a stamp saying this is a certified copy with the clerks signature. Both pages also have a raised seal. The space for my ex's attorney, his siggie and my siggie are blank. Is this ok? Can I send in a copy like this with my I-129F packet? Was I supposed to get a certified copy of the original paperwork that we signed or what? ::Scratches her head::

Also attached is the 10 page separation agreement which I'm assuming doesn't need to be included in my packet.

Please help! lol. Should my ex and I sign the certified copies (without the attorney's siggie?) Would I get an RFE for no siggies?

I don't want to buy the printer just for that, but wanted to find out how critical this is for rme to worry and do something about it.

1. If you see a + sign that means you ran out of room and need to condense the info down until the + goes away. You won't get an RFE as long as you can see everything in that box that you should see if that makes sense.

2. You don't have to have a date on the front of the pic, it can be a date on the back, handwritten. That's what I'm doing as well as labeling who's who in the pics.

When we make copies of our passport for the primary evidence section of our K-1 petition packet do we photocopy just the identification page, passport stamp page and visa page or do we need to send in photo copies of all pages of our passport including blank pages? Hi there. I don't think the US elections will slow down the case processes. The only thing that comes to mind that would slow down the processing is if there was a major natural disaster near the service centers or a major terrorist attack on the U.S. Let's pray that never happens.

I used UPS to the alternative address for private couriers. It was pricey but it was convenient for me as I could send it directly from work rather than making a trip to the post office.
