A fiance visa is for a fiance, not a wife. If your marriage it is recognized in Mexico then it is recognized here. You are married no matter where you go. It would be a very bad idea to get a divorce and then try to get married again with a K-1 because it would show that all she wants is to get into the US. Continue with the I-130, go with her to the interview later so you know she is safe.

The fiance visa as entitled is not a visa to visit to see if things might work out. It is for people who are seriously planning a wedding. Please do not waste the time of USCIS for such a purpose. Is it possible that your fiance could get a tourist visa? As I have heard if is very difficult to get a waiver for the 2 year rule , almost impossible.

You will need your co sponsor's information at the interview which is at the last stage before receiving the visa.

I've never heard of them sending a letter but I have heard that if your NOA2 expires before the interview they might ask for a notarized letter from the US citizen reaffirming their support of the petition. Maybe this is just a new policy for all expiring NOA2's? I won't worry about it, just send what is asked for. Possibly the embassy received some part of the petition originally and the old exp dates were in their records.

Administrative processing basically means that your application is undergoing some kinds of background and other checks. This can take an unlimited amount of time. Unfortunately it seems to happen alot to visa applicants from the Middle East. You might get a more appropriate response to your particular case on the Middle East regional board found on this site.

You aren't the only one applying for a visa in London. They have hundreds of appointments to schedule everyday which means your appointment will not be for more or less another 3 months. That's the way it works. You can call the Dept. of State and inquire when you might expect an appointment although I doubt they would give you a straight answer.


Just to clarify I didn't mean another 3 months on top of what you have already waited, just as a total. You will probably hear from them very soon.

I am not positive but this sounds like it would be a NOID or a NOIR. They are telling you that they denied you original petition and they won't do anything with the second until you address their concerns. Hopefully you will get an answer as to why it was denied.

1. No, you didn't even make it into their system with the K-1 because you were rejected. No effect.
2. About the same as a K-1 really, maybe just a month or two difference.
3. You will need someone to serve as a cosponsor if you cannot meet the income guidelines.

Either K-1 or Cr-1 would be good. CR-1 is cheaper and you can work right away which is convenient. K-1 is a little faster and initially cheaper, but you will have to adjust your status afterwards which is another expense and takes time. It really just depends if you would prefer to be separated before or after you are married. K-3 really is not an option anymore for filing.

Appy as soon as you can. Do not wait. She should have told you to file for extension to stay here. Did you do I 129 for financee visa? if so, and married in 90 days you can stay. Anyway, now you married in US and should apply to remain here while they process your I 130

They came in on VWP, no visa at all. They are not staying here at the moment so no need to extend their stay, and they are already married. CR-1 is a fine and legal way to go about the process and they are doing it just fine.

You do not need to send chat logs, email messages or phone call evidence when sending the initial K1 application. You would need them for the actual interview later on, but you don't need to stress over that now (I did not send any and my petition was approved). smile.gif


I have heard of SOME people who the adjudicator wanted more proof of a relationship. I think it just depends on who you get and how picky they are. If you want to be safe you could send a small selection over a time period and save the rest for the interview.

Your co-sponsor does not have to be a relation at all. It can be anyone with the monetary means willing to sign for you. I don't know what the embassy was talking about.

I am confused why you want a government agency to see in "different shades of color" there are rules for reason, to make as much as possible that everyone is treated fairly (which I know doesn't always happen), if they didn't adhere to the rules there would be no point in the petition at all....they would just welcome you at the POE with open arms after hearing your admittedly sad story.

My suggestion is to either go and get married to her and do the K-3 petition or go live with her.

I am not certain, but I believe the visa process that is referred to in that quote is the visitor's visa itself. So once you submit your K-1, the process of getting a visitor visa may be longer. But as you are from the UK you are on the Visa Waiver Program and don't need one (except that bit of paperwork a couple days before your flight).

That's just my interpretation. I could be wrong.

I'm sorry if that offends your sensibilities but I will explain. I married philipina number one and now have a 6yo son whom I have custody of. Filipina #2 was a lovely girl from cebu and after we had gone as far as the Embassy and received a request for more information, I returned home and collected what had been asked for but when I went looking for her to give her what she needed to give to the Embassy I couldnt find her. I eventually did track her down, on the beech in Puerto Galera with a guy from the Netherlands. Once again it didnt matter how far I had gone through the process, cheating is cheating so I cancelled the process.

The woman I am currently with I have known for years butonly realized recently that the girl I have been looing for was right under my nose the whole time. Kinda disneyish I think.

I think it does apply because it would determine if you are eligible for a waiver if you have had a waiver before. You were unclear in your first post if you had petitioned for all 3 and I wanted clarification.

It sounds like you a bit touchy about the matter. And if you can't handle someone who is trying to help you asking questions about your relationships, good luck with the embassy.

Its an option. You just would have to file it and then she would go home and you would wait the 6 months or so to process it before she can come back and you can get married.
