Hello my fiance's income is based on social security disability (income contribution) and he was getting around $12,600.00 (net) and on his part time job which is around $3,600.00 so a total of $16,200.00 ANNUAL INCOME last year and presently . Is that sufficient enough for him to meet the target income of 125% poverty line ? Coz I was thinking that a petitioner which is on disability income has a lower chances of Visa being approved. With that figures please help me if that will suffice the allowable income. He cannot have a full time job coz he's on disability that's why he only takes part time job. Please help if these incomes he has right now will pass the the requirement. Thank you very much.......HOPE YOU CAN HELP ME ON THIS ONE...


No that is not enough. He will need around $18,000 to qualify. However, assets or a cosponsor may be used to fufill the requirement.

If you come in on a K-1 the shots must be done before you file for AOS. So you can get them done in India if you like or you can have them done once you come over to the US but you need to complete them and have them transcribed by a civil surgeon in order to apply for AOS.

The I-134 is not a legally binding affidavit, it is used for non-immigrant visa's. Up until you marry (and subsequently file for Adjustment of status) the non-USC fiance will hold a non-immigrant visa. This allows them to get into the US before having a legal relationship with the USC fiance. The I-134 will need to be filled out by a qualified sponsor (the USC if he/she doesn't earn enough $ then also a co-sponsor) This form will need to be notarized. This does not get sent with the I-129F application. This is only submitted to the Embassy during the interview. Each Embassy will have information on this and will send it to you soon after your approved I-129F is forwarded to them.

The I-864 is a legally binding contract that the sponsor will be financially responsible for the immigrant in the event the immigrant attempts to benefit from certain federal aid programs. This form is filed at the Adjusment of Status part of the journey (after the Non-USC has travelled to the States and you two get married). I believe the new forms do not need to be notarized (check this) as they are already legally binding.


The I-134 does not need to be notarized, at least for the London embassy.

I-134 for K-1. When you eventually get to AOS you need the I-864. And for someone to use the I-864A to help you meet the requirements they need to be a household member. They would fill out a separate I-864 as a co sponsor who does not live with you, just FYI.

You will probably not have word about an interview until December or so. For the NOA2 approval it takes about 3 months and then your application is sent to the National Visa Center which sends it on to London. Once London gets it they send paperwork for your fiance to fill out and after that is sent back you are put in the queue for an interview.

However, if you are deployed you could possibly qualify for an expedite.

Well, it's just my opinion, but I think if it's sent from Australia, they're going to look at it as being filed by you. That's just my opinion and maybe I'm more paranoid than necessary. I just wouldn't want something as simple as sending it from Australia rather than the US, or having my signature instead of my fiances, be the reason I either get denied or have a bigger hassle getting accepted.


Our petition was sent from Scarborough, UK (we went to the post office together when I was visiting) and we had no problems, it doesn't matter where the petition is mailed from.

Calm down everyone. The cover letter for all intends and purposes doesn't matter. It is just a table of contents really. Have your dog paw print it for all USCIS cares. As long as you have the forms which are required signed by the appropriate person then it will be fine.

The embassy should extend the validity of the approval. You may need to write a letter of intent continuing your support of the application, but that is consulate specific, so I will let someone from Bogota answer that one.

If you can tell after one face to face meeting that you are sure you want to marry and that you both love and trust one another than apply. But if you are not sure don't waste immigration's time and resources for a visa you are not going to use.

1. He should be able to schedule it without a passport number, you will get a reference number to book the medical. You will however need a passport for the medical. So make sure you will have it back by then.

2. London does slow down big time around Christmas, based on our case last year our stuff was sent to London in mid October and our interview was in the very beginning of January.

If she missed her Adjustment of Status interview then she is in deep trouble. Your case will have been denied and since it is a month and a half later she is probably been put in some type of removal proceeding. Her permission to come back into the US on the Advanced Parole stopped when she missed the interview so she cannot come back into the US on that. You could try to appeal but as it was your fault you missed the interview (and not some fault of USCIS) you might not get very far. What visa did she originally come in on? Your only option now really would be to find out about any possible removal proceedings and then file for a CR-1 visa while she is still in Canada. I doubt she will be able to return to the US until she is granted a CR-1 which will take several months.

I don't know much about it but from what I have read from other's experiences the medical people make the recommendation. If the medical people see a problem they would have probably asked for additional information or sent him for additional evaluation. I would not think that it should be a problem.

Hey guys, thank you for all your past help and suggestions. We have successfully acquired the K-1 visa (my fiancee is from Colombia). In order for her to pass onto the airplane and past customs and immigration in the U.S., all she needs is the K-1 visa packet, her passport, and medical records? Is this correct?

Also, in regards to the marriage certificate, do you know how difficult it is to obtain this (ie for marrying in Ohio)? Is it more of a hassle with the K-1? Are there any web resources for this? Thank you for all your invaluable help and advice.

She needs her passport which includes the visa, the envelope they sent you that says do not open and her x-ray.

We got our license in Cleveland on a K-1 and no problems at all.
