Just general advice to everyone, never buy your ticket until you have the visa in hand.

You will probably get it in time, but there have been those that have been delayed for whatever reason. Did you pay to have it express mail?

People from some embassies need to front-load their petition with information to document their relationship so that when it comes time for the interview they have a better chance. Being from the UK you don't need to. Just make sure you have evidence that you have met your fiance in the past two years such as boarding passes, passport stamps, pictures, etc. The rest of the stuff you can bring to the interview but the person looking at your case might not even look at it.

I would not send a binder. You can save that to bring to the interview. I would recommend using binder clips just to clip the top corner so they can take it apart easily.

I've heard that the redirect anyways to the closest correct embassy. Put Mauritius and see what they do. They won't have you interview somewhere that isn't going to be the correct place. I've heard of alot of people who put the wrong embassy or consulate in their country (I.e. Canada) and they are just given the correct one to interview at.

Going the K-1 visa route is one route. My Fiance and I did, and I got my visa in just under 4 months (which is quicker than is usually anticipated). Canadians can stay for a max of 6 months, and I believe they can apply for a 6 month extension. What the USCIS folks will want you to prove is that you're not trying to establish de facto residence in the US by going this route.

The other option is for you to enter the US as a visitor (with the intention of being a visitor, meaning you don't dissolve all ties to Canada, or at least don't appear to be doing so) and then apply to adjust your status to that of a permanent resident. B-2 visitors can do this...some would argue it's a slightly riskier route, but it can be done. Again, as long as Customs/USCIS believes that your intentions upon entering the US are to pursue the visa class you are requesting entry on, you'll still maintain legal status. If your intention upon entering is to visit your girlfriend, and while there you decide to marry and apply to become a permanent resident, then yes, you can do that. Without knowing all the ins and outs of your situation (ie whether you've been married before, have children, any criminal history, etc) I can't get too specific. But hopefully that's a start. If you're planning on going for a length of 3+ months, the CBP may want proof, such as a bank statement, that you have funds to support yourself while in the country.


Option 2 that you gave is visa fraud because he already intends to get married and stay in the US. Coming in on a visitor visa and then adjusting status with this intention is illegal.

Go for the K-1, it will do exactly what you wanted. You can come, get married and stay all perfectly legally.

No problems whatsoever. Just make sure you have the beneficiary's name and the type of form submitted on the "for" line.

And it is true that the K1 was NEVER work authorized. Until February 2009 there were some vagaries in the wording of the I-9 form that allowed some K-1s to "get away" with working. In February 2009 the DHS cleared up the confusaion and changed the wording on the I-9. There was no change in "the law". Such would have required an act of congress. The "change" was implemented with the change of a few words on a form.


Someone should really change the K-1 Flow Chart. This states that it is possible to gain work authorization.

I have heard of very few people recently who get the work permit stamp at the airport. I'm not sure if they do it anymore. I know you can pay and apply to work while you have entered as a K-1 but that only lasts the 90 days your I-94 is valid so by the time you are approved its really a waste of money.

We thought the K-1 was the obvious choice for where we were in our lives. We both just graduated and I was just looking for teaching jobs (there still aren't any btw, lol) so it made sense for us to start our new life together after we had the visa and could get married.

Frankly we really didn't consider the CR-1, it does have its benefits though.

1. Boarding passes are great but you can get by without them. Itineraries accompanied by passport stamps would serve the same purpose.

2. It shouldn't matter that there were different airlines. You only basically need to show you were in the same country at the same time.

3. I highlighted mine just to make it easier to say what I wanted them to get from each document.

4. 5. Skype really is not needed at this phase unless you are in a really high fraud country. You'll have to go to the specific Taiwan related forum to see if this would be necessary or not. It just shows proof of a relationship and not of having met in person.

6.Photos are great. Send a few good ones of you together, maybe 5-10. You can print them or have them printed but be sure to label them with the names of who is in the pictures, where it was taken and when. Then put the pics in a plastic sandwich baggie so none of them get lost.

Talk about comparing timelines, if you bothered to look at mine you would notice that my fiance's (now husband) visa took 10 months. He is from England, not Iran.

So you think that your wait is any more important than any one else's that you would jump in front of with that lie? It isn't a long wait because they are sitting around twiddling their thumbs, it is because their are people waiting longer than you ahead of you in line.

That is not to say that I do not fully support those who are deployed getting an expedite, I have no issue with that. But to lie? Come on now.

My fiance is in Active Duty and about to get deployed. He actually called to Military line in USCIS that was absolutely useless. :( They say that they "help" Military, but in reality 4 and half months later and we can't even get a response from USCIS. :(


Have you tried contacting a Congressperson? That is unacceptable.

You cannot come into the country, marry and intend to stay on visa that is not the K-1. If you did want to marry while in America you could get married and then file for the CR-1 which is a spousal visa. You're wife would have to go back to her home country in order to interview for such a visa (much like the K-1). If she is already here and you just decided to get married (with no intention of doing so when she arrived) then you can marry and adjust status now.

Also if she is a J-1 currently make sure she does not have any home residency requirements. Some of those visas require the bearer to stay in their home country for 2 years following the visa (this can be waived later). It should say on the visa or in the paperwork.

Hello and welcome!

Touched means that the last updated date on the USCIS website for your case has been changed. It might mean that it was moved from the box, or that they did something to your file. It can mean anything really it just shows that someone scanned your file. Some people don't end up getting any updates on the website even though they are approved ( they receive it in the mail) so I wouldn't rely on it.

For the K-1 you just need to prove that you have met at least once in the past two years, not have known each other two years. Do you have any passport stamps showing the visits? Pictures together? Luggage tags? There are many things you can use.

The time it takes for cases varies. 6 months is an average some take much long and some take less. It just depends. Right now USCIS is moving very quickly, but last year when we did our K-1 it was quite slow.

Check out this K-1 Guide, and the K-1 flow chart for more information. Also in your profile you must have mistakenly put in J-1 instead of K-1 visa. Those are two very separate visas and people often look to see what visa you have in your profile to base their advice on. I would suggest changing it to K-1 so you get the proper advice.

There should be no problems getting a visa. She may have to mention it at the medical so she is not given the xray or the vaccinations not appropriate for a pregnant woman. You may also need to write a brief statement saying that you know that your fiance is having a baby and that it is yours for the interview.
