Current annual is what you would make this year if you made what you made the whole year. Ex. $10 an hour full time would be about $20000. That is for this year. This year is most important and then past taxes are secondary. They are not included in the calculation but can be used by the agent to determine if they think you meet the requirements.

According to the directions for the form the "consideration" for the contract between you and the US gov is him or her becoming a permanent resident.

You just send whatever is the most updated form on the USCIS website, even if it is expired. The most they might do is RFE you for a new form if by some miracle they come out with a new one immediately.

In addition it states in the directions for the form that previous editions are accepted.

As the above poster said, the i-134 is not legally binding. The K1 is technically a non-immigrant visa so most embassies will treat it as that and therefor not ask you to submit the i-864 until AOS. But since the K1 visa applicant(foreign fiancee) is most likely to marry and adjust status in the US, the embassy will still ask to see proof that the primary sponsor(you) or the co-sponsor is able to support the foreign fiance(e).

By the time you're married, add her to your medical/health insurance(whenever it's possible). Through work(if offered) is usually the cheapest. Just for me to get birth control over here a month before I was added to husband's insurance through work was around 200 for doctor's visit and the first month of pills - imagine the cost of breaking an arm.
Anyways, the point is not a huge medical bill. The point is to NOT get food stamps or any other benefits that are considered means tested benefits. By submitting the i864, the sponsor/joint sponsor signs it and thereby they may be held accountable IF the foreign fiance(e) uses any of those means tested benefits while the i-864 is binding and enforceable. It is a contract between the sponsor and the government. So the i-134 is NOT legally binding, the I-864 IS.

Actually according to the link I referenced above, food stamps are allowed as they are not cash assistance so they do not count toward being a public charge.

She can technically be sued for anything paid for a public charge for your fiance only. She is not responsible at all for you.

Officially an I-134 is not legally binding. It is when you adjust status and file the I-864 that she becomes responsible. This is not for debts, but for any money that is paid if your fiance were to become a public charge. You can be in debt and not a public charge.

We set it afterwards. You can do what you want, it isn't the law that it should or should not be set. They are just advising you that there are no guarantees of when you will get the visa. My husband had an interview in January and it took until April to get his visa. If we had planned a wedding before then we might have not made it.

He got the 1st notice last July 11 then after that we did not hear any updates anymore, do you have any idea what will be our next step? What requirements do we need to prepare? The only way you would be able to file to a consulate directly would be for a spousal visa.

Any work authorizations stamps in a passport need to be accompanied by a work visa. A K-1 is not a work visa. You can in some states get a license with a social security number and I-94. You must file pretty quickly to get it though because the I-94 is usually the date they put the license to expire. Then you may need to have your EAD card to apply for one.

The easiest method would be to arrive in the US and get married ASAP. Wait two weeks after arrival (so you are updated in their system). Get social security number, get license. Once you are married you can apply for EAD and AP with AOS right away so hopefully you will have your EAD/AP before your I-94 would expire so you can get a new license if they gave you a short expiration date.

How do you confirm whether someone has lost residency after they have left the country? My problem is, I filed the 864 for my ex-mother-in-law, whom has returned back to her home country. Now I will be filing for my fiancee'. How do I prove on the new I-864 that I am no longer liable for my ex MIL, since she's left the US for more than 2 years now?


I haven't heard of anyone in this situation. Maybe someone else has more experience. However, if she has been gone that long she most likely has lost her residency. According to the I-864 you are no longer responsible if they "no longer have lawful permanent resident status and has departed the US" I would think that your ex MIL would fit this category.
