We are having the wedding party in April we are engaged. I am not try to "jack" the system I am trying to get the person I love here with me in the US in a legal manner. Dont sit there and accuse me of trying to defraud the system due to lacking the knowledge that you have. We started off filing what we thought was right apparently we erred. With that said it seems our best bet is just to file the CR1 and wait it out. CBP told me this morning they do not recommend traveling while waiting on a CR1 not sure what to make of that. I know this is the K1 forum but in the cr1 guide it lists this:

All of this "knowledge" they you say you don't have is easily accessible on this website. Your profile says you registered in January, which is presumably enough time to read over all of the applicable guides, etc. No one is telling you anything new. You cannot be married and get a K-1 fiance visa because it is for a fiance (the name itself gives it away). If you have to be married in April you might as well cancel the K-1 right now, get married and then file for CR-1 which will take many months to approve. In my opinion if you have already started the K-1 why waste your time and money by getting married early and not being able to use it. Wait to get the K-1 have your fiance come to the US and get married.

Re: Guidance for Processing Pending Form I-129F Petition for Alien Fiancé(e) when
G-325A for Petitioner and/or Beneficiary is not Signed and/or Photos not Submitted.

Purpose
To provide field offices with guidance on processing Form I-129F petitions when the accompanying G-325A is missing signatures and/or photographs.

A properly executed Form G-325A is required for all I-129F petitions. Previously it was standard practice to issue an RFE when the beneficiary failed to sign the G-325A and/or failed to submit photographs. From the date of this memorandum, an RFE should not be issued in instances where the beneficiary failed to sign the G-325A and/or failed to include photographs provided that the beneficiary is residing abroad. The beneficiary will be required to sign the Form G-325A and/or submit photographs at the time of visa issuance abroad. It is also not necessary to RFE for the petitioner's signature on the G-325A, if the petitioner failed to sign it. The signature of the petitioner on the Form I-129F should be deemed sufficient for purposes of adjudicating the petition. Finally, it is important to note that the petitioner's photograph is still required for the adjudication of the I-129F, so if it is missing, it must be requested prior to adjudication.

The advice you will get on a do it yourself board will be that you don't need a lawyer if you have a straightforward case, and I would agree. No overstays, drug use, previous petitions you most likely can do as good of a job or better than any lawyer plus save yourself several thousands of dollars.

It doesn't matter *who* paid for the tickets or other expenses, just that you can show some record.


I would argue that in some cases it does matter who paid. What if it was a suspicious outside sponsor? Or a member of the beneficiaries family who paid for everything to get them a greencard? I agree in this instance it doesn't matter that the petitioner's parents paid for the ticket, but in other instances it might matter.

You can't have your cake and eat it too. If you wanted to ensure a big wedding and to come over just after getting the visa than you should have gotten a CR-1, you could have gotten both. It seems sometimes that people are even more focused on their dream wedding than being with the one they love (not saying anyone specifically, but it seems to be a running theme in general), so I gave an option. Take it or leave it, the choice is yours, you are the only one to know your priorities: the big wedding or being together quickly.

I am applying for a K1 visa for my beautiful fiancee to be with me here in the states and we have a few questions about the process.
1) Is it advisable to print the forms on resume paper?
2) Is there a particular order we should put the paperwork in?
3) Should we punch holes in all the papers and send it in a 3 ring binder?
4) Should we print all the papers on one side only (not double sided)?
5) Are the letter of admission and letter of intent the same thing?
6) Do we need a certificate of no marriage?
7) Should we number each page and create a table of contents using those numbers?
8) Should we label all of our pictures with what we were doing at the time?
9) Should we get the I129F and G325A form notarized?
10) We know our relationship is genuine but how do we prove to the consul that it is genuine. What can we include to convince the consul beyond
doubt that we are bona fide.
11) Should we include copies of our ID's?

I know this is a lot of questions and some are probably irrelevant but we are both very anxious about this application and want to do it right.

3. Punching holes is fine, but you don't need the binder. They will only throw it away and it will cost more for you to send to begin with.

There is great information all throughout. Take the time to go through everything as it will save you a lot of time later if you make a simple mistake. After you go through that and become more familiar, your questions will hopefully dwindle. Carefully scrutinize answers from people who just "think" versus there are some senior members that have been around awhile and back up their answers with links and facts. I have seen some truly bad information. Remember, ultimately you are the one responsible for the application.

That is the point! If you had filed everything correctly you would have been approved and gotten your NOA2 right now. There are two major times you receive a request for more information. When you first filed if you left out something important and right when they are looking at you for approval, at that point it is approval, RFE or rarely a denial. They aren't sitting there staring at your case for 5 months. It is likely it has been getting dusty at the bottom of a box with no human contact since you got your NOA1.

You and I have the literal exact same situation. Teacher who can't find a job, living with mom until we get on our feet etc. Anyways, not to worry. Have one of your parents file out the I-134 and have all of the necessary paperwork such as old taxes with W2's, current paystubs and letters from employers and you will be all set. You don't need to have enough funds if you have a cosponsor who does. You do however have to fill out the I-134 anyways as you are the main sponsor even if you don't make anything.

You'll be fine.

Actually having a overstayed before a K-1 is one of the only options to visit in the situation and he can't do VWP. Anyways, but OP why take all the time, money and trouble to get a K-1 and just abandon it? If you ever want to move to the US you're going to have to go through a similar process all over again.

Actually the instructions on the USCIS website state clearly you need to submit evidence of meeting in the past two years as well as proof on the US citizenship as well as passport pics, etc.
