Usually they say a denied visitor visa has no real impact on a K-1. But possibly the reason she was originally denied the visitor visa is the same problem now. Drugs or a police record come to mind (and I don't know your fiance, but those are common reasons for denial).

Yes indeed. We were young and ignorant and afraid.

VJ has been extremely informative, and I have definitely learned much, much more about this whole process since I found it, but when we filed last summer, I was writing an MA thesis and my man didn't want me to worry about anything but finishing it well, and he so he shopped around and did the paperwork with our lawyer. Together, they missed one box on one form. What can you do?

Anyway, our petition got approved! Woohoo!


That sucks, I would have asked for a refund. A simple mistake you might expect from someone just filing on their own, but you paid thousands of dollars just for the lawyer to not do what they needed to. Glad you were approved though, and only week or two lost there.

My impression was they were approved for NOA2 and then had not had any communication sine June. They should have heard from NVC and the embassy by now.

I would say she would more likely be here by Christmas or if you are lucky Thanksgiving. Currently the first part of the process is taking about 6 months, then on tho NVC then to the embassy and to interview.

Exactly, so in this case, they would...

1. File the petition
2. Get an RFE
3. Reply unsatisfactorily or not at all
4. Get notice the petition was denied for lack of primary evidence meeting in the two years prior to filing

It's not RFE or Denial. It's RFE and THEN Denial.


That is if the reviewer is in a kind mood. I've heard that they sometimes will just outright deny the petition if it is missing this section.

It is possible. You might have more luck looking the Middle Eastern forums for more specifics on the situation as they might have more knowledge on the topic (although you are dealing with the UK). You will need some proof of meeting. Any passport stamps? Pics? Bills from visits? Anything? My only real concern would be that in the UK if you interviewed in London for example, the adjucators might not be as understanding of the practice of an arranged marriage because it is just not as common.

Theoretically is supposed to be the actual piece of paper he has signed. However, if they are going to examine a signature closely to see if it is a copy or not, I don't know. It depends on who you get to look at your petition, luck of the draw.

I think they mean plan to get married at the courthouse as soon as the beneficiary arrives on their visa for AOS purposes. Then they can take their time to plan their wedding date for family and friends.

okay.. well I wasnt going to plan an exact date.. I am really hoping that this processe wont take to much longer than 9 month.. which will be the time spand by october.. but thanks for the advice. we'll complete everything else in the 3 months after we have the visa.. I was going to go to jamaica in june and we would work on the rest of the visa together... I am sending the F-129 this week.. so ya I guess we'll just see what happens.

so basically, my fiance in the U.S. files an I-129F. then within 90 days we need to get married in the USA. the problem is, whenever i choose to go back to the USA within the 90 days to get married, if i tell the border that is why i am going into the USA, they are not going to allow me in.
If i lie, i will get in, but once i get married, they will know i lied. i am supposed to go across the border to visit my friends and this just happened to be the weekend we went to the court house to do it? doesnt having filed the I-129F show premeditation to get married, and if so, then i am a liar at the border because of my intent.
and, all this aside, once we do get married, i have no problem going back to canada and continuing to visit every other month or am i allowed to stay and then get a job?


You need to read up on the 1-129F, you are misunderstanding the process. You apply, you wait several months and get the K-1 visa. You enter at the border with this visa which is specifically for getting married, so no need to lie. Then you need to adjust your status, remaining in the US until you have permission to leave. During this time you can apply for a work permit. You are welcome to try to visit during this process, doesn't mean you will get in, but you could.

Never lie to immigration.

What are you talking about? "If you turn in your petition you have about 50% chance of getting through by December/January." K1 process usually takes between 3-6 months to get your petition approved. Recently it seems that majority of K1s get approved within 5 months time frame. So I don't know what did you mean by December/january



What are you talking about? People lately are taking 5-6 months just to get their NOA2 then on to NVC and to the embassy where you will wait weeks to a few months for an interview. I don't know what "recently" you are talking about.....

Currently California is looking at late September filers (give or take). Once you get your NOA2, probably in a month or two you will go to NVC for a week or two and then on to the embassy for the interview.

First, if you are not SURE, don't apply. The 90 days is to plan a wedding and get settled, not to be sure you are compatible. If you get married ASAP and file AOS ASAP then it will take around 60 days from the day you file. Probably you will be in such a whirlwind from your recent marriage you will want time to relax before you start to work anyways.

You shouldn't send in the additional info, it won't get put together with your application. Take them to the interview if you need more proof of relationship.

I believe she will be asked what she would rather be interviewed in English or Chinese and they will interview accordingly. However, make sure that you make it clear that the two of you can communicate effectively (this is often a big red flag), either that you speak Chinese or she is going to English lessons, etc.

5 to 6 months assuming they filed correctly, which they obviously didn't because they got an RFE. Don't get mad at USCIS for your mistake in the application. They would have either RFE'd you or approved you at the time, and they apparently needed more info so they sent an RFE increasing your wait.

To the OP, there is almost no way you are going to make that date. Push it back for your own sanity. It is you wedding, not your family's no matter what they might think.

Don't you think we waited for our visa to be approved? In total it took almost 10 months for my husband to get his visa (in a case which had no complications), so I certainly understand the waiting game, everyone on this site does. So why should your case or anyone else's take precedence just because you feel like you are too good to wait like everyone else?
