If you really want to be safe you would wait until your fiance has their citizenship which is they are eligible for 3 years following becoming a permanent resident through marriage to you. Then they would be able to travel as they please and stay away as long as they wanted without the possibility of losing their residency rights.

Whoever wrote that letter should have worded it in a different way. As a K-1 applicant you might be under more scrutiny under the VWP because you obviously at some point do want to immigrate. If the officer decides this is your intention you will not be allowed in and therefore no longer able to use the VWP again (you would have to get a tourist visa to visit again). That is the only lasting effect a denial would have.

I have been through this process and I have seen people ask this same question on this board a hundred times. It has no ill effects on your K-1 application.

If you are nervous about not being able to get in why not fly through Dublin to the US. They have US customs at the Dublin airport itself so if you are denied then you won't be out of a very expensive plane ticket to get yourself back to England.

Why are you so mad at USCIS, the RFE was most likely an oversight on both your and your lawyer's part (because even having a lawyer, it is YOUR case not their's). USCIS get the information, they process the information and they approve the petition, that's it. If what they need is not there then they can't do their job and waste both your time, and their time requesting more info.

I do not necessarily agree. Pictures are great, but the UK rarely asks to see any relationship evidence at the interview and even then emails or boarding passes or phone bills could suffice.

I don't know how good bus/train/museum tickets will be to prove anything unless your name is on them. They could be anybody's (not saying they are but they are not solid proof). Do you have boarding passes with your names on them? Passport stamps? Hotel receipts?


Also I had actual photos printed then printed a word document with all the captions of the names of people in the pic, date and location. Then I cut out the captions and taped them on the backs. Simple and easy to read. Then I put all the pics in a plastic baggie.

3 months is almost impossible, probably closer to 8-12 months. Just so you know that straight off the bat. You can visit the US as long as you bring evidence that you will be returning home at the end of your stay. It depends on what happens at the border if you is allowed in or not. With sufficient ties to home you should be. Visiting will not have any impact on your visa application so you might as well send that ASAP. There is no problem whatsoever for your fiance visiting the UK during that time.

Well you won't be able to move to Denver until you are approved in the first place. Then for Adjustment of Status it is possible although highly unlikely that you will be denied, but then there is a huge appeals process, etc. which will unless they determine fraud allow you to stay. I would not worry about it. Once you are approved for the K-1 you know what they are looking for in terms of relationship evidence and financials.

Not much movement will happen for the next 5 months I'm afraid. Most likely your case will appear online in the next few days, although some never appear. It isn't all that reliable anyways. Our K-1 visa was approved in April 2010 and it still says Initial Review.....

Everyone has a valid point regarding the "risk factor" it all just depends who you see on the day. I also hired a lawyer to deal with our K-1 visa application, not because we were incapable, just because we didn't want to leave any stone unturned and were prepared to pay someone to get it right first time. One thing i will point out is that my lawyer did ADVISE me that if i were to visit the US then not to say i was visiting my fiancee for the reasons which everyone else has stated. That's not to say that's what you should do were you to visit, i just thought id share that little piece of info :)

If you have a simply case and you can read I would consider yourself more capable then a lawyer. It is certainly your personal choice though.

Also I don't know how your lawyer phrased it but you cannot lie to immigration. So if you are asked point blank, are you visiting a significant other you have to answer yes. If not it is your choice to tell more specifics about your trip.

You should have come here first. You forgot the most important part, evidence that you have met in the last 2 years. You will probably receive a request for more evidence which will put you behind a week or two depending on how fast you respond. You will probably here from them in a few days to weeks regarding them receiving your paperwork. Being in the military means nothing unless you are going to be deployed soon.

Is the I-864 and the I-134 the exact same form? what should i do with it once iv filled it in, send it with the others, or take it to the interview? will it slow the process when it isnt asked for in packet 3?


You bring the I-134 to the interview along with proof of your financial resources. It is essentially the same form as the I-864 although slightly modified. London basically wants to know when you get to the US you will have enough resources to stay and file for AOS.

im assuming thats the affadavit of support, which for us is: I-864. this is straight form the london embassy website: "An I-864 is not required when applying for a fiancé(e) visa. An I-864 will be required at the time the fiancé(e) visa holder applies to adjust his or her status from nonimmigrant to conditional resident with the United States Citizenship and Immigration Services(USCIS)."


Yes, I-134 is the affadavit of support but it is needed for London along with all the necessary documentation.

I assume you are the beneficiary? They will probably ask for any court documents you have and everyone needs a police check for their interview. As it is a drug related offense you might/probably will be denied at least initially and you will have to file a waiver to get a visa. What embassy will you be interviewing at?

They will automatically extend the validity of the NOA2 if it will expire soon. The only thing you might want to do is have the petitioner make a new letter of intent dated closer to the interview to reaffirm their interest in pursuing the visa, bring that to the interview (it probably won't even be needed, but just to be safe). London knows the process takes awhile so they renew the application all of the time.

I would say about a year or a little less. The USCIS processing is taking around 6 months, then on to NVC for a few days/weeks and then off to the embassy who can take anywhere from a few weeks to few months for interview.

Usually they say a denied visitor visa has no real impact on a K-1. But possibly the reason she was originally denied the visitor visa is the same problem now. Drugs or a police record come to mind (and I don't know your fiance, but those are common reasons for denial).
