Now that the NOA2 is received everything else is on the immigrant's end. It will process through NVC and you should be notified at your address listed about what you need to do. Your fiance will need all of the sponsorship documents, you need your medical and police checks and to fill out the necessary documents for the interview (the consulate will tell you what you need).

How about a local travel guide and tickets to public transportation so they can get out and explore (I don't know if they have a car yet). Maybe tickets to local museums, etc to have something fun to do but that is cultural as well.

I think the OP's reasoning would be that a more educated beneficiary would theoretically be better off generally (ie, health, home, etc) and therefore have less of a desire to try to obtain a visa fraudulently to come to the US. Not sure if it would totally be true, but it could be in some cases.

If she came as a K1 she almost definitely has a conditional greencard because you were married less then two year when you got AOS. You need to do a removal of conditions. check out the guides found at the top of the page. She can apply for citizenship 3 years (minus 90 day) following the date of her greencard.

The atlanta field office is not processing the cr1s at all. So if it will take then a year or so to get to my cr1 I am willing to take a chance and apply for K3, hopefully it will be processed in NBC and i ll bypass atlanta. In any case I don't see any harm in filing the K3


They will close the form before you even get to interview and you will be stuck with the CR 1 anyways.

Also I am pretty sure that whatever background check you were able to do is not as in depth as one USCIS may go, especially is something does pop up on your record somewhere.

Yea, I agree. It must be a browser or some setting or cookie, etc. that is preventing you. Get the newest version of Internet Explorer and set it to all the defaults and see if you can get in.

Also there is no need for them to tell you the truth as they never claimed they would in the first place. No where in your application does it say that all word of USCIS call center staff should be taken as fact.

VisaJourney only represents a very small portion of the petitions USCIS does every day. It is very possible that they are processing at least some K-1's everyday, just not VJ's.

If you go into your case status, it will have a date and time it was last active. This is a touch. For some it might stay on the day it was entered in the system. For some people it might change. It is just a sign your petition is doing something, like being scanned when moved or when someone looked at it for some reason.

It doesn't really have that much significance, but it gives hope that maybe something good is happening! lol.

You cannot add and multiply percentages. You need to use the raw data to prove the point you are trying to make. There might be only 1 out of 2 approved of 50 out of 100 approved in any giving month. Just saying 50% is not a clear representation of this data.

I think it is more the US citizen has the right to file the paperwork to have her stay, however they did not. As far as the US is concerned is a citizen of another country who has overstayed her visa so now she is banned. Hopefully you will be able to appeal or get a waiver, although I think that is more of a courtesy to the US citizen husband than anything else.

I certainly am no expert but it sounds like you came in on a tourist visa and overstayed, accumulating enough days of overstaying to get you banned for five years. You have no status in the United States because you were simply there as a tourist and started no paperwork. Had you started paperwork for AOS you could have left because they allow AP for emergency and over cases to travel abroad while it processes.

I do not see any other choices other than to file for a CR1 visa and apply for the waiver to repeal the ban. That can take several months to go through and as it is not a hardship to the US citizen it is probably unlikely you could receive an expedite.

When exactly did your husband leave the US? If it was less than 180 days after his 90 days from the K-1 visa than he might not have a ban.

Usually keeping the passport is a good sign. Sometimes they say AP but they just mean there is something that has to happen before you get your visa (like them going through your documents). AP is a specific thing for background checks, etc. but it can also be used as a catchall term which it seems the case here.
