Hi all,

I'm getting fet up with my fiance's court case where he's trying to get his birthdate corrected on his official doc's - 10th certificate and passport before we file for a K-1 visa.

I'm exploring my other options. What if we decide to get married in India? What do you need to bring with you to get a marriage license in Chandigarh? I think I'm covered as I have my Driver's license, brith certificate and divorce decree but what about Sam? What does he need to bring with him? As long as he doesn't have to bring his 10th certificate or passport I think we are good. His birth certificate is the only correct document we have at this point.

Asia: SouthQuestion about Brining over Family for Wedding on Travel Visa
Hi Guys, not sure where exactly to ask this question so I figured I'd try here. As you know I'm working on the K1 for my fiance Sam. We have a strong desire to bring over his family to attend the wedding in the U.S. once Sam get's his visa. I was wondering if any of you have done a similar thing?

Our tentative game plan is:
Sam gets issued visa at New Delhi embassy
immediately finalize wedding date for a few months in future
immediately apply for travel visas for his parents and sister (might be hard to get one for her as she is unwed)
then book airfare for Sam and his family once travel visas get granted

I know I have to fill out the affidavit of support for his family similarly to how I had to fill out for him for the K1 but my question is, does there need to be one Affidavit support packet per person or can I combine forms/letters/bank letters/employment letters/birth certificate copies etc for all of them?

Your help in this matter would be greatly appreciated!

This is what I learned from my other buddies on VJ.

A 10 year visitor visa limits what you can/cannot do in India. For example you can only stay in the country for 6 months at a time at which point you'd have to leave and come back. You cannot get a job with a visitor visa. If you are a spouse of a Indian citizen and they have an OCI card, you can go for a PIO card. This would allow you to travel to and from India without a visa and stay for however long you wish. The fee for the card, which will have a validity of 15 years (updated), would be US $ 365.00 for adult and US $ 185.00 for children below the age of 18 years. It also allows you to get a job in India I believe and is kinda like an Indian version of green card. A PIO card is the way to go if you ask me. smile.gif

What did they refuse at the VFS office? Was it parts of proof (like accepting some but not all photos) or whole chunks (like taking all the photos but refusing all emails)?

I'm sure every embassy has something they just don't talk about it much. They refused part of the evidence We bombarded them remember? lol. We had 300 emails , they only took 60 from each side - 120 in total I think, We had 276 pics, they only took about 80 something because some where in similiar places or poses. At some point they asked if we had anything else to submit, apparantly you can submit more than what's on the 221g! I didn't know that. Sam ran home and grabbed a few things, this time they took the letter from my parents and the cute engagement album we made on shutterfly. Oh and they like to have the letters and cards sorted by type, we had them combined so the lady took care of that for us there. They also took my wedding dress receipt, engagement rings receipt, all things we tried to submit last time but were refused, ugh!

Sam will have to fill in the gaps, I can't remember the rest. Should I call DOS in a few days to get an update? whistling.gif

I'll let Sam jump in to explain his experience today at VFS, basically they refused part of our evidence because we had too much lol. whistling.gif I don't care how much we have as long as we get approved! It's stupid how this time they accepted stuff we wanted to submit last time but they wouldn't allow us then! Anyways should get an answer in 7-10 days, and btw, the lady basically unofficially confirmed that there is a quota - they are only allowed to grant so many visas at a given time, sucks.

It's a piece of paper that proves that you voted in a particular year. Yes, NOTHING to do with our relationship but they still asked for it! Very hard to get in some areas.

Just to update everyone, Sam got his voter's list thingie today and didn't have to bribe them amazing! He did have to go back 3 times before they had it for him though. He also got it translated. Also, just to warn some people as it wasn't obvious to us, that you need to submit original letters and cards with envelopes (if you have them) not photo copies. They promise to return them later. We should be ready to submit our additional evidence on Monday or Tuesday at the latest. yay. kicking.gif

Just to update everyone that we are about 75% done with our evidence gathering. Sam's already taken care of his voter's thingie. At first they told him to come back in two weeks and he pressed them and they said come back in two days. So he should get that on Friday.

I have a cover letter for the 221g that we'll both sign
I have a 5 page essay affidavit on how I met him and why I want to marry him, he'll do likewise so they get it from both of our sides
I have a one page affidavit on the language issue.
I have a one page affidavit on my passport copy.
I created 32 more pictures last night from stills from various videos we had during both my trips there. - Sam will print there.
I also color copied every hand written letter / card I have from him and envelope or if not why, received in big box with gift, no postmark available, or lost envelope, only have letter etc.

This is what I've learned from this experience. We originally had submitted about 36 pics and 40 emails but that clearly wasn't enough even though it showed a big date range of communication, they wanted more. We are now going to submit about 250 pics and a few hundred emails. So for those that haven't gotten this far yet in the process, BE PREPARED, volume of evidence is the key for New Delhi.

Once I get his stamp of approval on my affidavits I'm going to the bank to get them notarized and off to Fed Ex Kinkos to send him a package that should arrive there on Saturday. If he gets his voter thingie on Friday there is a possibility we can submit this back to VFS on Monday, just a week after his interview. Not bad if I do say so myself!

My fiance Sam had his interview today and got a 221g. Here's the list of things they want from us:

1) Notarized explanation of how and when you first met your fiancee and why you decided to get engaged - I wonder if they want this in Sam's writing instead of mine from his side/notary. Any advice on this one would be most appreciated, they apparently didn't like that we met in an Internet chat room.

2) List of all engagement ceremony guests, their relationship to you, their addresses and phone #'s, Please do not include immediate relatives. There was 8 people who weren't immediate relatives I hope that is good enough!

3) Itemized emails and/or postmarked letters or cards showing correspondence with your fiancee before and after the engagement ceremony. We already submitted that grrrr!!! But we'll do it again.

4) Photos of you and your fiance before, during, and after the engagement ceremony. We already submitted that grrrr!!! But we'll do it again.

5) Notarized copy of your fiance's passport - assuming this is to be done on my side from a U.S. Notary?

6) Voter's ID card and voter's list for yourself for the past 5 years. - Sam will have to figure out this one.

7) Notarized statement from your fiancee describing her ability to speak your language (Hindi/Punjabi/Other) and any specialized training she has received in the same - What the heck? We speak English to each other!!! Do you want me to print out the 6000 emails from the last 2 years?? Haha.

I agree with kari , If u can go u should go . And are u talking about us kari ha ha . It does help a lot . Just the presence would help emotionally for the co , the confidence leavel is high with the presence of urs .
I guess we were totally lucky that we both got interviewed .

Well, we are now at 90+ days. So yesterday, I sent a snail mail to my congresswoman. That got me even more fired up, so I called her also. Of course I got some call center flunky type who said she would call me some time this week or next week.

I got my NOA1 on 4/12/07 and the check was cashed on 4/20/07. Nothing after that... No updates, no "touches", nada. Fortunately I am going back to Brasil again in August to see her, I cant wait for that! But, my god, this process is painfull!

Funny thing is, I kept telling her before we started our papers as that its a v e r y long and painfull process and it will be difficult. Now, Im the one freaking out! haha

Oh well, I guess I am just venting... ;)

Hi all!

Can anybody give any some updated info on K1 Visa processing at the RJ counsel?

After NVC sends the K1 package down, how long before you were notified about Package 3?

How long did processing take after the interview until you were able to pick up your passport?



I ask because I am trying to plan my PTO (personal time off) at work so that we have enough time when the interview hits. I've heard it usually is 2 days, but the emabassy web site is now saying 5 days. That could really screw up my time off from work dependign on how long I am down there for the interview with my girl :(

I am not sure how long they are valid, but my girl needed both certificates and it took 1 week to get them both. She said the Federal Police in RJ was ok, but the other one was located next to a very bad jail and she was rather scared to be there ohmy.gif

My finacee already has her police certificates. They were issued by both the Federal and SECRETARIA DE SEGURANÇA PÚBLICA. They both told her that she had to go to the Cartório and have them stamp it.

She says that the certificates are official and not xeroxed. Why would she have to go to the Cartório? I am VERY nervous because the instructions specifically state "The certificates issued by “Cartório” or “Fórum” are NOT, repeat, NOT acceptable, in any circumstances".

She *just* recieved Package 4 today and our interview is on the 27th. I doubt there is time to have the certificates re-issued if they gave us the wrong ones...

Anybody have any knowledge on this????

and where you two get marriage certificate impacts quite a lot on how easy for him (kiwi) to go to USA in the future for green card, not so much for work permit I think.

Now that the NOA2 is received everything else is on the immigrant's end. It will process through NVC and you should be notified at your address listed about what you need to do. Your fiance will need all of the sponsorship documents, you need your medical and police checks and to fill out the necessary documents for the interview (the consulate will tell you what you need).
