I have a question for a friend from Singapore. She wants to visit the US as a tourist for a few weeks. However, when her parents found out she wanted to go they took her passport and refuse to give it back (she is an adult). When she tried to file for a lost/stolen replacement her parents took the passport in to show that it still existed and the issuing office will not give her a replacement. The police were called but stated that it was a domestic issue and they could not get involved.

Does anyone have any ideas or suggestions how she can get her passport?

Well officially the embassy should not renew the petition without the US citizen's secondary approval. However, I would continue to contact USCIS regarding cancelling it from your end. Ask to talk to a supervisor.

I personally use binder clips just to hold everything nice and tightly together. They are going to undo your whole package anyways when they get it and put it in their folders with their own fasteners.

The household member is also liable based on the promise they sign as part of the contract:


Agree to be jointly and severally liable for payment of any and all obligations owed by the
sponsor under the affidavit of support to the sponsored immigrant(s), to any agency of the Federal
Government, to any agency of a State or local government, or to any other private entity that
provides means-tested public benefit;


They are liable for payment to the sponsor. They never sign any promise to the US government, only a promise to the sponsor. The sponsor could sue the household member for the money agreed, but the US government is going to come after the sponsor if they need to.

The household member is only responsible for making their money available for the main sponsor. Their contract is only with between the household member and the sponsor, not USCIS. Therefore they cannot be held legally responsible for paying back anything should the immigrant get means tested benefits.

Sometimes when they say additional processing they just mean what needs to be done hasn't been done yet, or they are waiting on something for it. Were you born in the UK or are you from another country? That can sometimes make a difference. Do you have a common name or a name that might appear on a watch list?

Okay you guys so have a couple of questions in regards to the I-864 form I'm going to send NVC.....I just want to make sure that I did not fill out the form incorrectly....

Since I'm a student and unemployed this year,
I have a joint sponser (my Dad) that I reside with to fill out the I864a form.....

When I fill out the I-864 form do I on
Part 1-Mark box
A- I am the petitionar. I filled or am filling for the immigration of the immigration of my relative.
or
D-I am the only joint sponser
E-I am one of the two joint sponsors

For Part 3
Information on Immigrants you are sponsoring
I am sponsoring the principal immigrant in part above
Do I fill
A.yes
B. NO (applicable in case of two joint sponsors)

Part 5 Sponsors household size

Part 21. Persons you are sponsoring in this affidavit
Enter the number you entered in line 10- which I put one for my husband the immigrant
Persons not sponsored in this affidavit:
a-yourself
b-you are currently maried enter 1 for your spouse.... I included him in line 10 so I don't write anything right?
g- is optional so even though my dad is the joint sponsor i can leave that blank right? it says optional?
h- add the numbers up Household size and I came up with two... for myself and my spouse....Is that correct? Yes


Part 24
a.LIst your income from line 23-- mine is 0
b.income you are using from anyone you have counted in your household... I counted myself only... So for part 21 -g the optional do I go back and include my Dad now? I put his name and income down but did not add him on part G.....

Part 25-Federal income tax return information... I have had income for the past three years however its not much but of course i'll add it in.....

Part 26,27,28 are all optional and my Dad makes enough income to cover my spouse so that will just be left at 0.
Of course my Dad will complete a I864a form.....

With zero income for you/petitioner have the joint sponsor use the form I-864, not 864A. Doesn't matter who the joint sponsor is.

The petitioner is always a sponsor regardless of income


I doesn't matter either way, both forms would work in this situation.

I recently received the request to send in the AOS. The only problem is that I do not work so that means I would have to place as Income 0. I am a full time student which is why I don't work. And there are no family members that are able to help me out as co-sponsers or joint sponsers. Do you know any alternatives? Or it will not affect my case if I only place my name and do not search for a joint sponser. Can you please let me know? This is urgent.

It will certainly affect your case because you will be denied. It didn't say a sponsor was optional so therefore it is vital.

K-3 really is no longer a viable option as they are being administratively closed. If you aren't married and want to get married in the US then you can do a K-1 which is a fiance visa. If you are already married or want to get married in Thailand then get married first a do a CR-1. I think both are pretty much equal in being difficult to obtain. CR-1 takes a little longer but it comes with a green card when approved as opposed to having to adjust status later on with a K-1. Read the Guides found in the menu at the top of the page for more information.

Hi everyone am new here and am feeling so very overwhelmed.

I am a US citizen, my husband is Canadian. I have been up in Canada on a visitor visa since 2005. Hubby and I have been married since Oct 08. Initially the plan was for me to immigrate up to Canada but plans have changed and now we are looking at moving back to my "home town" in the US. My official address is still there as are most of my family.

I was under the mistaken assumption that once we filed all his papers and we were waiting we could go ahead and move and wait for the approval etc. *stupid of me to assume*. (I swear I was told or read or heard we could do this, I must have dreamed it.) But now from what I am reading that is not the case. We are supposed to be moving at the end of June and I haven't gotten much of the paperwork started. The one thing we do have is the affidavit of support, my father completed it and sent it up last week.

I got excited when I saw the DCF option, but then I am guessing I don't qualify since I am only here on a visitor visa?

Any advice would be greatly appreciated. I got myself into trouble assuming before, but I think I am pretty safe in assuming we will need to postpone the move and get all the forms filed and get his approval?


You can move back in June, but it is going to take him several months at least before he can move under a CR-1 visa.

Where does it say you need to attach proof of citizenship to the Affidavit of Support?

I have a similar concern, so I am a dependent of my mom on her returns but as the USC for the petition I do not count in her family size. Is that correct? So she would have a family of 1 (her). And I would have a family size 2 (me and my fiance). Am I understanding this correctly? So for the form I need to list my fiance as wholly dependent on me then?

But then the checklist which you are supposed to send itself it says do not mail any documents to the embassy.
