No you won't. The card you get as a permanent resident is the same one they give to citizens....

They are not responsible for sending you a new SSN card, you are responsible for getting a card without these restrictions. Just go to SSN and bring your green card to get a new card.

Wait for citizenship. Then either get married (here or there) and file CR-1. Or don't get married (at least not yet) and file a K-1. Both will take several months. But the CR-1 comes with a greencard upon entry. It really depends when you want to be a part and when you want to be married.

Hi all,

Fairly new to site but can see a lot of helpful people here. I have a complex question that hopefully someone can help me with (note: might not be getting all the legal principles right):

If someone's conditional LPR was terminated because they failed to timely file the I-751 ROC but managed to receive an employment based LPR 7 months after, does that period of non-LPRness (word???) reset the continuous residency clock?

Details may be off but only thing I know for sure is that person is widowed (after she received LPR based on employment), has been LPR for a total of 4 and a half years (2 during conditional period, 2.5 during current LPR I believe). Is she eligible for N-400 right soon (within .5 years) or does she have to wait another 2.5 years because her status had been terminated?

Again thanks in advance and looking forward to input!


Have her send in the application for citizenship, if they accept it she is good. If they send it back she has to wait.

You have to wait 5 years or be married to a US citizen and have a greencard for 3 years. Sounds like the 5 years will be sooner. Just file the paperwork to show she has been a greencard holder for 5 years when the time comes.

  So hubby comes to me today with the story of a friend of a friend.   Don't know total details but here are the basics

 

   Person came to US with DV lottery , has 10 year gc  lives "back east"  probably either NC or GA if that makes a difference.

   Applied for citizenship , passed interview  supposely never heard about oath

   Made infopass , went in and they asked him why he had voted , he told them  his brother had brought the forms and he filled/sent them in. 

   They tell him he needs to return in 2 months.  

 

Hubby is thinking they are just going to give the guy his USC  because they asked him to come back. 

 

I am thinking they are getting ready to pull the filing and worse.  

 

 

 

 

 He needs to get an attorney to file for a cancellation of removal ASAP (assuming he qualifies)

I agree with the OP, I just get so upset with all these people who claim no intent to marry and immigrate, and you know full well that they had intent. This is not to say that everybody who adjusts status on another visa is misrepresenting themselves, but it is amazing even on this site how many people seem to think they can get away with it. Ergh. And here we all are, nervously thinking about our applications, wanting to be with the ones we love all because we actually want to follow the rules.

I doubt that she would be able to visit you in the US while the visa is processing because she has the ban from her overstay. You will overcome the ban with a waiver I believe filed after the interview at the consulate (which is effectively one of the last steps). You can still go to Canada and visit her or you can meet up in a third country.

You need to file for a CR-1 to bring her over on a spousal visa, this will take many many months, but it is the only option you really have as she was acting as though she was a permanent resident and overstayed.

Someone from who went through the same embassy you are going through would probably have the best answer.

Although I have found that if you are borderline meeting the poverty guidelines they may check the other returns, but if you clearly have enough then they won't.

If you have the transcripts you don't actually need the W2's at all. He definitely needs taxes for the most recent year but sometimes they require the past 3 years.

Only the 3024 is an old form, the others are Sept 2010.
