Good luck to you guys! Im sure it will be something simple that you can get resolved quick. From what I have read in other places on VJ, after they receive your RFE reply you'll get NOA2 fast.

I'm not as religious as my girl, but one thing I kept telling her was that God was testing us to make sure, that if we can make it through this process, we are good for life :)

I believe you are still well within the norm so contacting an elected representative probably won't do much good.

Depending on who your Congressman is, they may help you or not. My Congresswoman was totally worthless. I was able to obtain results from going to my senator (who sent the inquiry via the congressional channels). Just google for who they are and write them a paper letter. You may have to make a follow up phone call, but they will at least talk to you and try and help if possible.

Good Luck!

It seems like some people have better luck than others. Our petition flew through NVC.

WE MADE IT!!!!! Cristiane had her interview yesterday. We were the first in line and the 2nd to be interviewed. We were VERY nervouse, but the lady was very pleasant and talked to me almost more than she did to Cristiane. We were celebrating back at the hotel by 11:30am!!

One bad thing is they no longer allow you to come and pick up your passport at the Embassy anymore. You must wait for the courrier service to deliver it to you sad.gif

Ugh. The Brazil Embassy sent Package 3 to my girl's old address. Today they are sending out a new one. But apparently the mail service is ok strike! We're not having good luck here sad.gif

Would it be better for her to just go to the Embassy and pick up the packet herself?

US Embassy and Consulate DiscussionAffidavit of Support concerns, please help!
QUOTE (Penguin_ie @ Oct 16 2009, 09:18 AM) <{POST_SNAPBACK}>
If you were under the income guidelines for having to file taxes in the USA, you will need to provide a letter explaining that this is so. My husband was unemployed while living with me in Ireland, and that is what he did, it caused no problems.

Yes, as long as your mom and sister exceed the poverty level amount for their households (their husbands, kids and any other dependants) plus your fiancee, you will be ok. That being said, some embassies do not like multiple co-sponsors, maybe someone with experience from Spain will chime in on this. You will still be the primary sponsor, even without income, and will need to fill in a I-864; you can list your assets there, though technically you do not need to if you have a co-sponsor. They do not need to live int he same state, as long as they are legal US residents all is fine.

Paystubs tend to be prefered; if you do find a job, you can leave Spain as soon as the I-130 is filed and start working, so you'll have a couple of paystubs to send her for the interview. Usually, embassies will not accept offer letters as proof of jobs, unless it is a transfer within a company. Again, embassies have a lot of leeway to do their own thing with DCF and I do remember reading a recent case on here from London where the offer letter was accepted, but having a co-sponsor lined up would be better.

The mother and sister together cannot combine income. It has to be one or the other.

The OP's fiance is not from Spain, they just lived there I belive.

The OP needs to fill out the I-134 form at the consulate stage, not the I-864. They filed a K-1, not a K-3.....

US Embassy and Consulate Discussion1-134 questions
QUOTE (emmieme @ Oct 20 2009, 08:01 AM) <{POST_SNAPBACK}>
Hi everyone !
I have some question about the form 1-134 Affidavit of Support for my fiances interview at the London Embassy. I am the petitioner and I was wondering if you can help me clear up a few things?

1) I do not have a job or income at moment. Do I need to fill out an affidavit, even if I don't have income? Do I just fill in assets? I have some money in savings, but do I have to state where it came from? Is it okay if it came from my fiance? I also will have 2 co-sponsors.

2) Do they do background checks on the co-sponsors at the U.S consulate in London?

3) My mom is one of our co-sponsors. We will be residing with her at my parents house. How does she count the household size for the poverty level amount? Would my mom include herself, her husband (he is unemployed), my fiance, AND me if I don't have an income at the moment? Or would I not be included if my mom doesn't claim me as a dependent on her taxes?

4) My mom makes 19,000 USD a year and my parents own their own home. If her assests make up for the income required, then should I forget about having a second sponsor? Or should I play it safe with 2?

5) Does the U.S consulate prefer it to be all income and not assets?

Thanks you for your help!!!! Emily x

1. You will fill in the I-134 no matter what. You are the petitioner and therefore automatically the sponsor. You can fill in assets if you want, but either way it prob. won't make much of a difference.

2. I don't think that they do background checks at the consulate stage on co-sponsors.

3. You can only have one co-sponsor in the sense that everything does not add up. So one person has to make enough money to be the sponsor on her own. She would have herself, her husband and your fiance in her household I believe because you are filling out your own I-134 so you would be counted on your own.

4. I would say she would be definitely cutting it close for income. She would need $22, 887 in income to be able 125% for the 3 person household. For assets you need 5 times the difference in income. So in this situation she would need almost $20,000 in assets.

5. The consulates typically focus on income mostly. Obv. once assets are depleted they are gone. If I were you I would try to find a different co-sponsor who at least has a smaller family size.

My fiance's visa has been stuck in London since the end of July and we haven't heard anything from the embassy. Anyone know of the best way to contact the embassy?

I called the DOS on ours a few times and they told me it had not been received by the embassy. Odd thing is we got our packet 3 letter today dated Oct 3rd and postmarked the 14th. I called the DOS 3 times this month and every time they said the embassy didn't have it. Seems the right hand doesn't know what the left is doing.

I'd still take the advice on calling the DOS. I would also look into how to contact the embassy directly.

The NVC told me last night when they informed me our petition was finally released from AP that the US consulate's number in London is (dialing from the US) 011 44 2074999000. I hope this helps you. Good Luck and keep us posted. smile.gif Malena & Paul

I would not call that number as it can get hideously expensive. You can call DOS and they have the exact same information in the USA.

The State you live in is legally obligated to provide not only transportation for your son but education as well. And that education can be anywhere in the State. He will be placed with other special needs children where qualified educators will work with him. Contact the Department of Education in your city and inquire. Your daughter should not have been removed from daycare.

I know that was not your main point but you should be an informed parent.

This is good advice. Your son based on his special needs is, through the Americans with Disabilities Act, entitled to schooling and transportation which caters to his needs. If he has a diagnosed condition he is also entitled to receive disability payments.

Also in my opinion, as a teacher so take it for what you will, your son seems needs to be tested for something more than ADHD. I hope that he can eventually be treated effectively because you and he certainly do not deserve the life you are having to lead.

. It seems more like the a tyrant punishing us, not communicating with us on what we need to do and denying our case for reasons that have nothing to do with the love we have for one-another.

Not communicating with you? I believe it literally says on the visa which is in the passport that there is this requirement. If that's not communication in a way that you won't forget or lose it, I don't know what is.

You need to call up first to get the code to place in the subject line in order for them to even consider reading the email. If you have a valid reason they will give you the code which you will include in your email. Otherwise it will be deleted.

They are talking about the American fiance's name. They would not have an A# because they are not an immigrant.

I totally agree that there should be something done about frivolous denials. However, I have a feeling that many (not all) of the people on Visa Journey who complain about such situations have much more of a story then they are letting on. There is usually more of a reason for a denial then they mention or sometimes even know about. I would not worry about it until you yourself are in the situation you are talking about.
