I would assume that as soon as you have a Social Security card you would be able to study. It really depends on the school and what proof of residency that they want. You might want to contact one of your front running choices to see.

A sponsor should not reduce the chance of a visa being given (the petition is the first bit, the sponsor is for the actual visa) presuming that your consulate accepts cosponsors. Most do.

It doesn't matter what the relationship is. People often have friends or family who help out. You can put future sister in law if you want.

You will always need a sponsor. Whether it is through the I-134 or the I-864 it depends on the consulate, essentially they are the same thing. The petitioner is always the main sponsor, regardless of income. Any citizen or US resident can be a co sponsor, they just need the proper forms and enough income.

That estimate is only for the K1 petition. It still needs to go through NVC and on to your consulate where you need to wait for interview and have a medical. Add at least a few more months on to your estimate.

My guess is you should be planning a fall wedding, but then I wouldn't plan anything until I had that visa in hand.

My fiance and I submitted our initial K1 petition before the Christmas break. I am the sponsor, UK nationality so going via the US embassy in London. Although we are early in the process we are trying to plan our wedding later in the year (end of August) and had a question about a possible problems that we thought we should check.

1. If we arrange the wedding for August but dont have the Visa in time, can we go ahead with our plans, me fly in, get married in the US and then I would have to leave presumably. Would we need to advise them we had got married during the process and would there be a problem coming into the country without a Visa yet in order to get married whilst still in the process to obtain one.

Not sure if there is any other complications we might not have considered yet, although I am trying to look through the vast quantities of info to cover everything, so any advice welcome.

Wait so are you both living in the UK? If you are then you can marry and do a DCF and you will get your visa very quickly if that is an option for you.

Hi guys

I am pretty new to visa journey, but my fiancee and I are in the process of applying for a K1 visa to bring me down to the USA (from Calgary, Alberta, Canada).

We have sent in the paperwork, etc, and received an NOA1. We have set the wedding for August 31st, 2013.

The big question is will we have enough time for this wedding date to work? I just filled out the timeline today, and it is predicting our 129F may be adjudicated between June 22, 2013 and July 30, 2013*.

Is this a pretty good estimate? Or are these playing on the safe side of things?

If you have been in this situation before, please let me know how things turned out!

I think he estimate of the date is correct, but it still has to go through the Department of State and on to the embassy where they will send you paperwork and you need the medical and you need to wait for an interview date. August 31st is probably not a safe bet.

*Edit currently the average time between the embassy receiving your information and you having an interview is 82 days. So even June 22 + 82 days will mean you miss your wedding.

1. If you are using bank funds to substantiate the 125% above the poverty line then yes. If you have more then enough income without accounts then no.
2. You need W2's and a letter from your employer, you should also have tax transcripts for the past few years.
3. i don't think so, it will be the same interview so I would guess the same information would suffice. Someone may correct me on that.

Your first step is simply to prove you have met within the past two years. This should be with passport stamps, boarding passes, etc. Pictures can help. Depending on your consulate you may want to front load your petition with pictures. Don't overwhelm them with all the print outs, pick a selection over the years to show your communication. Assuming that you do not have any dependents then $30000 should be more then sufficient for the affidavit, but you don't need to worry about that at the moment.

London will accept a cosponsor. Your fiance is always the first sponsor. If you need a cosponsor you can have one, she will fill out the I-134 as well and provide needed documents. Your fiance needs to fill out the I-134 just like the cosponsor even if there is no money, write a note saying the fiance was not required to file taxes for those years. You do not have enough money to self sponsor with your assets (it needs to be several times the poverty line to use assets, car will not really count as you need that). If your cosponsor has enough income that is all you need.

I'm a British Citizen who was denied a student visa in the winter of 2010. I believe that the reason for my denial was that I could not prove I had strong enough links to the UK, or something like that anyway, it was a while ago now.

My question is: Would being denied a student visa in the past have an impact on a k-1 visa application?

You can't play the blame game, at the end of the day it is your petition so you have to be responsible for it. Simple. I wish it was that USCIS would be helpful on the phone, but that is not the case here nor for others who have called unfortunately. That's why filers need to be proactive. No one will care more about your case then you do.

That's OK, like I said I feel foolish now. The thing is, I downloaded the I-129F instructions, and also the Fiance help pdf. None of them say I need to submit evidence of anything with the I-129F form. I knew more would be required eventually, after the I-129F is approved and when going for the interview, but I did not know I needed to submit a whole packet with the initial form. I was just in the Philippines in May, and also last year, so I have met her 2 times in the last 2 years. I can easily prove everything. I mostly used Xoom to send her money, but they for some reason closed my account, so for a while I used Western Union, but I was eventually able to create a new account with Xoom and have mostly been using them for the last year.


But it does say very clearly that you need to submit other things! There are 7 pages of instructions outlining what you need in convenient questions such as what should I include?

There are a lot of forms to fill out in the whole immigration process. I am just trying to stress to you that you aren't going to get anywhere if you don't sit down and just reading it first.

Now, I imagine some people will dislike this simply because expediting is kinda like queue-jumping, and well, I'd rather not unless I really had to. Which it seems I do. My situation is that my mother, with whom I live, here in the UK is being made redundant very soon, and I myself are in between jobs. Firstly I was wondering if this would be sufficient grounds to have our case expedited as this could potentially leave me homeless. The reason for the need to move to the US faster is that my fiance's grandparents in America have offered to let us stay there rent free until we're able to get on our feet with our new life together etc.

Secondly, my fiance in the US currently doesn't make enough so we'd end up using a co-sponsor when it comes to consulate/embassy stage. We were just wondering if the fact that we expedited this for my (Beneficiary) financial issues at the USCIS stage would affect the later interview stages when it comes down to finances?

Well presumably your mother would have to find a place to live whether you lived there or not. She's not just going to wander the streets I'm sure. So why can't you continue to live with her while you wait?

Actually we have seen at least 2 members getting denied after 5 to 6 months of waiting because they forgot the G-325A when they sent the I-129F package (you can ask Novembro about it if you want. She got many advice to just wait for a RFE. It didn't happen, she got denied, even if she had been trying to send the missing form to the USCIS and to have it add to her case for at least two months. She then got married and is now in a CR-1 process... )

You can wait a little bit see, if they reject your package immediately (http://www.uscis.gov...i-129finstr.pdf ("Improperly filled forms will be rejected and the fee returned, with the instructions to resubmitt the entire package") or you can call the USCIS saying your form was filled improperly, and see if they can return it to you with your fee right away.

If this doesn't happen, withdraw your petition and refill. Forgetting a form is a serious risk for denial. RFE is probably not going to happen so don't wait 6 months only to get denied and refill then.





There is no way USCIS is returning that fee.

You are after that date so they technically haven't gotten to you yet at least according to their processing times listed. Their official processing time is for July 18th. Therefore they are not going to take any action if you are still within their advertised time frame. They are usually only willing to put in a service request if you are outside of their processing times. You are three months out of their processing times so help will be unlikely.
