K-1 Fiance(e) Visa Process & ProceduresAfter arriving in the US
I think you have to wait for a couple of weeks so that her name is in the system and then you can go to an SSA office to apply.

Congratulations!!!

Things should go a lot quicker now that you are out of the balck hole that is VSC. I would recommend taking a look at the timelines for your embassy to get a general idea about wait times.

K-1 Fiance(e) Visa Process & Proceduresembassy address
The letter of intent is used at both the petitioning stage and at the embassy interview.

If you are sending the letter of intent with the initial K-1 petition to CSC, use the USCIS address.

If it is for the interview then use the embassy address in Lagos.

K-1 Fiance(e) Visa Process & ProceduresI-134 Q11. I intend/do not intend to make specific contributions to the support of the person(s) named in item 3
As DKM noted above, the I-134 is also used for visitors visas.

As someone who is coming here as a fiance(e) it is assumed that they are on the path to permanent residency. Also, remember that when filing AOS we fill out the I-864 which is legally binding.

So, for K visas, this question of intend/do not intend is not applicable.

BTW: the example is from VJ.

K-1 Fiance(e) Visa Process & Proceduresif NOA2 receive what do i do?
Having a copy of the petition is so that your fiance can see what you sent to USCIS. You can just let your fiance know what it was you sent to them. USCIS is not going to return your petition. If you don't have the original petition don't worry about it.

A copy of the letter of intent is here: http://www.visajourn...r_of_Intent.doc

The proof that you send with your fiance to the interview does not have to be the same that you sent with your petition. At the interview you want to be able to prove your ongoing relationship so only include evidence from the time you sent the petition up to the interview. You can send originals if you want, but if you want the originals back make sure you have copies to give to the CO. What originals did you include with your petition? It is possible that these will not be necessary for the interview.

As for what to do after the NOA2, I would just follow the guides here on VJ.

Hope this helps smile.gif

K-1 Fiance(e) Visa Process & ProceduresNOA2 expiration date
The expiration is basically a timeframe for you to have your interview. Most people will have the interview within 4 months of approval. Others have to wait. If your interview falls outside the window then you can just shoot an e-mail to the consulate to extend your petition.

Once you have the interview your fiance has 6 months to enter the country, ie, the expiration of the NOA2 is no longer an issue.

K-1 Fiance(e) Visa Process & ProceduresI-134 Revison Level ?
Just use the latest version of the I-134 from the USCIS website.

Pay stubs are used to prove income.

I think that most people send more than one year's tax info to be on the safe side. You can get tax transcripts for free from the IRS so I think people just send it to be on the safe side. Tax transcripts do not need to be notarized.

You can go ahead and do duplicate I-134s but the consulate only needs one.

Another letter of intent is a good idea good.gif

I am lost, i sent them ds 230 part 1 and 2 :'*

i will have to call the NVC then

NVC or USCIS? I'm assuming the letter was an RFE from USCIS, so you will need to dial 1-800-375-5283 Then hit 1,2,2,4,2,1 Then enter receipt number, then 1 a couple more times.

Or was it from the embassy? Are you the US Citizen or the beneficiary?

either way, I'm sure it won't be too bad to straighten out.

NVC. He said he filed an I-130 for his wife and they send the DS230 and all that other stuff to NVC.

To the OP, please fill in your timeline so that people can be better equipped to help you.

Filing fee: $455

Other stuff: passport pictures, medicals, police report, plane tickets, mailing documents, etc etc...all of these are going to depend on (1) the country and (2) the couples preference....I would say anywhere from $500+

K-1 Fiance(e) Visa Process & ProceduresProblem with Travel Plans at NOA2 time
QUOTE (ravivar @ Dec 26 2007, 12:04 PM) <{POST_SNAPBACK}>
Thanks to everyone for replying. I really appreciate it, and I know everyone is busy due to the holidays.

So now, based on what you guys are saying, I guess this should be my plan. Please let me know what mistakes I'm making:

- Send I-129F now.
- My friend whose address I will use with USCIS will contact me in India when I've received the NOA2. I can let the NOA2 sit here untouched until I come back.
- My fiancee will receive notice from Mumbai interview requesting that she pick up forms and checklist.
- I come home, even a couple months after she receives word from the embassy, get the NOA2, get I-134 and everything filled out and notarized, and send this packet express to India.
- After receiving my mail, my fiancee notifies the Mumbai embassy that she's ready to schedule her interview

From what you guys said, it also seems like the one thing I should be worried about is if I get an RFE while I'm away. Is this correct?

Thank you guys again, much appreciated

Looks like a good plan good.gif

Yes, the only thing I would worry about is the possibility of getting an RFE because the responses to that is time sensitive and you want to deal with that ASAP. Other than that, once you send the I-129F you should be good to go.

Your fiance may receive an interview date, ie, she may not need to actually schedule it (you may want to check and see what the procedure is in India). But in any case, you can send her all the other info when you get back to the States.

Good luck with everything smile.gif

K-1 Fiance(e) Visa Process & ProceduresProblem with Travel Plans at NOA2 time
It is best if the financial documents are dated as close to the interview as possible. Most people will have them dated a month or so before the interview.

Your fiance takes the I-134 to the interview but, if you are in India you can get it notarized at the US consulate there if you want.

Once you get the NOA2 the consulate your fiance will have the interview will be contacting them. No more communication from USCIS for you. As long as you have an address for you to get the NOA2, you should be fine. Is someone going to be chekcing your mail? You may want to have someone do that on the chance that you receive an RFE and need to respond to it because that information is not available via the USCIS case status website.

I'm not sure what the case being abandoned or rejected is about.

You can use the value of your house on the I-134. You need to show something stating that you own it and how much it is worth.

Check out the example I-134 here: http://www.visajourn.../Form-I-134.pdf

Thank you ZeeNusah, would you also send the I864 at the same time?

Since you filed a K-1 you just need the I-134 for the interview.

When your fiance gets here and you file for adjustment then you use the I-864.

it's funny you ask...my husband just mentioned that today..

i'm the US citizen and i received a letter in the mail about 3 days after the interview was scheduled [about 3 or 4 weeks ago i think] and i spoke to my husband earlier today and he says he JUST received the letter today.....imagine we were depending on the egyptian postal service throughout this process!?!?

so the answer to your question would be---they contact you through mail...the US citizen or whoever you chose as your agent will receive the letter and a copy will also be sent to the beneficiary, who is in egypt, i'm guessing...

however, you have the choice of calling the NVC two weeks into each month, you'll find out a little earlier that way..

also, here's the website they're going to tell you to visit:

http://travel.state..../info_3731.html

good luck with everything...wishing you a smooth and super fast process!!

all the best!! heart.gif

Since the OP is applying for a K1 the process is a little different. NVC schedules the visa interview ofr CR1 while the embassy schedules the interview for the K1 and sends the letter to the beneficiary.
