If you are talking about financial benefits, I would say stick to the K1. Getting married while it is in process means that you will have to reapply for another visa and gather all the documents over again.

Just stick with the K1 since you already filed it.

It does not need to be an exact copy. It is mostly so that your finacee can see what you sent USCIS and look over in case they ask her any questions about it.

Now for all originals of the documentary proof, what would this consist. I know we don't send our passport. So far I have in mind is my original birth certificates. I'm I forgetting something?

This would be for things like a divorce decree or something like that. You do not need to send your passport. I sent my original birth certificate but they did not ask for it.

3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
This may sound redundant, but can someone provide an example please?

4. I-134 Affidavit of Support form. Ensure it is notarized (by a US Notary Public), with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
So only the I-134 Affidavit of Support form needs to be notarized? Do my supporting evidence needs to be notarized?

Only the I-134 needs to be notarized.

5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and useful information on the Affidavit of Support Form.
Would this be, the date my bank account opened, statement with total amount deposited last year, my current statement, Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead., ?? Question #7 on the I-134 form, it ask for you to list savings, stocks, bonds, mortgages, do I need to provide or write anything down for those if my annual income is 25,000+ for me and my fiancee? If so, Do I need to provide document to prove that?

If you meet the requirements on income alone you do not need to add anything else. Just provide your pay stubs, letter from employer and your tax information. Double check on your fiancee's packet 3 with the number of years of tax info they want. Some want 1, others 3.

6. A copy of the NOA2 that you received in the mail.
This part is probably the easiest. hehe

7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

Ok, tell me if I have enough or if it's valid. I have Skype phone history, MSN chat log (even though we video cam more than typing), print screen of our video cam for visual pictures. I really can't think of anything else, can some of you guys tell me what your fiance(e) bought to the interview????

We had e-mails, phone records, text message records and chat logs. We also included my boarding passes from my last trip before the interview and pictures we took together and with some friends and family when I was there.


To my understanding, I need to send 2 copies of I-134 packet to my fiancee? Questions about I-134, #11, What is some example I can put here??

With her current student income earned as a teaching assistant and my assets, cash and shares, we would have enough to qualify still. So I think the best course of action will be to try and have them accept her letter of employment (when she gets it in August) as well as her financial records as you stated above. One thing you could do is have your fiancee write a letter explaining her situation. I was at my job just over a year after grad school before my fiance had his interview and I wrote a letter explaining why my income for the previous years was under the poverty level. At the interview, the CO asked for the I-134 and the letter from my employer. He then looked at my tax return to confirm my income but did not keep my tax returns (I provided 3 years worth).

If I were you, I would have a cosponsor lined up. If you happen to have your interview a couple of months after your fiancee starts working it is possible that they may not fele it is sufficient. Some consulates are more strict about this than others. Have one lined up just in case. You may not need it.

FYI: in general, the CO will not count the income of the beneficiary so you may not be able to use your resources. I would check with your consulate to double check though.

You can start looking into get documents ready that will be needed for the interview. Some of the documents need to be fairly recent to the interview date (pay stubs, I-134, letter of employment, etc). Some stuff you can start gathering (tax transcripts if you need them) and proof of ongoing relationship stuff.

When your petition is approved, the service center forwards it to NVC where they assign a case number and then it is sent to the embassy where your fiance will have the interview. When that happens NVC will send you a letter with your new case number basically saying that they received your approved petition and they will forward it to the embassy within a week. They do not need anything from you. The K-1 petitions do not stay long at NVC, a few days maybe (if they are not delaying processing like the rest of the system).

The dates on VJ are just an estimate and are calculated based on info from other VJers so I would not worry too much about the dates moving. What matters is when you get that actual approval from USCIS.

A lot of May filers are still waiting for approval so you probably have a little bit more of a wait ahead of you. Of course, it does not hurt to call but it may not do much good at this point.

Today I totally broke down when I was talking on the phone to my mom. This process can suck so much out of you. But we have to resolve to stay strong through this and continue on so that we can be with our loved ones. We need to stay positive and make sure that this process does not break us. Like they say "what doesn't kill you makes you stronger".

This is why VJ is such a great place because I can share my story with others who will actually understand.

Are you talking about checking the case status online?

If you want to do that you need your case number (WACxxxxxxx). You can find it on the paper notice of action (NOA1) that you got in the mail or on the back of your cashed check that you sent with your petition.

Sign up at this website: https://egov.uscis.g.../jsps/index.jsp

And then you can set it up to e-mail you when your case status changes (like if you get an RFE and when you get approved).

There's no reason the K-1 should affect your financial aid. However, once you are able to list her as a dependent on your taxes, it will probably have some effect. You should talk to a student financial counselor on the effects of having a spouse on your pell grant. But the mere act of filing and receiving a K-1 will not affect it.


From what I thought you are more likely to get a Pell Grant will married because you are no longer dependent on yoru parents. I was just concerned because I would have to declare my dependent as a foreign or international right?



Yes, once you get married you will be declared an independent student and your wife will be your dependent (as long as you provide half of her support).

If I am not mistaken Pell Grants are awarded based on need.

So if you need it you should be able to get it. Getting married may vary how much you get but not whether you get it or not.

Here are the criteria:

"Grant amounts are dependent on: the student’s expected family contribution (EFC) (see below); the cost of attendance (as determined by the institution); the student’s enrollment status (full time or part time); and whether the student attends for a full academic year or less."

"The EFC is the sum of: (1) a percentage of net income (remaining income after subtracting allowances for basic living expenses and taxes) and (2) a percentage of net assets (assets remaining after subtracting an asset protection allowance). Different assessment rates and allowances are used for dependent students, independent students without dependents, and independent students with dependents."

So it looks like you should be fine.

If you get married during the K-1 process you are now husband and wife.

You will have to start over with a spousal visa and abandon the K-1 thereby wasting time and money.

If you are wanting to get married soon just wait, get married and then file for the spousal visa.
